Kozhikode: The joint coordination committee of Samastha and its affiliated organisations decided to intensify protests if state govt failed to take favourable action on its demand for a rethink on changes in school timings.
The committee which met in Kozhikode said extension of school hours by half-an-hour adversely affected madrasa education. Samastha had earlier submitted a memorandum to chief minister, requesting a reconsideration of the revised schedule. It said education minister V Sivankutty contacted Samastha president Syed Muhammad Jifri Muthukoya Thangal and expressed willingness for a joint discussion on the issue.
"Samastha will present practical suggestions during the talks. If govt fails to respond positively, all units under Samastha will join together to intensify the agitation," said M T Abdulla Musliyar, convener of the coordination committee.
"Govt said there was no going back on the decision. Govt represents the people and it must take decisions considering public sentiment. When we speak of religion, it is education and when we speak of education, it is religion.
Education is the lifeline of Islam and it cannot be set aside," he added.
Earlier, Samastha secretary Umar Faizi Mukkam flayed Sivankutty's remarks and said that Samastha and Muslim community were a significant section in the state and no govt should be under the impression that they could go ahead by sidelining the community.

Court Acquits All Seven Accused Including Pragya Thakur, Cites Lack Of Evidence

A special NIA court in Mumbai has acquitted all seven individuals accused in the 2008 Malegaon blast case, including former BJP MP Pragya Singh Thakur and Lieutenant Colonel Prasad Purohit, after determining that the prosecution failed to establish guilt beyond reasonable doubt. Special Judge AK Lahoti delivered the verdict seventeen years after the devastating explosion that claimed six lives and injured over 100 people in the Maharashtra town. The court emphasized that mere suspicion cannot sustain criminal proceedings and acknowledged the prosecution's inability to substantiate allegations against the defendants. The September 29, 2008 blast occurred when an explosive device attached to a motorcycle detonated in Malegaon during the holy month of Ramzan. The town's significant Muslim population made the timing particularly sensitive, leading to widespread communal tensions and the controversial emergence of the term "Hindu terror." Judge Lahoti made pointed observations about the case's moral dimensions while maintaining judicial objectivity. The court stated that terrorism transcends religious boundaries but emphasized that convictions cannot be based solely on moral considerations despite the gravity of the incident against society. The acquitted individuals include Major (retired) Ramesh Upadhyay, Sudhakar Chaturvedi, Ajay Rahirkar, Sudhakar Dhar Dwivedi alias Shankaracharya, and Sameer Kulkarni alongside Thakur and Purohit. The case initially fell under Maharashtra Anti-Terrorism Squad jurisdiction before transferring to the National Investigation Agency in 2011. Investigators had alleged that the blast formed part of a broader conspiracy involving the Abhinav Bharat organization, purportedly seeking revenge for previous attacks on Hindus. The ATS claimed Thakur owned the motorcycle used in the explosion and that Purohit, then serving in military intelligence, facilitated explosive procurement and participated in organizational meetings. However, the court found no credible evidence supporting these claims. Regarding the motorcycle ownership, Judge Lahoti noted that forensic experts could not completely recover the chassis serial number, preventing definitive ownership establishment. The court also observed that Thakur had renounced material possessions and embraced sanyas two years before the incident. The judgment cleared Abhinav Bharat of terrorist activities, stating insufficient evidence linked the organization to terror operations. The court noted that material witnesses failed to support prosecution arguments and that conspiracy meetings could not be proven. Following the verdict, an emotional Thakur characterized the outcome as a victory for Hindutva, claiming vindication after seventeen years of legal proceedings that had devastated her life.

Seven accused, including BJP leader and former MP Pragya Thakur and Lt Col Prasad Purohit, were facing trial in the case for offences under the Unlawful Activities (Prevention) Act (UAPA) and the Indian Penal Code. Advertisement === Major (retired) Ramesh Upadhyay, Ajay Rahirkar, Sudhakar Dwivedi, Sudhakar Chaturvedi and Sameer Kulkarni were the other accused in the case. What the court said? Advertisement === The court instructed that the families of all six victims of the blast will be given Rs 2 lakh each, and all injured victims will be given Rs 50,000 as compensation. The court said: UAPA will not be invoked in this case as sanction was not taken as per rules. Both the sanction orders of the UAPA in the case are defective. Abhinav Bharat organisation was used as a common reference by the prosecution. There is no evidence that the money of the Abhinav Bharat was used for terror activities. Prosecution proved that a blast occurred in Malegaon, but failed to prove that a bomb was placed in that motorcycle. The court has come to the conclusion that the injured people were not 101 but 95 only, and there was manipulation in some medical certificates. What was the case? Six persons were killed and more than 100 injured when an explosive device strapped to a motorcycle went off near a mosque in the town, located about 200 km from Mumbai, on September 29, 2008. In its final argument, the NIA submitted that the blast in Malegaon – a town with a sizable Muslim population – was orchestrated by the conspirators to terrorise a section of Muslim community, disrupt essential services, create communal tensions, and threaten the state's internal security. The NIA has said that based on 'relevant, admissible, cogent, trustworthy, wholly reliable and proved evidence' it 'conclusively and cogently' established the crucial circumstances to form a complete chain of events. The charges comprised UAPA sections 16 (committing terrorist act) and 18 (conspiring to commit terrorist act) and various IPC sections, including 120 (b) (criminal conspiracy), 302 (murder), 307 (attempt to murder), 324 (voluntarily causing hurt) and 153 (a) (promoting enmity between two religious groups).
