Wisconsin Supreme Court clears the way for a conversion therapy ban to be enacted
The court ruled that a Republican-controlled legislative committee's rejection of a state agency rule that would ban the practice of conversion therapy for LGBTQ+ people was unconstitutional.
The 4-3 ruling from the liberal-controlled court comes amid the national battle over LGBTQ+ rights. It is also part of a broader effort by the Democratic governor, who has vetoed Republican bills targeting transgender high school athletes, to rein in the power of the GOP-controlled Legislature.
What is conversion therapy?
What is known as conversion therapy is the scientifically discredited practice of using therapy to 'convert' LGBTQ+ people to heterosexuality or traditional gender expectations.
The practice has been banned in 23 states and the District of Columbia, according to the Movement Advancement Project, an LGBTQ+ rights think tank. It is also banned in more than a dozen communities across Wisconsin. Since April 2024, the Wisconsin professional licensing board for therapists, counselors and social workers has labeled conversion therapy as unprofessional conduct.
Advocates seeking to ban the practice want to forbid mental health professionals in the state from counseling clients with the goal of changing their sexual orientation or gender identity.
The U.S. Supreme Court agreed in March to hear a Colorado case about whether state and local governments can enforce laws banning conversion therapy for LGBTQ+ children.
What is happening in Wisconsin?
The provision barring conversion therapy in Wisconsin has been blocked twice by the Legislature's powerful Joint Committee for the Review of Administrative Rules — a Republican-controlled panel in charge of approving state agency regulations.
The Wisconsin Supreme Court ruling means the conversion therapy ban can be enacted. The court ruled that the legislative committee has been overreaching its authority in blocking a variety of other state regulations during Democratic Gov. Tony Evers' administration.
The lawsuit brought by Evers targeted two votes by the joint committee. One deals with the Department of Safety and Professional Services' conversion therapy ban. The other vote blocked an update to the state's commercial building standards.
Republicans who supported suspending the conversion therapy ban have insisted the issue isn't the policy itself, but whether the licensing board had the authority to take the action it did.
Evers has been trying since 2020 to get the ban enacted, but the Legislature has stopped it from going into effect.
Legislative power at stake
The Legislature's attorney argued that decades of precedent backed up their argument, including a 1992 Wisconsin Supreme Court ruling upholding the Legislature's right to suspend state agency rules. Overturning that ruling would be deeply disruptive, attorney Misha Tseytlin argued.
Evers argued that by blocking the rule, the legislative committee is taking over powers that the state constitution assigns to the governor. The 1992 ruling conflicts with the constitution and has 'proved unworkable,' Evers said.
The Supreme Court on Tuesday agreed with Evers.
The issue goes beyond conversion therapy
The conversion therapy ban is one of several rules that have been blocked by the legislative committee. Others pertain to environmental regulations, vaccine requirements and public health protections.
Evers argued in the lawsuit that the panel has effectively been exercising an unconstitutional 'legislative veto.'

The US president, and his cabinet members such as Kennedy, have also overseen huge cuts and job losses across the US government. The taskforce is made up of a 16-member panel appointed by health and human services secretaries to serve four-year terms. In addition to cancer screenings, the taskforce issues recommendations for a variety of other screenings including osteoporosis, intimate partner violence, HIV prevention, as well as depression in children. Writing in its letter to Kennedy on Sunday, the AMA defended the panel, saying: 'As you know, USPSTF plays a critical, non-partisan role in guiding physicians' efforts to prevent disease and improve the health of patients by helping to ensure access to evidence-based clinical preventive services.' 'As such, we urge you to retain the previously appointed members of the USPSTF and commit to the long-standing process of regular meetings to ensure their important work can be continued without disruption,' it added. Citing Kennedy's own slogan of 'Making America healthy again,' the AMA went on to say: 'USPSTF members have been selected through an open, public nomination process and are nationally recognized experts in primary care, prevention and evidence-based medicine. They serve on a volunteer basis, dedicating their time to help reduce disease and improve the health of all Americans – a mission well-aligned with the Make America Healthy Again initiative.' According to the Affordable Care Act, public and private insurance companies must cover any services recommended by the Preventive Services Task Force without cost sharing. In a statement to MedPage Today, Department of Health and Human Services spokesperson Andrew Nixon did not confirm the reports, instead saying: 'No final decision has been made on how the USPSTF can better support HHS' mandate to Make America Healthy Again.' Reports of Kennedy's alleged decision to overhaul the taskforce come after the American Conservative published an essay earlier this month that described the taskforce as advocating for 'leftwing ideological orthodoxy'. It went on to accuse the panel of being 'packed with Biden administration appointees devoted to the ideological capture of medicine', warning that the 'continued occupation of an important advisory body in HHS – one that has the capacity to force private health insurers to cover services and procedures – by leftwing activists would be a grave oversight by the Trump administration'. In response to the essay, 104 health organizations, including the American Medical Association, issued a separate letter to multiple congressional health committees in which they urged the committees to 'protect the integrity' of the taskforce. 'The loss of trustworthiness in the rigorous and nonpartisan work of the Task Force would devastate patients, hospital systems, and payers as misinformation creates barriers to accessing lifesaving and cost effective care,' the organizations said. In June, Kennedy removed all 17 members of a US Centers for Disease Control and Prevention panel of vaccine experts. The 6-3 decision split along the court's ideological lines ensures that Trump will not face another blockbuster trial anytime soon - with the case sent back to a lower court to determine what is considered his 'official' versus 'unofficial' acts. Obama spoke out about the case via his spokesperson Patrick Rodenbush earlier this week, refuting many of the accusations circling around him. 'The bizarre allegations are ridiculous and a weak attempt at distraction. Nothing in the document issued last week undercuts the widely accepted conclusion that Russia worked to influence the 2016 presidential election but did not successfully manipulate any votes,' Rodenbush noted. 'These findings were affirmed in a 2020 report by the bipartisan Senate Intelligence Committee, led by then-Chairman Marco Rubio,' Rodenbush concluded. Hong Kong's CK Hutchison seeks Chinese investor to join Panama Ports deal
A Hong Kong conglomerate that's selling ports at the Panama Canal said Monday it may seek a Chinese investor to join a consortium of buyers, a move that could please Beijing but bring more U.S. scrutiny to the geopolitically fraught deal. CK Hutchison Holdings' initial plan to sell its port assets to a group that includes U.S. investment firm BlackRock Inc. pleased President Donald Trump, who has alleged that China interferes with the critical shipping lane's operations in Panama. However, they apparently angered Beijing and drew a review from Chinese anti-monopoly authorities. A Beijing-backed newspaper posted scathing commentaries about the deal, with one describing it as a betrayal of all Chinese. Beijing's offices overseeing Hong Kong affairs have reposted some of these commentaries, widely seen as an indication of Chinese leaders' stance. A Hutchison subsidiary has operated ports at both ends of the Panama Canal since 1997. After months of uncertainty brought by tensions between Washington and Beijing, Hutchison said in a statement that the exclusive negotiations period with the consortium has expired. However, it added 'the Group remains in discussions with members of the consortium with a view to inviting major strategic investor from the PRC to join as a significant member of the consortium,' referring to the People's Republic of China. The awkward position Hutchison found itself in for months highlights the challenges Hong Kong business elites face in navigating Beijing's expectations of national loyalty, especially when relations between China and the United States are strained. Hong Kong has overhauled its electoral system to ensure the city is run by 'patriots.' CK Hutchison is owned by the family of Hong Kong's richest man, Li Ka-shing. It announced March 4 that it would sell all its shares in Hutchison Port Holdings and in Hutchison Port Group Holdings to the consortium that also includes BlackRock subsidiary Global Infrastructure Partners and Terminal Investment Limited, a subsidiary of the Mediterranean Shipping Company. In May, Hutchinson co-managing director, Dominic Lai told shareholders that Terminal Investment was the main investor. Its parent company is led by Italian shipping scion Diego Aponte, whose family reportedly has a longstanding relationship with Li's. The initial deal, valued at nearly $23 billion including $5 billion in debt, would have given the consortium control over 43 ports in 23 countries, including the ports of Balboa and Cristobal, located at either end of the canal. That agreement also required approval from Panama's government. The deadline for their exclusive negotiation period ended on July 27.
