JAC Act not binding in judge appointments, says Azalina
The Minister in the Prime Minister's Department (Law and Institutional Reform) said the Act's main role was to screen, evaluate and recommend candidates to the Prime Minister, while appointments to the Federal Court, Court of Appeal, and High Court must still follow Article 122B of the Federal Constitution.
"The JAC Act is not a final step in the appointment process. It only recommends names, and these recommendations are not binding.
"For JAC's role to be legally binding, the Constitution would need to be amended,' she told reporters after officiating the 22nd Pengerang Umno division delegates meeting on Sunday (July 13).
Azalina also cited a previous explanation by former minister in the Prime Minister's Department, Datuk Seri Mohamed Nazri Abdul Aziz, who clarified in Parliament that the JAC Act was an administrative provision and does not have binding legal effect.
On the planned march by the Malaysian Bar on Monday (July 14), Azalina said it was within their democratic right, as long as it was carried out professionally and within the boundaries of the law.
"If they want to march, that is their right. As lawyers, I believe most of them are professionals who understand Article 122B and the JAC Act 2009,' she said.
Meanwhile, Azalina said that the appointment of a new Chief Justice would only be decided after the 269th Conference of Rulers, scheduled to be held from July 15 to 17.
On Saturday (July 12), Muslim Lawyers Association (Pembela) chairman Datuk Zainul Rijal Abu Bakar urged for the appointment process to be expedited, citing the recent and upcoming retirements of several senior judges.- Bernama

Auditor General's appointment adheres to law, says A-GC
KUALA LUMPUR: There's no requirement for Datuk Seri Wan Suraya Wan Mohd Radzi to retire, as her appointment as Auditor General (AG) was made in accordance with the law, says the Attorney-General's Chambers (A-GC). In a statement, the A-GC said that based on Article 105 of the Federal Constitution and subparagraph 1(1) of the First Schedule to the Audit Act 1957, the AG may be appointed from among members of the public service. "Referring to Clause (2) of Article 105 of the Federal Constitution, when Wan Suraya was appointed as Auditor-General effective June 13, 2023, she no longer held any other positions in the Federal service and therefore ceased to be a member of the Administrative and Diplomatic Service scheme," it said. "However, although she is no longer part of the Administrative and Diplomatic Service, she remains a member of the general public service under Section 3 of the Audit Act 1957. "Given that her appointment as AG complies with legal provisions, there is no need for her to be retired in the interest of the nation," it added. Earlier this week in the Dewan Rakyat, Bersatu Chief Whip Datuk Seri Ronald Kiandee said the AG, appointed under the Federal Constitution, must be an independent individual with no ties to the executive branch and should not be part of the country's administrative structure. He claimed that Wan Suraya was still a member of the Administrative and Diplomatic Service scheme and urged the government to clarify whether the appointment fulfilled the requirement of separation from the executive. Meanwhile, opposition lawmaker Datuk Seri Takiyuddin Hassan also questioned the legitimacy of Wan Suraya's appointment and whether it complied with the Constitution. Following that, Deputy Minister in the Prime Minister's Department (Law and Institutional Reform) M. Kulasegaran said her appointment is legitimate and in line with the Federal Constitution and Audit Act 1957. During the ministry's winding-up session on the AG Report 2/2025, Kulasegaran said there was no issue regarding Wan Suraya's appointment and that legal provisions governing the appointment process were clear. Earlier today, unity government spokesman Datuk Fahmi Fadzil said the appointment of Wan Suraya is constitutional. He said this was confirmed by the Chief Secretary to the Government, Tan Sri Shamsul Azri Abu Bakar, during today's Cabinet meeting.

PN endorses United Opposition Front to coordinate stand on key national issues
KUALA LUMPUR: Perikatan Nasional's (PN) Supreme Council has reviewed and endorsed a proposal to form Barisan Pembangkang Bersatu (BPB), or the United Opposition Front, aimed at forging consensus on key national and public interest issues among political parties outside the ruling coalition. The proposal, presented by PN chairman Tan Sri Muhyiddin Yassin today, outlines the formation of a structured platform to enable opposition parties to take joint positions on matters affecting the people and the country. In a statement issued after the meeting, PN secretary-general Datuk Seri Azmin Ali said the objective was to coordinate efforts among non-government political entities and align their responses to issues of national concern through a spirit of cooperation and shared responsibility. "The Supreme Council has agreed in principle to the formation of this opposition front and will initiate follow-up discussions with other political parties outside the government bloc," he said via the statement posted on PN's official Facebook page. He said the council viewed the proposal as a step forward in strengthening the voice of the opposition and ensuring the concerns of ordinary Malaysians are brought to the forefront of national discourse. "The supreme council sees it as a timely and necessary move to restore balance to the country's democratic process. We must unite all political forces outside the ruling bloc to ensure there is a credible, structured and effective opposition that can speak and act on behalf of the people," he said. Among the concerns raised were over the long-standing infrastructure issues in Sabah, especially water supply, electricity, and road access, that are said to have burdened the people for far too long," he said. Azmin also reiterated that PN fully supported the Himpunan Turun Anwar rally, describing it as a peaceful gathering reflecting the people's demand for real change. "This is not merely a protest. It is the people's expression of frustration and hope for a better future, free from economic oppression and authoritarian governance," he added.
