
SC recalls order after finding litigant obtained compensation by fraud
A bench of Justices Surya Kant, Ujal Bhuyan and Dipankar Datta adjudicated the dispute over the ownership of land between, which was purchased by three persons Reddy Veerana, Vishnu Vardhan and one T Sudhakar in 1997 and acquired by Noida in 2005 and now forms part of Noida's commercial hub in Sector 18.
It was alleged that Veerana fraudulently claimed sole ownership of the land in several proceedings before diverse judicial fora from civil courts to high court and to the Supreme Court in 2022 when top court had passed an order for enhanced compensation to Veerana.
Veerana was alleged to have fraudulently ousted Vardhan and Sudhakar and pocketed the compensation amount.
Vishnu Vardhan contested the claim of Veerana by initiating several proceedings and sought recall of the May, 2022 order of the apex court.
Justice Datta, who penned the verdict for the bench, said from the multiple decisions of this court on 'fraud, what follows is that fraud and justice cannot dwell together".
'The legislature never intends to guard fraud, the question of limitation to exercise power does not arise, if fraud is proved, and even finality of litigation cannot be pressed into service to absurd limits when a fraud is unravelled." The order added, 'However, even if Vishnu had not applied for a review – as a logical corollary of the aforesaid discussions – the decision in Reddy Veerana (2022 verdict) too having been obtained by Reddy by playing fraud, has to be erased from the records being a nullity." The bench also set aside the Allahabad High Court's October 28, 2021 verdict which accepted Veerana as the sole owner of the property and enhanced the compensation from Rs 152.04 per sq. metre to Rs 1,10,000 per sq. metre saying the fraud has vitiated the entire proceedings.
'As a logical corollary of the impugned order being set aside, it would follow that the decision of this Court in Reddy Veerana (2022 verdict), upholding the same, which too was obtained by playing fraud, will also be a nullity, and thus stand recalled in exercise of our inherent powers," the bench ordered.
Referring to a 1994 verdict of the apex court, the bench said that fraud was held to be an act of deliberate deception with the design of securing something by 'taking unfair advantage of another: a deception in order to gain by another's loss".
'We begin with recording the realisation that undoubtedly, there seems to be much more than what has met our eyes. However, like all courts, we are bound to decide cases based on the evidence on record, judicially noticeable facts, and the applicable law. Despite Reddy and Vishnu – and to a certain extent Sudhakar – having used the judicial process obviously to secure their personal interests, we cannot be a bystander," it said.
The verdict continued, 'If things have happened with a telling effect on public interest, resulting in public funds from the public exchequer being drained, the same has to be dealt with within the bounds of our jurisdiction. In our pursuit for the truth and to uphold the rule of law, we must adhere to established principles unless a valid reason warrants deviation." The top court remanded the case back to the high court and with a direction to implead Vishnu Vardhan and T Sudhakar, the other two owners of the land as additional respondents. PTI MNL MNL AMK AMK

Assets worth crores recovered from engineer
Bhubaneswar: Continuing its crackdown on State government officials involved in corrupt practices, the Odisha Vigilance on Tuesday conducted simultaneous searches at locations linked to an Assistant Engineer of the State Works department, following allegations of amassing assets beyond his known sources of income. 'On the allegation of possession of assets disproportionate to the known sources of income, simultaneous house searches were conducted on the properties of Raja Kishore Jena, Assistant Engineer in the Roads and Buildings division-III, in Bhubaneswar on Tuesday at 10 places in Bhubaneswar and Nayagarh,' a Vigilance official said. The locations where the raids were conducted include Jena's paternal house located at Jagannathprasad in Nayagarh district, his office chamber and his in-law's house, shops and other properties owned by the Assistant Engineer in Bhubaneswar and Nayagarh. As per official sources, 10 teams of Odisha Vigilance comprising seven Deputy Superintendents of Police (DSPs), five Inspectors, one Sub-Inspector (SI), 11 Assistant SIs, and other supporting staff conducted the search on the strength of search warrants issued by the Vigilance Court of Special Judge in Bhubaneswar. The anti-corruption officials have reportedly unearthed properties worth several crores possessed by Jena and his family members. The Vigilance officials found Jena in possession of a multi-storeyed building at Niladri Vihar and two flats in Bhubaneswar worth several crores of rupees. He also reportedly owned two shops at Utkal Kanika Galleria Mall and Symphony Mall in Bhubaneswar, 13 high value plots, including nine in Bhubaneswar, three in Nayagarh and one in Khurda district. Jena has allegedly invested Rs 75 lakh in bank, postal and insurance Vigilance officials also unearthed cash and household articles worth more than Rs 30 lakh. Notably, Jena had joined in government services as Junior Engineer on October 3, 2007, with a consolidatedsalary of Rs 5,000.

Police bust mobile theft gang; nine stolen phones recovered
Hyderabad: The Jeedimetla Police have apprehended members of a notorious gang involved in phone snatching and thefts targeting innocent people. Police arrested five individuals and recovered stolen property, including two motorcycles and nine mobile phones, valued at Rs 3.5 lakh. The case was cracked through meticulous investigation involving CCTV footage analysis, technical surveillance, and verification of suspect databases. Police arrested R Vijaynath Varun, 19, of Kukatpally; R Shiva, 21; R Naresh Nayak, 23; Kumar; and Venkat, all residents of Jagadgirigutta. Meanwhile, Abdul Shahed, Syed Kaleel Ahmed, Mohd Akhil Ahmed, and Syed Irfan are absconding. According to police, on July 27, a complaint was received from Kum D Akhila, of Quthubullapur. She stated that after finishing work, she was proceeding to her hostel and walking towards Shapur Nagar Busstop while talking on her phone. Upon reaching near Subham Hotel, two unknown offenders on a black coloured bike approached her from behind, forcibly pushed her, and snatched her phone. Due to their actions, she sustained an injury to her right ear. She further stated that she could identify the pillion rider of the bike as wearing a red coloured shirt. K Suresh Kumar, Deputy Commissioner of Police, Balanagar Zone, said that all the gang members were addicted to alcohol and consumed ganja. The accused, Varun, Shiva, Naresh, Kumar, and Venkat, used to assemble regularly in the evenings in open areas behind Metro Station, Vignanpuri Colony, Sangeeth Nagar, Kukatpally, and Jagadgirigutta bus stop, where they consumed alcohol and ganja. Under the influence, they roamed around the areas of Kukatpally, Jeedimetla, Madhapur, JNTU, Prasanth Nagar, and Moosapet with the intention of committing thefts, forcibly snatching mobile phones by assaulting individuals, and engaging in automobile and ordinary thefts. They specifically targeted individuals walking alone, particularly women who were talking on mobile phones or appeared to be vulnerable. The DCP stated that footage from over CCTV cameras covering possible escape routes was analysed. By matching the modus operandi (MO) with known criminals and verifying suspect records, the accused were successfully identified and apprehended, and the stolen property was recovered. The accused, along with other associates, were previously involved in mobile phone snatching, automobile theft, and ordinary theft cases across various police stations in Cyberabad and Hyderabad. Shiva was previously arrested in a rape case, and Naresh has a criminal history of 11 cases.

Tamil Actor S Srinivasan Arrested In High-Value Loan Fraud Case
New Delhi: Tamil film actor and self-styled doctor S Srinivasan also known as 'Powerstar' was arrested by the Economic Offences Wing in the national capital in a high-value loan fraud case, according to officials. According to officials, Srinivasan had promised to arrange a loan of Rs 1,000 crore for a firm, but cheated Rs 5 crore from it. The police said that Srinivasan was declare by the court as a 'Proclaimed Offender' twice. He absconded from trial proceedings since 2018 and he was the mastermind of a large-scale conspiracy to cheat the complainant company to the tune of Rs 5 crore on the pretext of arranging a Rs 1000 crore loan. Investigation revealed fraudulent diversion of funds for film production and personal use. The accused was found to be involved in six similar cheating cases in Chennai The Economic Offences Wing of Delhi Police traced Srinivasan to Chennai's Vanagaram area, with the help of local intelligence and technical surveillance. On July 27, he was arrested from Chennai's Golden Treasure Apartments, the Delhi Police said adding that he has been remanded to judicial custody. According to Delhi Police, in December 2010, the Complainant Company Blue Coast Infrastructure Development Ltd. was approached by Henry Lalremsanga, Deepak Banga, Anil Varshney, and Ramanuja Muvvala, who presented themselves as experienced consultants capable of securing a loan of Rs 1000 crores for hotel and corporate investment purposes. They assured that in case the loan is not sanctioned, they would refund any upfront amount paid, within 30 days. The consultants then arranged a meeting of the Complainant with Srinivasan, who claimed to be the proprietor of Baba Trading Company and a long-time lender capable of arranging the Rs1000 crores loan. Following this the complainant paid an upfront amount of Rs 5 crore, purportedly for purchasing special adhesive stamps (at 0.5% of the loan amount). However, no loan was arranged, nor were Rs 5 crore returned, and the post-dated cheque given as a counter guarantee was also dishonoured by the bank due to insufficient balance. Investigation revealed that Rs 5 crore was transferred on 27.12.2010 to s Baba Trading Co. from the complainant company, and then into bank accounts controlled by accused Srinivasan and his wife. He withdrew Rs 50 lakhs in cash and transferred Rs 4.5 crores into a joint account. An FD of Rs 4 crores was later made and seized. During the investigation, the accused Srinivasan was arrested and interrogated. He failed to produce any proof of purchasing adhesive stamps, showing a clear intent to cheat. He was first granted interim bail on 27.09.2013, with a commitment to repay Rs 10 crore within 15 days, of which he paid only Rs 3.5 lakh. He absconded and was declared a Proclaimed Offender (PO) in April 2016. He was re-arrested on 07.03.2017, granted bail again on 02.06.2017, and once again evaded trial, leading to a second PO declaration on 14.11.2018. The 64 year-old accused Srinivasan was also found involved in six other cases registered in Chennai with the same modus operandi.
