Property owners challenge City's new proposed fixed charges in court

THE constitutionality of the City's decision to link certain fixed charges to property values in its amended Budget for 2025/26 will come under the spotlight when the South African Property Owners Association (SAPOA) hauls the DA-led administration to court.
The organisation has taken issue with the City's cleaning tariff, the fixed water charge, and the fixed sanitation charge, saying these three items of the budget were in fact property rates imposed outside of the legislation which governs the imposition of such rates.
However, Mayor Geordin Hill-Lewis believes that the court application is an attempt to go back to a system of regressive taxation which hits ordinary families, and the poor, the hardest.
SAPOA's membership currently comprises more than 90% of the country's commercial and retail property industry, including some of the largest property-owning companies in South Africa.
The properties owned by their membership include the V&A Waterfront (co-owned by Growthpoint), Canal Walk Shopping Centre (owned by Hyprop), Cape Gate Shopping Centre (owned by Hyprop), Table Bay Mall (owned by Hyprop), Tyger Valley Shopping Centre (co-owned by Pareto), Blue Route Mall (owned by Redefine), Gugulethu Square (owned by Vukile), Atlantis City Shopping Centre (owned by Vukile), Sable Square Shopping Centre (owned by Spear), and Cavendish Square (owned by Old Mutual).
In his founding affidavit, SAPOA chief executive Nilesh 'Neil' Gopal said that the board resolved to take legal action to have the budget declared unconstitutional and invalid.

'They contravene the applicable constitutional and national legislative framework applicable to the imposition of rates and the levying of tariffs for municipal services,' he said in papers.
Gopal added that while they acknowledge the city's rebates that they offer, it mostly is to aid pensioners and isn't sufficient to offset the impact the tariffs will have on them.
'These reductions and rebates do not detract from the fact that the three items are unlawful and should not have been introduced in the first place: A reduction or a rebate cannot save a charge which was unlawfully imposed,' he said.
Gopal maintained that the continued rise in municipal costs had a significant detrimental effect on the costs of occupancy faced by tenants in commercial/retail properties.
'My point is that the systems of exemptions, reductions, and rebates established by the City under the Cleaning Tariff (as well as the Fixed Water Charge and the Fixed Sanitation Charge) are different from the Rates Act. It relies, however, on the General Valuation Roll ("GV Roll') established under the Rates Act. It is an impermissible parallel system of rates.
'For all these reasons, the Cleaning Tariff, while purporting to be a service, is a rate, but an unlawful one, because it does not comply, or even follow the scheme let alone the letter of the Rates Act,' he added.
The relief SAPOA is seeking is to have the budget declared invalid.
However, the order of invalidity should be suspended for two months to allow the city to deal with the revenue shortfall that will result from the invalidity of the three items.
Hill-Lewis said the city cannot agree that wealthy property owners should be charged the same as lower-income or middle-class households.
'This would be regressive, would place a disproportionate burden on ordinary families, and would be patently unfair.
'The city's budget protects homes under R2,5m and extends rates relief to many more middle-class homes, all while preserving the city's critical infrastructure and service investments,' said Hill-Lewis.
If SAPOA were to succeed in their argument, the effect would be 'to have ordinary families effectively subsidising the wealthiest property owners', said Hill-Lewis.
'Fixed charges linked to property value are a lawful, fairer, and equitable way for Capetonians to contribute within their means to our city's infrastructure programme and fixed service costs. Cross-subsidising – where the better off among us help to fund services for the less fortunate – is the only sustainable way to ensure a working city of hope for all,' said Hill-Lewis.
The Cape Town Collective Ratepayers' Association (CTCRA), an association with 56 ratepayer associations and civic organisations from across Cape Town, has thrown its weight behind SAPOA's decision, saying: 'This case is not just of importance to the ratepayers of Cape Town. If left unchallenged, there is a realistic possibility that other municipalities in South Africa will adopt CoCT's methods. It is critical that the rule of law, fairness in service delivery, and constitutional accountability are upheld – not just for our city, but for the nation.'

Founded by Julius Malema and his comrades on July 26, 2013, the party emerged from a deep frustration with the slow pace of change since democracy and the persistence of poverty, inequality, and racial divisions. Their rallying cry was clear: radical economic transformation, land expropriation without compensation, nationalisation of mines and banks, and the eradication of poverty. He reminded the crowd of Khayelitsha's history, founded in 1983 under apartheid as a relocation site for Black people forcibly removed from Cape Town. Despite decades of democracy, Khayelitsha still bears the scars of spatial apartheid: poor infrastructure, inadequate housing, unreliable water, and limited public transport. For many residents, these conditions have become normalised. Malema did not hold back in his criticism of the Democratic Alliance (DA), the party governing the Western Cape. He accused the DA of being a party that protects white privilege and sustains inequality by neglecting townships like Khayelitsha. While affluent suburbs such as Constantia and Clifton enjoy well-maintained roads and services, places like Gugulethu and Nyanga continue to suffer from neglect, overcrowded clinics, and dangerous streets plagued by gang violence. He added that the DA's failure to extend services such as the MyCiTi bus into these areas was described as deliberate exclusion. 'Spatial apartheid continues under their watch,' Malema said, framing the DA's governance as a continuation of apartheid-era divisions. He argued that the DA prioritises the comfort of the elite over the dignity and well-being of the poor majority. The party, he claimed, has no genuine interest in addressing poverty or unemployment, problems that affect over 43% of South Africans and hit the youth hardest. Malema also spoke about the broader economic challenges facing the country, saying that while other nations on the continent experience growth, South Africa's economy is stagnating. He criticised the control that white-owned banks and financial institutions hold over the economy, dictating who can access loans and property, and keeping wealth concentrated in the hands of a few. "At the same time, key state-owned enterprises are being weakened by defunding and attempts to privatise through outsourcing or fragmenting services." He pointed to the gradual dismantling of institutions like Eskom and Transnet, warning that the consequences are dire for the country's development and job creation. The looming debt crisis, with government spending over R420 billion this year just on interest payments, was described as a ticking time bomb that threatens social services such as education, health, and policing. To counter this, the EFF plans to push for laws requiring parliamentary approval of loans from the International Monetary Fund and World Bank. The party rejects neoliberal economic policies imposed by these institutions, arguing instead for a state-led developmental model focused on industrialisation and wealth redistribution. The EFF's rise from a small, radical movement into a force that commands respect across South Africa's political spectrum is no accident. Malema stressed that the party has remained true to its revolutionary principles, refusing to become co-opted by establishment politics or elite interests. The EFF's activism spans beyond Parliament, engaging directly with communities through land occupations, supporting workers' rights, and fighting gender-based violence. However, the party's growing influence has unsettled the political establishment. Malema recounted how even international figures have taken notice, including a visit to the White House where former US President Donald Trump played EFF songs 'Kill the boer' as a warning, which he repeatedly sang after concluding his speech. He criticised both the ANC and DA for forming uneasy coalitions motivated by fear of the EFF's growing power. In a pointed attack, Malema said the ANC has become riddled with corruption and tenderpreneurship, while the DA serves to protect white monopoly capital. Yet, both parties are united in their efforts to block the EFF from gaining control in any government. On crime and policing, the EFF expressed support for Lieutenant General Nhlanhla Mkhwanazi, who raised allegations of corruption and criminal syndicates operating within law enforcement. The party insisted on a parliamentary committee to investigate these claims, emphasising the need to clean up police and justice institutions. Looking to the future, the EFF is preparing for the 2026 local government elections with ambitions to govern outright in many municipalities. Malema urged party structures to strengthen grassroots organisation, win wards decisively, and deliver services that the DA has failed to provide. Ending poverty, combatting crime, and ensuring dignity for all remain the movement's key objectives.

China urges global consensus on balancing AI development, security

BEIJING - China's Premier Li Qiang warned Saturday that artificial intelligence development must be weighed against the security risks, saying global consensus was urgently needed even as the tech race between Beijing and Washington shows no sign of abating. His remarks came just days after US President Donald Trump unveiled an aggressive low-regulation strategy aimed at cementing US dominance in the fast-moving field, promising to "remove red tape and onerous regulation" that could hinder private sector AI development. Opening the World AI Conference (WAIC) in Shanghai on Saturday, Li emphasised the need for governance and open-source development, announcing the establishment of a Chinese-led body for international AI cooperation. "The risks and challenges brought by artificial intelligence have drawn widespread attention... How to find a balance between development and security urgently requires further consensus from the entire society," the premier said. He gave no further details about the newly announced organisation, though state media later reported "the preliminary consideration" was that it would be headquartered in Shanghai. The organisation would "promote global governance featuring extensive consultation, joint contribution and shared benefits", state news agency Xinhua reported, without elaborating on its set-up or mechanisms. At a time when AI is being integrated across virtually all industries, its uses have raised major questions, including about the spread of misinformation, its impact on employment and the potential loss of technological control. In a speech at WAIC on Saturday, Nobel Prize-winning physicist Geoffrey Hinton compared the situation to keeping "a very cute tiger cub as a pet". To survive, he said, you need to ensure you can train it not to kill you when it grows up. - Pledge to share AI advances - The enormous strides AI technology has made in recent years have seen it move to the forefront of the US-China rivalry. Premier Li said China would "actively promote" the development of open-source AI, adding Beijing was willing to share advances with other countries, particularly developing ones. "If we engage in technological monopolies, controls and blockage, artificial intelligence will become the preserve of a few countries and a few enterprises," he said. Vice Foreign Minister Ma Zhaoxu warned against "unilateralism and protectionism" at a later meeting. Washington has expanded its efforts in recent years to curb exports of state-of-the-art chips to China, concerned that they can be used to advance Beijing's military systems and erode US tech dominance. Li, in his speech, highlighted "insufficient supply of computing power and chips" as a bottleneck to AI progress. China has made AI a pillar of its plans for technological self-reliance, with the government pledging a raft of measures to boost the sector. In January, Chinese startup DeepSeek unveiled an AI model that performed as well as top US systems despite using less powerful chips. - 'Defining test' - In a video message played at the WAIC opening ceremony, UN Secretary-General Antonio Guterres said AI governance would be "a defining test of international cooperation". The ceremony saw the French president's AI envoy, Anne Bouverot, underscore "an urgent need" for global action and for the United Nations to play a "leading role". Bouverot called for a framework "that is open, transparent and effective, giving each and everyone an opportunity to have their views taken into account". Li's speech "posed a clear contrast to the Trump administration's 'America First' view on AI" and the US measures announced this week, said WAIC attendee George Chen, a partner at Washington-based policy consultancy The Asia Group. "The world is now clearly divided into at least three camps: the United States and its allies, China (and perhaps many Belt and Road or Global South countries), and the EU -- which prefers regulating AI through legislation, like the EU AI Act," Chen told AFP. At an AI summit in Paris in February, 58 countries including China, France and India -- as well as the European Union and African Union Commission -- called for enhanced coordination on AI governance. But the United States warned against "excessive regulation", and alongside the United Kingdom, refused to sign the summit's appeal for an "open", "inclusive" and "ethical" AI.

Image: Supplied Instead of uniting in their legal challenge against eThekwini Municipality's failure to repair the city's health hazard sewage infrastructure, the DA and ActionSA, who are joined court applicants, were at each other's throats. The two parties took the city to the Durban High Court over the sewage problem. The matter was heard at the Pietermaritzburg High Court on Thursday and Friday and was adjourned after the full bench reserved the judgment. In its 2022 affidavit, ActionSA alleged that the municipality had failed to maintain and repair its sewage infrastructure, which would have prevented untreated effluent from spilling into rivers, the ocean, and beaches. DA councillor Thabani Mthethwa said his party used the court action to expose the municipality's failure to deal with sewerage challenges. "It was only after court papers were filed that the municipality began to make superficial attempts to address the crisis, clearly demonstrating that without pressure from the DA, no meaningful steps would have been taken," said Mthethwa. However, in an unprecedented turn of events among conjoined applicants, DA's KwaZulu-Natal chairperson Dean Macpherson issued a damning press statement on Friday, alleging that the ActionSA's legal team came to court 'unprepared'. He alleged that the ActionSA's lawyers could not answer 'basic' questions from the court. Talking to this reporter, ActionSA provincial leader Zwakele Mncwango hit back at Macpherson, saying he was a lonely man seeking attention. Macpherson alleged that ActionSA's lawyers performed so badly that some of its embarrassed leaders hastily left the court. He said the DA effectively saved the legal action by spending the majority of Thursday and Friday presenting a strong argument that the ANC-led municipality was not complying with 'legally binding' national and provincial directives and lacked a credible action plan to fix the sewage crisis and rampant vandalism on the wastewater infrastructure. 'We also exposed that the municipality had not adhered to its water licenses. 'Unfortunately, the same cannot be said for ActionSA [as] their legal team was completely unprepared and was unable to answer basic questions from the court. 'Things got so bad for ActionSA that they were only able to argue their case for a mere 30 minutes before resigning in defeat,' said Macpherson. In reaction, Mncwango said he did not attribute the statement to the whole DA leadership, but only to Macpherson, whom he said was obsessed with ActionSA. 'Maybe he needs to get a boyfriend, I think he is just frustrated,' said Mncwango. He alleged that Macpherson was annoyed that the DA was forced by the court to join Action SA's application, which was filed on November 16, 2022, whereas the DA wanted to lodge a separate litigation, which it filed against the city in 2023. 'Because we did not want this thing to be about ActionSA, we invited all stakeholders, including political parties, to join us on this litigation so that we can be together in court. 'They decided not to respond, then four months later, they decided to go to court on their own,' said Mncwango. Mncwango said he was happy when the DA lodged its application, which was later joined with that of ActionSA. 'The only problem we had was that the DA, by joining our matter, delayed the matter because it was supposed to be heard some time ago, but the DA was not ready as it had to read affidavits. 'You have not heard us attacking the DA because I am happy that we are fighting together for the same residents; therefore, why must we provoke each other?' said Mncwango. He said he did not understand why the city was opposing the matter, instead of fixing the sewerage using part of its R1.5 billion, which was allocated to it to repair infrastructure that was damaged by floods. 'The municipality has an overall budget of R71 billion, which is why we asked how you prioritise your budget if sewage is your priority and you understand its impact on the environment,' he said. He said he was confident that the ActionSA legal team put up strong arguments. The DA supporters had on Thursday and Friday picketed outside the court in support of the court action. DA had applied for permission to picket. Mncwango said a group of ActionSA supporters were present outside the court, but not picketing because the party did not apply for permission. He said that while inside the court, he was alerted to the chaos caused by police attempting to disperse ActionSA members. He said when he questioned police about their action, they told him that the DA asked them to disperse the ActionSA members because they were picketing without permission. 'I went inside to call Francois Rodgers (DA provincial leader), who went outside and together with me spoke to the police, and the matter was easily resolved, but Dean was angry that the matter was resolved because he wanted a fight with the ActionSA. 'Therefore, I don't think that the statement was authored by the DA, but it was written by Dean with his anger issues, which is why I am saying that maybe he is looking for a boyfriend in the ActionSA' said Mncwango. During an interview with this reporter, Macpherson said Mncwago was sick and denied calling police to disperse 'hobbos', which he said ActionSA recruited to come to the court to pose as its members and were picketing. 'The ActionSA must answer why did they came to picket when they did not have permission to do so? Why did they break the law?' he said. When asked if he was happy to be joined with the ActionSA in the legal fight against the municipality, Macpherson said: 'It was in the ActionSA's benefit because we saved them from humiliation in court and they should be grateful that they were joined with us.'
