Incidents at English hazardous industrial sites ‘going unchecked'

The team responsible for preventing environmental risks at England's most hazardous industrial sites is facing a recruitment crisis and one insider has warned environmental incidents are going unchecked.
The control of major accident hazards (Comah) regulations cover 950 of England's most hazardous industrial sites – from nuclear power plants to chemical manufacturers – in locations such as Buncefield oil depot near Hemel Hempstead, where, in 2005, the largest explosion in peacetime took place in the UK.
The regulations are enforced by the Environment Agency alongside the Health and Safety Executive (HSE), however, an internal EA report obtained by the Ends Report via a freedom of information request has revealed that the agency has been unable to recruit the staff it needs to monitor the sites.
The report stated: 'In the period April 2023 – April 2024, 33% of campaigns failed to produce any candidates who met the screening criteria. The most recent recruitment initiative for five positions resulted in a meagre six applicants, of which only two were external. Only two candidates were appointed.
'Over the past two years, 34 positions were advertised in this field. Despite extending offers of employment to 75% of the roles, only 13 of the advertised positions were filled.'
An EA employee, who spoke on condition of anonymity, said the implications of these failures by the Environment Agency was that any gaps were picked up by the HSE. This mattered, they said, because the latter 'doesn't give as much weight to the environment as [it] should, and so it needs the Environment Agency there to push that agenda'.
The insider said there had been examples where the EA found out about environmental incidents much later than the HSE. 'Given the seriousness of some of these incidents, not having shared information suggests there is a breakdown,' they said.
The internal report explains there is a general scarcity of individuals in this job market, which, the regulator says, has resulted in a 'dearth' of external applicants. It states that given Environment Agency salaries are at the 'lower end', it is 'unsurprising that we receive a low number of external applicants'.
The report adds that in the past 12 months, turnover of existing staff has reached 18% and churn to other teams is at 20%. 'This is above the average rate of around 6% across all roles,' the report notes.
Existing staff have expressed frustration, referencing 'low salaries, inadequate rewards, and a lack of organisation for professional development as key factors influencing their decision to leave the organisation', the report states.
Dr Doug Parr, a policy director at Greenpeace UK, said this 'alarming data' on how 'little oversight is being applied to sites with flammable and explosive chemicals is just the tip of the iceberg'.

Parr added: 'Lurking beneath are the weakened agencies created to stop corporations the UK relies on for vital services from overcharging and underdelivering. The withering away of enforcement is effectively a programme of radical deregulation that no one voted for, as responsibility for entire sectors – once held by elected ministers – seeps away through the widening cracks in our underfunded and underpowered regulators.'
Parr said that while Donald Trump's explosively dramatic approach to axing regulation in the US is attracting a lot of attention, this 'blitzkrieg on regulators is only one way to defang them, because decades of neglect and decay will render them toothless just as effectively as his bureaucratic knuckleduster, and do so without attracting nearly as much attention'.
An Environment Agency spokesperson said: 'We work closely with partners – including the Health and Safety Executive – to ensure the delivery and enforcement of Comah regulations. This includes ensuring all operators have intervention plans in place to prevent major accidents which could impact people and the environment. We are also undertaking a number of operational initiatives in order to improve staff recruitment and retention in this area.'

In a case brought forward by retired engineer Bob Latimer, in 2012 the European Court of Justice ruled that sewage discharge by Northumbrian Water at Whitburn broke EU water treatment laws. He said he appreciated Ofwat's latest investigation but that he lacked confidence in the water firm's new commitment to cutting pollution in the region. Northumbrian Water said it was investing more than £1bn over the next five years to cut the number of spills from storm overflows and to improve "our coasts and rivers". Bidders demand Thames Water granted immunity over environmental crimes

Lenders vying to take over Thames Water have demanded that the struggling company and its management be granted immunity from prosecution for serious environmental crimes as a condition of acquiring it, the Guardian can reveal. Creditors want the environment secretary, Steve Reed, to grant the water company extraordinary clemency from a series of strict rules covering everything from sewage spills to failure to upgrade its water treatment works. The demands, if successful, would render the Environment Agency (EA) largely powerless to take enforcement action against Britain's biggest water company for some of the most serious criminal breaches of its licences and permits. Thames Water has been a serial offender in recent years, paying tens of millions of pounds in fines and penalties, with multiple convictions for dumping raw sewage into rivers and streams and dozens more investigations under way. The fate of the heavily indebted utility was thrown into further doubt this week when the US private equity firm KKR quit an auction to buy it, citing concerns about politicisation and the poor state of its assets. That has left a disparate band of about 100 bondholders, who have collectively lent the company about £13bn, as the sole bidder. If the creditors' bid fails, Thames Water is likely to fall into state ownership via the special administration regime – a fate the Treasury is desperate to avoid. Sources described the creditors' list of demands as a 'ransom note' that underlined their powerful negotiating position as the 'last show in town'. Creditors argue that failure to secure leniency from fines and enforcement will mean Thames Water is caught in a 'doom loop' that prevents it from recovering and injecting enough money into its tired network. The company, which has 16 million customers in the London and Thames Valley regions and 8,000 employees, is labouring under about £20bn of debt and is running out of cash. The requests formed part of the creditors' turnaround plan that was put to the water regulator, Ofwat, in recent days. Among the proposals were that the EA stops enforcing personal liability for managers at Thames Water and does not pursue enforcement over the company's failure to deliver a huge number of infrastructure upgrades, known as the water industry national environment programme (Winep). The Guardian revealed in December that Thames Water intentionally diverted millions of pounds pledged for Winep environmental clean-ups towards bonuses and dividends, sparking an Ofwat investigation. Customers have already paid for those projects via their bills. Thames Water failed to deliver more than 100 of 812 Winep schemes it was due to between 2020 and 2025. Other creditor requests include not prosecuting Thames Water for sewage spills on dry days or for 'flow to full treatment' licence breaches – where the EA and Ofwat police how much wastewater its plants can treat at any time. They also want Thames Water to be exempt from prosecution for breaches of the industrial emissions directive, which governs pollution into rivers, streams, land and the atmosphere. To achieve these requests, the creditors want Reed to give a strategic decision statement ordering the EA to deprioritise enforcement. The Guardian revealed in March that Thames Water was demanding leniency for fines and penalties in order to attract bidders and stop cash they might inject from leaking out of the business. However, the extent of the creditor demands, and request for near-blanket immunity for serious environmental crimes, has surprised water industry insiders, who warned it could spark legal challenges from rivals or lead to more requests for special treatment. The regulator said its investigation had uncovered failings around Thames's handling of sewage and wastewater, which amounted to a 'significant breach' of its legal obligations. The EA is still pursuing parallel investigations into Thames Water over alleged failure to comply with environmental permits, and has powers to prosecute the company. Creditors are expected to write down a significant proportion of their debt in return for taking over the company. Time is running out to find a solution to keep it afloat as it burns through £3bn of high-interest rescue loans. A spokesperson for the creditors declined to comment on commercial discussions but confirmed their plan required 'regulatory support'. 'The creditors' proposal will fix the fundamentals, protect public health and prioritise improved customer and environmental outcomes,' they said. 'In addition to a detailed operational plan and billions in fresh investment proposed by the creditors, Thames Water requires a fundamental reset and regulatory support so that asset health and performance can be restored to the levels that customers and the environment deserve. 'The creditors are committed to working with the government and regulators to achieve that outcome as quickly as possible and expect Thames Water to be held to account to deliver a realistic but ambitious trajectory for the company's return to compliance.' A government spokesperson said: 'The company is stable and government is carefully monitoring the situation. We expect the company to continue to meet its obligations to both customers and the environment.' An Ofwat spokesperson said: 'Our focus is on ensuring that the company takes the right steps to deliver a turnaround in its operational performance and strengthen its financial resilience to the benefit of customers. We are assessing whether the [creditors'] plans are realistic, deliverable and will bring substantial benefits for customers and the environment.' Thames Water said: 'In order to be investable, we and prospective investors would need to engage in discussions with our regulators.'

Although this year's World Environment Day focuses on plastic pollution in our waters, today's focus touches on a wider issue – the preservation of water ecosystems. This week, the European Investment Bank pledged to invest 15 billion euros ($17 billion) in projects that help reduce water pollution, prevent water wastage, and support innovative businesses in the water sector over the next three years. The commitment by the European Union's lending arm is part of the bloc's strategy to tackle water shortages and droughts made worse by climate change, and address the intense pressure on water supplies from farming, pollution and sprawling urbanisation. Meanwhile, Britain also said it would step up efforts to protect its water resources ahead of the summer, after the driest and warmest spring in England in over 130 years. The Environment Agency (EA) said reservoirs across England were only 77% full, compared with the average 93% for this time of year. It noted, though, that recent rain at the start of June was having a positive effect. "It's been the driest spring since 1893, and we need to be prepared for more summer droughts as our climate changes," the group's chair and the EA's director of water, Helen Wakeham, said. Wakeham also said recent rainfall was helping, but that it hadn't been enough to prevent a drought being declared in the northwest of England. Additionally, Britain banned Thames Water and five other water companies from paying bonuses to their bosses because they had failed to tackle pollution, in its latest effort to overhaul the industry's poor environmental record. The government has said the water industry in England and Wales is broken, with Thames Water at the centre of a scandal after years of under-investment resulted in sewage spills, while it continued to make profits and pay executive bonuses.
