Telangana HC seeks report on steps taken to safeguard KLIS
On Tuesday, a bench comprising Chief Justice Aparesh Kumar Singh and Justice G M Mohiuddin resumed hearing the case. The petitioner's counsel argued that under Section 39 of the Disaster Management Act, the government is required to take long-term measures for flood prevention.
He said that though the court in September 2023 had directed the government to submit a report on the steps taken to safeguard the project, its order was not complied with.
He alleged that despite the government's assurance that it would submit the report as soon as it received inputs from the National Disaster Management Authority (NDMA), nearly two years had passed without compliance. He warned that another major flood could severely impact Jayashankar Bhupalpally, Mulugu, and Bhadradri Kothagudem districts, putting inhabited areas at risk of submersion.
Special government pleader Pottigari Sridhar Reddy, representing the state, sought additional time to file the report and provide updated details. Accepting the request, the bench adjourned the hearing to August 28.

HYDERABAD: Chief Justice Aparesh Kumar Singh hoisted the national flag at the Telangana High Court on Friday to mark the 79th Independence Day. He reiterated the Court's commitment to improving access to justice and paid tribute to freedom fighters. Reviewing the High Court's performance over the past year, Justice Singh said 74,768 cases were instituted and 72,414 disposed of in 210 working days, crediting the Bench and Bar for efficient delivery. On infrastructure, he said 'Nyaya Nirman' norms were guiding uniform district court complexes. The state has sanctioned Rs 1,053 crore for 13 new complexes, while proposals worth Rs 891 crore are pending. Under the centrally sponsored scheme, Rs 16.58 crore has been allocated for 2025–26, with five major projects completed.

Hyderabad: Telangana high court Chief Justice Aparesh Kumar Singh on Friday said CCTV facilities have been installed in all district courts during the last financial year, and the digitisation of court records—initiated in 2017—is being expedited. Addressing the legal fraternity after hoisting the national flag at the 79th Independence Day celebrations at the high court, the CJ emphasised that qualitative and speedy disposal of cases is possible only through the collective effort of the Bench and the Bar. During the past year, 74,768 new cases were filed, and 72,414 cases disposed of within 210 working days, he said. The state govt has granted administrative sanction of ₹1,053 crore for constructing 13 new district court complexes in priority districts—Jangaon, Bhupalpally, Gadwal, Karimnagar, Mahbubnagar, Mancherial, Mulugu, Nirmal, Peddapalli, Sircilla, Vikarabad, Wanaparthy, and Bhuvanagiri. Proposals worth ₹891 crore for new courts in remaining districts are pending sanction, he added. HC quashes proceedings on ‘negative comments' in Whatsapp group about CMDRF account
The Kerala High Court has quashed criminal proceedings that were initiated against two persons for allegedly posting 'negative comments' in a Whatsapp group about the collection of money towards the Kerala Chief Minister's Distress Relief Fund (CMDRF) account for victims of the July 2024 Wayanad landslides. A case was registered against the petitioners under BNS on the charge of wantonly giving provocation with intent to cause rioting, for punishment for obstruction etc under the Disaster Management Act and for causing nuisance and violation of public order under the Kerala Police Act. A Bench of Justice V.G. Arun recently held that the comments, when read as a whole, makes it apparent that they were posted during the course of a discussion regarding the utilisation of the contributions made to the CMDRF. On misutilisation of funds There are comments about misutilisation of the money donated and also against the political party in power. Even if so, to assume that such comments are capable of causing riot among the public and nuisance to others is to say the least, preposterous. That the comments are not palatable to a group of people or even to the government is no reason to initiate criminal prosecution against the petitioners since the comments, though critical of the government, are well within the bounds of law. Stating that the offences alleged has not been made out in the present case, the court said that fair criticism of the government's actions cannot be termed as something done with an intention to cause rioting. Neither would it attract the provisions of Kerala Police Act. An offence under the Disaster Management Act too would not be attracted since there was no obstruction to any public servant or a refusal to comply with the directions of the government or any of its servants. The Constitution guarantees the right to freedom of speech and expression to every citizen. Fair criticism and right to express dissent is intrinsic to the concept of democratic governance. Clamping persons expressing dissent or raising criticisms with criminal cases is an affront to the democratic values enshrined in the Constitution. The comments posted by the petitioners being fair criticism, continuation of their prosecution will be an abuse of process of law and violative of the freedom of speech and expression guaranteed by the Constitution, the court added.
