Arrested influencer Sharmishta Panoli's lawyer, a Muslim, calls her good student

India Today2 days ago

A Muslim lawyer has stepped forward to defend Sharmishta Panoli, the 22-year-old law student arrested over a controversial video, calling her a 'good student' and raising serious questions about the Kolkata Police's handling of the case.Speaking to India Today TV on Monday, advocate Md Shamimuddin alleged procedural lapses in her arrest. 'The laptop and mobile phone of Sharmishta were seized by the investigating agency. A statement had also been recorded. So, she is not required for the purpose of investigation anymore.'advertisementPanoli, a fourth-year law student in Pune with a large social media following, was arrested on May 30 from Gurugram after a now-deleted video sparked outrage for allegedly hurting religious sentiments. She was remanded to judicial custody till June 13 by a Kolkata court.
The lawyer claimed the arrest was illegal and unnecessary. 'Technically, the investigating agency should have served her with a notice under Section 35(3) of BNSS. They went to her house, found it locked, and without trying other means like email or WhatsApp, they directly moved the court for a warrant,' he said, accusing the police of skipping mandatory steps."If you do not find a person who is at home, and you want to serve a notice to that person, there is a law that you can affix that particular notice at a conspicuous place of her home, maybe at the door of her home. You can even serve this notice through email, through WhatsApp. But they did not try all these ways," Shamimuddin said.advertisementHe further said that his client was cooperating fully with the investigating agency."If she had been evading the process of law, then perhaps she would not have given her laptop and her mobile phone to the investigating agency after her arrest. In fact, she cooperated with the investigating agency. She had given a statement to them. So she had done her part," the lawyer contended.Kolkata Police, however, maintain that they followed due process. 'All legal procedures were duly adhered to... All attempts were made to serve notice, but she was found absconding on every occasion,' it said in a post on X.In court on Tuesday, the Calcutta High Court refused interim bail to Panoli, observing that 'freedom of speech does not mean hurting religious sentiments'. The bench noted India's diversity and added, 'We must be cautious... Heavens will not fall if someone is kept in custody for a few more days.'While critics have slammed Panoli for using derogatory language in response to a social media user questioning Operation Sindoor, Shamimuddin said the case is still under investigation. 'Let the police investigate the matter. If they file a charge sheet, then we will go for trial,' he said.advertisementWhen asked whether his faith was offended by Panoli's words, Shamimuddin said, 'If something wrong has been done by her, it will come out in the charge sheet... Everyone who has erred should be pardoned, if that person comes out clean.''She is a fourth-year student of Symbiosis, Pune, and she's a good student. That is the reason she landed up in Symbiosis,' he added.Panoli had earlier issued an unconditional apology and deleted the video, but the controversy had already snowballed, leading to multiple FIRs. The High Court has clarified that all related FIRs will now be merged under a single case being investigated in Kolkata. The matter will next be heard on June 5.

Kolkata: Sharmishta Panoli, the 22-year-old social media influencer from Kolkata arrested over a communally charged video linked to Operation Sindoor, has been granted interim bail by the Calcutta High Court. Ms Panoli was arrested on May 31, over two weeks after she made the controversial remarks in response to a post questioning India's military action after the Pahalgam attack. The interim bail comes a day after the Kolkata Police filed a first information report (FIR) against Wajahat Khan Qadri, the man whose complaint led to the arrest of Ms Panoli. Mr Qadri faces allegations of hurting religious sentiments. He is on the run, the police said. An Assam Police team has also reached Kolkata with an arrest warrant for Mr Qadri. The Assam Police filed a case against him earlier this week for posting content on social media that contained hate speech and derogatory remarks, which hurt religious sentiments. He was not found at his Kolkata house when the police team went there on Wednesday. Mr Khan also faces many cases in other states. Ms Panoli was arrested from Gurugram last week after her Instagram post drew protests. Her arrest sparked a political row, with the BJP and its allies targeting the Mamata Banerjee government in West Bengal. She was produced in court and sent to judicial custody for 14 days. Ms Panoli even received support from nearly 7,000 km away. Geert Wilders, a member of the Dutch Parliament and the leader of the right-wing Party for Freedom, has said the influencer's arrest is a "disgrace for freedom of speech" and urged Prime Minister Narendra Modi to ensure she is freed.

Couldn't sign letter for Parliament's special session as I was on tour representing country: Supriya Sule

Nationalist Congress Party – Sharadchandra Pawar [NCP (SP)] leader Supriya Sule said on Thursday (June 5, 2025) that she could not sign a letter demanding a special session of Parliament over the Pahalgam attack, as she was on a tour representing India as part of a multi-party delegation. Addressing a press conference after her return from a four-nation tour, the MP from Baramati in Maharashtra's Pune district, said her party's stand was that there was no need for debate as 'Operation Sindoor' was still underway. 'When Parliament's monsoon session begins, we will be asking questions to the government on the Pahalgham attack and Operation Sindoor,' She said. The government had sent multi-party delegations to several nations to highlight Pakistan's continued support for terrorism and India's response to the April 22 Pahalgram attack in the form of Operation Sindoor to destroy terror centres in Pakistan and Pakistan-occupied Kashmir. 'I couldn't sign the letter demanding the special session of Parliament as I was on a tour representing the country. I have shown faith and trust in my country. The tour was productive, and the leadership of all four countries — Qatar, South Africa, Egypt, and Ethiopia — expressed strong solidarity with India and condemned all acts of terrorism,' she said. All four countries share a close bond with India, which they consider 'the land of Mahatma Gandhi, Jawaharlal Nehru, Indira Gandhi, Manmohan Singh and Narendra Modi', she said. Ms. Sule said she had told Congress leaders that she would attend the INDIA bloc meetings after her return. The Sharad Pawar-led NCP (SP) is a constituent of the Opposition grouping INDIA (Indian National Developmental Inclusive Alliance). In a letter to Prime Minister Narendra Modi, 16 Opposition parties have demanded that a special session of Parliament be convened. The government on Wednesday (June 4, 2025) said that the Monsoon session of Parliament will be held from July 21 to August 12.
