[UPDATED] Farhash denies link to Sabah coal licence report, demands apology

KUALA LUMPUR: Businessman Datuk Farhash Wafa Salvador Rizal Mubarak has denied a news report linking him to the awarding of a mineral exploration licence in Sabah.
The former political aide to Prime Minister Datuk Seri Anwar Ibrahim is also demanding a full public apology from the news portal responsible for the publication.
Earlier, an article published by MalaysiaNow claimed that a company owned by Farhash had secured a mineral exploration licence in Sabah from Sabah Mineral Management Sdn Bhd (SMM) for an area three times the size of Kuala Lumpur.
In a cease and desist letter by his lawyers to MalaysiaNow, Farhash described the article, which claimed he owned Bumi Suria Sdn Bhd and that the company had secured a licence from a Sabah government agency, as "false and defamatory".
His lawyers clarified that Farhash is merely a director and shareholder of Bumi Suria, and not its owner.
"Our client categorically denies the truth of these assertions. Neither our client nor Bumi Suria has ever been awarded any mineral prospecting or exploration licence in Sabah.
"These false and misleading statements have seriously damaged our client's reputation, exposed him to unnecessary public scrutiny, and wrongly implied involvement in improper or politically influenced business dealings," the letter said.
The firm further said that the publication had failed to verify its claims with either Farhash or the relevant authorities before publishing the article, which it said breached fundamental journalistic standards.
As such, the legal team has demanded that MalaysiaNow:
1. Cease and desist from further publication or dissemination of the article.
2. Remove the article from all platforms, including its website and social media channels.
3. Issue a full and unequivocal public retraction and apology to be prominently published within 48 hours.
4. Provide written confirmation of compliance within the same timeframe.
The letter said that failure to comply would result in legal proceedings being initiated against the portal and any individuals responsible.
It was reported earlier that Farhash had also lodged a police report over the matter at the police headquarters in Bukit Aman.
He urged police to investigate the article under Section 499 of the Penal Code for criminal defamation and/or Section 211 of the Communications and Multimedia Act 1998.
SMM chief executive officer Natasha Sim vehemently denied the claims, saying the government-linked company does not have the authority to issue or award such licences.
"SMM is not a licence-awarding body nor do we have jurisdiction to award or issue licences.
"No company with the name of Bumi Suria Sdn Bhd has ever been issued or awarded any prospecting licence by the state government as of today," she told the New Straits Times.
Since last year, Sabah Chief Minister Datuk Seri Hajiji Noor and other cabinet ministers had repetitively said that the state government had yet to issue any licence to anyone.
Hajiji also said that when it comes to issuing mining licences, the state government will discuss matters such as equity, royalties, fees, and leases in cabinet meetings before reaching a decision.

The discovery was made by a member of the public at approximately 10.30 am. KOTA KINABALU: Istana Seri Kinabalu has denied claims that the state governor's family was involved in the recent death of Form One student Zara Qairina Mahathir at SMA Tun Datu Mustapha in Papar. In a statement, Istana Seri Kinabalu denied the claims circulating on various social media platforms, calling them baseless, irresponsible and defamatory to the Head of State's family. The statement warned the public against spreading unverified and slanderous information which could harm reputations. It also reminded the public that sharing false information may be subject to legal action under existing laws, including the Communications and Multimedia Act 1998. 'Any updates related to the investigation should be referred to the Royal Malaysia Police or the Ministry of Education to avoid confusion and misunderstanding among the public,' the statement read. Meanwhile, Sabah Police Com­missioner Datuk Jauteh Dikun said the police have recorded the statements of 61 people, including students and teachers, in connection with the death of 13-year-old Zara Qairina. He said they were also investigating claims of bullying, which could have caused the student's death. 'The investigations will take time as everything has to be done thoroughly, professionally, sensitively and properly with the help of counsellors. 'We are exploring all angles, including the circumstances leading to the girl's fall from her hostel building at SMA Tun Datu Mustafa in Papar on July 16,' he told reporters after the Sabah Warriors' Day celebration yesterday. He said the investigations were being conducted carefully as traumatised students were involved. However, he added, allegations that those implicated in this case included children of a state assemblyman and VVIPs, including himself, were unfounded. Meanwhile, Sabah Law Society (SLS) president Datuk Mohamed Nazim Maduarin said the incident had raised concerns surrounding school safety as Zara Qairina's death did not occur in a vacuum. 'It has raised questions of school safety, student welfare and institutional response. 'It has also led the public to wonder whether the systems meant to protect children are functioning as they should,' he said in a statement. Mohamed Nazim said the association is aware that the family has appointed legal counsel, and that they fully respect their right to pursue justice through lawful means. 'We are also monitoring the progress of this case closely and will continue to do so. 'Our stand is clear: This case must not be swept under the rug and it must not be forgotten,' he added. SLS extended its condolences to the family of Zara Qairina, who died at the Queen Elizabeth Hospital here a day after she was found unconscious in a drain at her school hostel.

MBDK personnel removing illegal advertisements on a lamp post in Klang. — KK SHAM/The Star KLANG Royal City Council (MBDK) has removed 8,850 illegal banners, bunting and posters – placed on trees, lamp posts, traffic lights and road signs – so far this year. MBDK Corporate Communi-cations Department director Norfiza Mahfiz said most of these advertisements involved property sale, transport rental, household renovations and moneylending services. 'Out of these illegal advertisements, 4,713 were unlicensed moneylenders or 'ah long' posters,' she said after an operation to remove illegal bunting near Jalan Tepi Sungai in the city. Norfiza said 60 phone numbers of loan sharks had been handed over to Malaysia Communications and Multi-media Commission (MCMC), which could terminate them under Section 263 (2) of Communications and Multimedia Act 1998. She said MBDK had a unit that went out each day to remove unlicensed advertisements, which marred the royal city's image and damaged trees. 'When a report is made about illegal advertisements, our enforcement team will respond within an hour or two,' said Norfiza. Last year, MBDK removed 11,587 illegal banners and bunting, including 5,087 loan shark-related advertisements, with 89 phone numbers referred to MCMC. Norfiza said the city council had also issued compounds to 117 businesses in relation to illegal advertisements up to July, following 98 operations. 'Advertisement By-law 2007 states that no person may erect any advertising sign or banner without prior written approval of MBDK. 'Owners of illegal advertisements could also be compounded up to RM1,000,' she said. Norfiza said flagrant disregard for the by-law also placed motorists at risk. 'Bunting tied to poles at traffic intersections obstruct motorists' view.' She added that these advertisements also hampered the view of pedestrians attempting to cross roads.
