
No jail for man who threw stone from train, hit RPF cop; fine enough: Court
Mumbai: A sessions court has held that a man's decision to throw a stone from a moving train was a reckless act that endangered people on a platform of Sewri station in 2012, but it chose not to jail him.

Pointing out that he was only 20 then, it said no purpose would be served by sending him to jail. Instead, it imposed only a fine of Rs 500, saying that would meet the ends of justice.
The maximum sentence the offence attracted was six months in jail. The stone thrown by the accused,
, a Mankhurd resident, struck an RPF constable at Sewri station, leaving him with a cheek injury. Another constable was injured in a similar manner the same day at GTB station, but he could not identify the accused in court.
According to the prosecution, on July 6, 2012, RPF constable Mahindra Ahire was on duty at platform 1 of Sewri station. While a local train was passing by, a young man in the last luggage compartment yelled and threw a stone at him, hitting him below the right eye and causing a minor injury. Ahire attempted to catch the man, but the train picked up speed and left the station. Ahire attended to his injury, completing his duty and then went to the Wadala RPF office to report the incident to his superior.
There, he learned that RPF head constable Hemant Choudhari had also been struck on a leg by a stone thrown from the same train and the description of both suspects matched. Later, Ahire went to Wadala railway police station and lodged a complaint. The investigating officer sent him to St George Hospital for an examination and a medical report documenting his injury was issued.
On Aug 11 that year, while on patrolling duty at Sewri station, Ahire spotted Siddiqui and caught him.

Siddiqui was taken to Wadala railway police station and granted bail on three days later.
Ahire, Choudhari, the investigating officer, and the medical officer deposed during the trial. The judge rejected the accused's submissions that the stone used in this offence was not seized. "One cannot be oblivious of the spot and circumstances of the incident. Here, a stone was pelted from a running local train, the injured was on the platform, and the stone suddenly hit the informant (Ahire).
The informant immediately rushed towards the local train to catch that boy, but he could not catch him as the local train was too fast.
It was a crowded place. In such circumstances, one cannot expect the informant to search for that stone as he was hurt," additional sessions judge V G Raghuwanshi said.
Siddiqui was booked under IPC sections 332 (voluntarily causing hurt to deter a public servant from his duty), 337 (causing hurt by an act endangering life or personal safety of others), and 353 (assault or criminal force to deter a public servant from discharge of his duty).

'No Relief To Bus Driver For Causing Death Of 7 Persons': SC Declines Plea Against Conviction
Last Updated: The court directed the petitioner to surrender within a period of four weeks. The Supreme Court has declined to consider a plea by a man who was convicted for driving a bus in a rash and negligent manner resulting into death of seven people. A bench of Justices Sandeep Mehta and Prasanna B Varale said the court was not inclined to interfere in the concurrent findings of facts recorded in the impugned judgments convicting the petitioner, Hanumanth Achari and affirming his conviction. The petitioner stood convicted for the offences punishable under Sections 304A, 279, 337,338 IPC and Section 183 of the Motor Vehicle Act, 1988. He was awarded sentence for one year rigorous imprisonment on the count of Section 304A IPC and one month each for other counts under the Indian Penal code. The petitioner challenged the validity of the April 15, 2025 judgment passed by the Karnataka High Court's circuit bench at Dharwad. 'We have heard the submissions advanced by counsel for the petitioner, and have carefully gone through the impugned judgment and the material placed on record. On the fateful day, the petitioner was driving bus of the KSRTC which collided with the tempo trax vehicle, resulting into death of 7 persons and injuries being caused to other passengers," the bench said. The court noted the first Appellate Court and the High Court have appreciated and re-appreciated the evidence and have reached to the conclusion that it was the petitioner, who drove the bus in a rash and negligent manner, which caused the accident and resulted into loss of 7 precious human lives. 'Thus, we are not inclined to interfere in the concurrent findings of facts recorded in the impugned judgments convicting the petitioner as above and affirming his conviction. The Special Leave Petition, being devoid of merit, is hereby dismissed," the bench said. The court also dismissed the application filed by him from exemption from surrender. It directed the petitioner to surrender within a period of four weeks, failing which the Trial Court would take appropriate steps to have him arrested for serving out the sentences.

ED raids Himachal assistant drug controller, seizes vehicles and unaccounted liquor
The Enforcement Directorate (ED) Chandigarh Zone carried out extensive search operations on June 22 and 23 at seven premises linked to Nishant Sareen, Assistant Drug Controller, Dharamshala, and his relatives and associates. It confiscated two high-end vehicles estimated to be worth Rs 32 lakh and more than 60 unaccounted liquor bottles. As per ED officials, the searches were conducted in connection with allegations of corruption, bribery, and misuse of official positions during his previous posting as assistant drug controller in Baddi, Himachal Pradesh. During the operation, the ED seized crucial documents, including drug licences, show-cause notices, pharmaceutical clearances, property-related papers, and multiple digital devices. The agency also froze over 40 bank accounts and fixed deposits (FDs) along with three lockers held by Sareen and his family members. The liquor bottles were recovered from Sareen's residence at Omaxe Cassia, New Chandigarh. The ED suspects that Sareen exploited his regulatory authority to grant undue favours to pharmaceutical companies in exchange for personal gains. The probe is ongoing.

The investigation is related to a case of corruption and bribery while Sareen was posted as ADC in Baddi, Himachal Pradesh. The ED's investigation under the Prevention of Money Laundering Act (PMLA) was initiated based on an FIR registered by the State Vigilance and Anti-Corruption Bureau, Himachal Pradesh Police. The FIR was filed under Section 11 of the Prevention of Corruption Act, 1988, against Nishant Sareen for allegedly misusing his official position for personal benefits. Background While posted as ADC in Baddi, Sareen was accused of corruption and bribery. He was arrested by the State Vigilance and Anti-Corruption Bureau and charge-sheeted along with his associate Komal Khanna. After being released on bail, Sareen was posted as ADC in Dharamshala in September 2024. Another FIR was registered against Sareen and others by the Haryana police in 2022. The FIR alleged forgery of a partnership deed of Zhenia Pharmaceuticals, Panchkula, which increased Komal Khanna's share from 50% to 95%. Sareen and Khanna were also accused of threat and intimidation, indicating misuse of Sareen's official position. Seizures during search operation During the recent search operation, the ED seized various documents, including drug licenses, show cause notices, and clearances issued to pharmaceutical companies. Property-related documents and digital devices, including mobile phones, laptops, and pen drives, were also seized. The ED also seized two vehicles worth approximately Rs 32 lakh and froze more than 40 bank accounts and FDRs belonging to Nishant Sareen and his family members. Additionally, three lockers were also frozen. During the search, more than 60 unaccounted liquor bottles were found at Sareen's residence in Omaxe Cassia, New Chandigarh.
