
Bail application for Shute shooter continues
The bail application hearing for Martin Wessels entered its third day at the Ladysmith Magistrate's Court today (May 14).
State prosecutor Ms Khumalo made a surprise application for the magistrate to recuse herself from the case, claiming bias. Khumalo argued that Wessels was being treated like a privileged accused, as he was allowed to testify in both English and Afrikaans. She also raised concerns about the affidavit presented by defence attorney Justin Heunis, stating that he had translated it himself into English. Heunis countered that the affidavit had indeed been translated into English and handed to the prosecutor, and that the translation was for her own benefit.
Heunis further argued that the magistrate had not yet made any decisions that would indicate bias, and therefore there were no grounds for recusal. After hearing arguments from both sides, the magistrate refused the application for recusal, allowing the case to proceed.
With the recusal application dismissed, the court heard testimony from investigating officer Mr Mabaso. He provided background information on the deceased, Anton Lombard, describing him as a father of two young children, aged 11 and 13, whom he supported despite not living with their mother. Lombard was employed as a manager at Sentracor.
Mabaso then outlined the state's reasons for opposing bail, citing four key concerns. He argued that Wessels was a flight risk, that his life would be at risk if he were released into the public, and that the public would also be at risk. Additionally, Mabaso claimed that Wessels might interfere with witnesses and that his history showed a disregard for the law.

The bail application hearing will continue tomorrow, with the court expected to hear further arguments from both the defence and the state. Wessels remains in custody.

"We have already arrested six undocumented foreigners during this raid, and because the majority of our buildings and most of our hijacked buildings are being occupied by foreign nationals, whenever we requested to intervene, we are told to provide alternative accommodation to evacuate. "We are confronted by those challenges as we are unable to do anything with them. We cannot even demand their immigration statuses. That is why we have Home Affairs here with us today and other departments," he said. Mabaso indicated that the operation aims to create a safer, more vibrant Johannesburg where residents can enjoy quality services and opportunities for growth. This operation comes hot on the heels of a similar operation which took place early last month, which targeted Textile House and African Diamond — both located on the corner of Kerk and Goud streets.

Rape of 11-year-old: Closing arguments presented in bail hearing
The bail hearing of a 28-year-old man accused of raping and impregnating an 11-year-old Boksburg girl was again postponed at the Boksburg Magistrate's Court yesterday (June 9). The matter will resume on June 12. This follows the defence and the State presenting their closing arguments for the bail application. The accused's lawyer, Frik van Rensburg, said the investigating officer's statement contains no supporting evidence and should not be relied upon. He pointed out that the child initially denied the alleged rape when questioned by her mother, raising the question of how the court could then accept her version of events. ALSO READ: State opposes bail as officer testifies in child rape case 'The prompting of the victim could, with all due respect, be indicative of an ulterior motive,' he said. Van Rensburg said the child was only assisted by her mother when the statement was taken — in English, not her mother tongue. State prosecutor Kagiso Ralethata argued that the State's case is not weak. 'The only thing outstanding is the DNA results, which could take about nine months. The victim was assessed by a doctor and no independent evidence was handed in to show that the applicant would be acquitted,' he said. 'The contentious point was the circumstantial evidence in the form of a statement from the victim's sister. 'It was highlighted that the witness is out of the country and that the investigating officer has not yet obtained her statement. 'We cannot say whether we will be able to obtain the statement. I will argue that, although the statement is important to a certain degree, it is not a crucial piece of evidence. The State can proceed without it.' The suspect, who cannot be named to protect the child complainant, was arrested on April 22. KZN murder accused found dead in police van after court appearance
Eduan Terblanche (53), who is accused of murdering his partner Stacey van Heerden (49) at a Mooi River hotel on May 28, was found dead inside a police van yesterday. According to The Witness, Terblanche was being transported from the Mooi River Magistrate's Court to holding cells in Pietermaritzburg yesterday, shortly after his bail application was postponed. He was meant to return to court tomorrow for the continuation of his bail application. However, his family confirmed they were last night informed of his death. Police in Mooi River have now opened an inquest docket to investigate the cause and circumstances surrounding his death. KZN police spokesperson Colonel Robert Netshiunda confirmed the incident without naming Terblanche. Netshiunda said police were investigating an incident 'where an inmate, who was being transported from court to the police station, was found dead inside a police van on arrival at the station on Monday'. Terblanche appeared in court yesterday using a crutch and wrapped in a blanket. He was facing charges of murder and defeating or obstructing the course of justice after his partner, Van Heerden, was found dead at the Gleneagles Hotel. According to the charge sheet, Van Heerden was killed, allegedly by Terblanche who then reportedly set fire to the hotel room while she was still inside.
