Howrah: Police on Monday night arrested a Bangladeshi citizen, who reportedly crossed over into India illegally around 15 months ago.
Faruk Sheikh (36), a resident of Mouli village in Narail district in Bangladesh, had paid a Bangladeshi facilitator, Sajjadul Biswas, Bangladeshi Taka 20,000 or around Rs 14,000 in Indian currency.
Initially, he lived in Mumbai before arriving at Howrah station on Sunday. Sajjadul, who was in another compartment on the same train, reportedly cut off contact and his mobile became unreachable, police said.
Cops at the Shibpur Police Station were alerted by residents who spotted Faruk seeking employment in the PM Basti area of Shibpur on Monday evening. Cops, on questioning, found no passport or visa on Faruk and arrested him under the Foreigners Act.
During interrogation, he reportedly gave multiple versions of entering into India—through the Nadia border, Bongaon border and the unfenced area. He told police he worked as a mason during his stay in Mumbai.
Cops reportedly found no Indian ID document though they found some papers with unclear drawings, which Faruk claimed, were connected to his masonry profession.
The authorities are investigating Faruk's motive behind entering India and his planned return to Bangladesh.
He was on Tuesday remanded in police custody for five days.
Last week, a chauffeur, Azad Sheikh (41), who was apprehended for driving rashly, turned out to be a Bangladeshi national. On interrogation, he revealed that he managed to obtain Indian documents from a Nazat resident, Zafar Ali Sheikh, by paying Rs 15,000. He used those papers for his job.
Police said an investigation was on to identify individuals crossing the border without proper documents, finding accommodation with relatives or through intermediaries, and subsequently, obtaining legitimate Indian identity documents against a modest amount. An earlier probe into passports being issued without proper verification of documents revealed that around 120 Bangladeshi nationals acquired Indian passports illegally and travelled abroad.
In those cases, police had filed charges against 130 individuals, including suspected operatives.

Pune: Pimpri Chinchwad police's cyber wing arrested two men from Ahilyanagar district on Monday, in connection with the alleged "digital arrest" of a 47-year-old Pune man who lost Rs 53 lakh to fraudsters. Stolen money would be wired to their accounts and the duo would then withdraw the cash to hand it over to their handlers, the authorities alleged. "Their handler is also from the same village, but is currently based in Pune. Our investigations show the handler had created at least 20 mule accounts in this village. The details of these accounts were handed over to fraudsters based out of Maharashtra," said assistant inspector Pravin Swami, of Pimpri Chinchwad cyber police. The two men arrested on Monday were identified as Akash Pathare (28) and Avinash Tungar (27). They were held as the police investigate the complaint by a Moshi resident who said that on April 2 he received a "letter" via a messaging app that claimed his bank account was being used to launder money and that he faced arrest. One police official said: "The person at the other end told the Moshi resident he was an 'officer' with the Mumbai crime branch. He told the victim the cops and the bank needed to verify his bank account through a money transfer. The victim was even told the bank would return the money to him immediately after verification. Senior inspector Ravikiran Nale of Pimpri Chinchwad cyber police told TOI that during their investigation, they found Rs 5.4 lakh of the money was transferred to a private bank's account. "So we took the details of this account holder from the bank and found that it was in Ahilyanagar district. We arrested Pathare who revealed three more names. We then arrested Tungar. A search is on for the two others," Nale said.

Mumbai: Calling it "preposterous", Bombay high court on Monday dismissed a drug trafficking case registered in 2021 against Dhruv Tahil, son of actor Dalip Tahil . The court held the law prohibits a merging of several minor aberrations over 18 months into one charge, a move that led to Tahil "being charged with an offence of a higher magnitude". Holding the Bandra Anti-Narcotic Cell's action as impermissible after analysing sections 218 and 219 of the erstwhile CrPC, the HC said: "Prosecution cannot be permitted to decipher and follow its own procedure for levying of charge of such a serious nature which is impermissible under the provisions of (law)." Pointing out that Tahil was not even arrested in possession of contraband, Justice Milind Jadhav said: "Prima facie when section 218 (of CrPC) is read, such charge by prosecution on the face of record appears to be preposterous… The procedural law does not permit the prosecution to assimilate more than three charges into a singular charge over a period of 18 months to be tried together and invoke a singular precipitative action. " The ANC, Bandra unit, in May 2021 arrested Tahil, then aged 30, after a co-accused, Muzammil Shaikh, held in Bandra (E) with 35 gm of mephedrone (MD), alleged that he had "in the past" supplied to him and various others. Police said it recovered WhatsApp messages between Jul 2019 and Jan 2021, which allegedly pertained to purchase of 1 gm or 2 gm of MD on various occasions, totalling 44 gm from Shaikh worth roughly Rs 25,000, to justify its invocation of serious charges of drug trafficking against Tahil in alleged conspiracy with Shaikh. HC noted that for small quantities, the punishment is less -- maximum 1 year in jail; but for intermediate quantities (less than commercial) invoked against him, it is 10 years. Justice Jadhav said "the prosecution was aware" each single act of alleged procurement was "less than small quantities" and Tahil would get the benefit of doubt, and hence it combined all the alleged transactions without following the tenets of the exception carved under the law. Tahil had challenged a 2023 rejection of his discharge plea by a special NDPS court. Justice Jadhav, after hearing Tahil's counsel Ayaz Khan, who alleged non-application of mind by the police and "mala fide intentions" in invoking the charges, and after hearing prosecutor H Dedhia, said, "From the material available on record and invocations of charge… no case is made out for the applicant to stand trial." HC also said "the alleged WhatsApp chats... in my opinion cannot translate into admissible evidence" during trial. HC said the state failed to comply with CrPC mandate and it led to Tahil "being charged with an offence of a higher magnitude". That too, under a special law like NDPS, which attracts higher punishment and fine and stringent conditions to get bail, HC noted adding, stringent laws require reciprocal duty on police to strictly comply with the law and its aspects that may have a negative impact on the accused.

A special court in Mumbai on June 10 granted one-day custody of National Company Law Tribunal (NCLT) Deputy Registrar Charan Pratap Singh to the Central Bureau of Investigation (CBI) for further probe in connection with a Rs 3-lakh bribery who was arrested by the CBI on May 29, was initially remanded to judicial custody along with his aide, Karsan Ganesh Ahir. While Singh's lawyer Sak Saxena had moved a bail plea, the CBI sought five days of police custody, citing the need for further the plea, Saxena argued that seeking custody after the accused had been sent to judicial custody amounts to a review of an existing judicial order, which is impermissible under the Bharatiya Nagarik Suraksha Sanhita (BNSS) or any other applicable law. He contended that unless new compelling evidence had emerged, a renewed plea for police custody was invalid. Saxena further added that any need to confront witnesses could be addressed while the accused remains in judicial custody through court-approved procedures. The special judge, after hearing both sides, observed that the initial police custody was denied on May 29 and since then, new witness statements had emerged indicating Singh's involvement. Citing this, the court ruled that the CBI had presented sufficient grounds to justify a one-day custodial remand for further court directed Shyamal Sawant, Police Inspector of CBI's Anti-Corruption Branch, to take Singh into custody from Central Prison Mumbai on June 10 and produce him before the court again on June 11 at 11.00 was arrested for allegedly demanding and accepting a bribe of Rs 3 lakh from a businessman to help favourably resolve an ownership dispute involving a prominent hotel in Mumbai. According to the CBI, Singh had handed over Rs 50,000 to Pradeep Kumar Nagarale, Court Officer at NCLT Mumbai, on May 16 as part of the bribe meant to influence an NCLT Board agency further alleged that incriminating WhatsApp conversations between Singh and Nagarale were deleted from both their phones, which it is currently attempting to retrieve as part of the Watch
