Warden at Al-Quran learning centre sentenced to six years' jail for sodomising two boys

SEREMBAN: A warden from an Al-Quran study centre has been sentenced to six years in prison and two strokes of the cane by the Sessions Court here after pleading guilty to charges of committing physical sexual assault, sodomy, and unnatural carnal sex against two boys between 2023 and January 2024.
Judge Datin Surita Budin handed down the sentence against Mohd Khairi Fitri Baharom, 38, on Thursday (June 12) after the three charges were read separately and ordered him to serve the prison sentence starting from the date of his arrest on May 25.
Surita also ordered the accused to undergo rehabilitation counselling and police supervision for one year after completing his prison sentence.
According to the charges, Mohd Khairi Fitri was accused of committing physical sexual assault against a 12-year-old boy between December 15 and 20, 2023, in a warden's room at the study centre in Jempol.
He was accused of sodomising the same victim again around 10.30pm on January 7, 2025, and committing unnatural carnal sex against a 10-year-old between April and December 2024 at the same location.
The offences were charged under Section 14(a) of the Sexual Offences Against Children Act 2017, read together with Section 16(1) of the same act, which carries a maximum prison sentence of 20 years and caning if convicted.
He was also charged under Section 377C of the Penal Code for committing carnal intercourse against the order of nature without consent, which carries a prison sentence of not less than five years and a maximum of 20 years and caning if convicted.
The accused, who was not represented by a lawyer during the appeal process, requested that the court impose the lightest possible sentence on the grounds that he still had his mother to care for.
Deputy Public Prosecutor Norazihah Asmuni requested a proportionate sentence be imposed, given that the offences involved children and the accused was an individual responsible for their care and safety.
"The accused abused his power and committed sexual harassment against them (the victims). Therefore, a proportionate sentence is requested as a lesson for offences against vulnerable children who can be exploited by anyone," she said.
Mohd Khairi Fitri pleaded not guilty to 12 other similar charges against the same victim and five other children from around 2024 to January 24, 2025, at the same location and a house in Jalan Air Melana in Kuala Pilah.
The court set July 14 for the next mention of the case and appointment of a lawyer. – Bernama

Ismail said the car driver and five other passengers were rushed to Kuala Lipis Hospital for further treatment, while the lorry driver and his assistant were unhurt. He said the case was being investigated under Section 41(1) of the Road Transport Act 1987. KUALA LUMPUR, June 13 (Bernama) -- Counsel for Toh Puan Na'imah Abdul Khalid informed the High Court today that a lower court's refusal to refer eight questions of law had effectively denied her a fundamental right, leaving critical legal issues central to the case unresolved. Na'imah filed the application in the Sessions Court in February last year to refer the legal questions to the High Court. Her counsel, Datuk Dr Gurdial Singh Nijar, submitted that the Sessions Court had misconstrued the law governing applications to refer constitutional questions under Section 30 of the Courts of Judicature Act 1964, thereby denying the applicant clarity on her legal position and resulting in a miscarriage of justice. "This oversight calls for rectification in order to uphold the integrity of the judicial process and ensure that the applicant's rights are fully respected," said Gurdial. He made the submission during the hearing of Na'imah's application to review the Sessions Court's decision to dismiss her request for a referral of legal questions in the undeclared assets case, heard before Judge K. Muniandy today. Gurdial contended that Na'imah was called to assist in the investigation against her late husband, Tun Daim Zainuddin, strictly in her capacity as a witness, and at all material times, she was never regarded as a co-suspect. "Na'imah complied with the section 36(1)(b) notice requiring her to disclose information in respect of assets to the best of her ability and she had made a statement on oath in this respect. "The MACC took the view that her compliance was insufficient and perhaps in retaliation, the MACC commenced the present charge against my client," he said. He added that based solely on the alleged non-compliance, a witness (Na'imah) is now subjected to criminal prosecution and faces the prospect of a custodial sentence of up to five years and a fine of up to RM100,000.

KUALA LUMPUR, June 13 (Bernama) -- The Malaysian Anti-Corruption Commission (MACC) has seized another RM16 million worth of luxury items linked to the misuse of sukuk funds for the construction of a highway in Klang Valley believed to be owned by a concession holder with the title of Tan Sri yesterday. The MACC said the seizure at the individual's residence in Bandar Tasik Selatan, Cheras included 84 luxury bags worth about RM3 million, 11 branded watches (about RM1 million), gold bars, coins and statues (about RM3 million), diamonds and jewellery (about RM4 million). 'A luxury casino equipment set estimated to be worth RM150,000 was also seized,' the commission said in a statement, adding that a secret vault that stored weapons and ammunition was discovered but the weapons were not seized as they were registered under the security company the individual owned.
