Inside crisis-hit special care: ‘They are not monsters. They are ordinary kids that have gone through difficult things'

It was an 'affront to the rule of law', said Mr Justice John Jordan in the High Court recently, that beds were not available for three vulnerable children in need of immediate placements in the special care system.
One of the three without a place in the most secure form of care was a teenager who was 'free falling' and whose father believed would die without a place.
Another was a self-harming child who attempted suicide after being 'drawn into a life of criminality' and had been 'subjected to sexual exploitation'.
Children and young people deemed to be at such a risk to themselves, or others, as to need therapeutic residential care may be detained in this system by order of the court.

's 26 special care beds were open – down from 15 weeks earlier. Today, 15 are operating.
He described the system as being 'in crisis', adding: 'This dysfunctional system is getting worse. It is an indictment of the State that those special care beds are not available.'

As recently as June 19th,
Mr Justice Jordan said it was like 'winning the All-Ireland'
to hear, for the first time in more than six months, every child with a special care order had a placement.
Last Thursday, however, the 'no beds' list section was back. The
parents of a vulnerable teenager said they were 'at their wits end'
due to no placement being available for their child despite an order being granted the previous week.
There were 'significant concerns' for the child who was described as being suicidal and had 'overdose tendencies', said Sarah McKechnie, barrister for Tusla. 'It is my understanding a bed won't be available until in or around August 25th.'
In an online post, the child's mother said the teenager was in hospital following a suicide attempt – the latest of many. She said she would refuse to allow the discharging of her child from hospital in an attempt to keep them safe.
Special care remains in the spotlight as a system in crisis. There are 26 beds across three centres, but they have never all been in operation. One of the centres, Coovagh House, is in Limerick. The other two are in Dublin – Ballydowd in Lucan and Crannóg Nua in Portrane.

The numbers involved are small; just 0.2 per cent of the 5,761 children in care need special care. However, the service attracts trenchant criticism for its limitations given the risks faced by those who need it.
Tusla, arguing in 2023 for higher pay rates to recruit more special care workers, told the Department of Children 'the current crisis in ... capacity has the potential to lead to a fatal outcome for a child who cannot access special care'.
In recent weeks, The Irish Times was granted unprecedented media access to the largest special care unit, Crannóg Nua. Adjacent to the St Ita's Hospital campus, and behind 20-foot high fences, the facility is bright and modern, located on a landscaped campus. However, just five of the 12 beds are open.
During the visit, social care workers, kitchen staff, the on-campus school principal and management talk about how the facility works. There were glimpses of three children, all of whom were calm, during and between activities with their support workers.

Once an order is made, gardaí get involved to 'ensure [the child is] brought safely to the service', says Tusla.
Each child has an en suite single-bedroom – which they may personalise with posters or photos – though there is little to no privacy. They are locked into bedrooms at 10.30pm and can be checked on through a hatch, explains Aisling Byrne, social care leader.
She shows the common area, laundry room and kitchenette. Dotted around are safety pods – industrial-strength beanbags on to which children are brought when being restrained.
An innovation of Crannóg Nua, the pods have reduced injuries to children and staff given restraint used to mean two staff bringing a child by force to the ground.
The school at the heart of the campus is led by Jacqui McCarron. She shows small classrooms where the Junior Certificate curriculum is followed, including art, woodwork, home economics, PE and core academic subjects.

'We have the opportunity to work intensively with them, see what's working,' she says. 'They make progress and that is powerful for their self-esteem. You wouldn't believe how much completing the Junior Cert means to them. It is probably the only academic success they will ever have.'
The profile of the children is undeniably difficult, says William O'Rourke, assistant national director of alternative care. Typical histories include 'self harm and suicidality, substance misuse, sexual exploitation, violence or aggression towards and from others, property damage, mental health presentation and antisocial or criminal behaviour'.
'We are seeing more and more sexual exploitation, emerging mental health issues, emerging personality disorders,' he says.

'Their lives may be so chaotic in the community and they don't actually see this until they come in and stabilise,' says O'Rourke. 'We can see what's happening to them truly when they come to a service like this.
'Take the risks away and you are then dealing with the person. It may be the first time they are being seen for who they are, and not just as them in their circumstances.'
He adds that 'the kids generally settle within days' and engage with staff and education and develop positive relationships.
'It is a really positive intervention when you remove the risk and hopefully identify what they need.'
From 2013 to the end of last year there were 269 admissions to special care, some of which were repeat. The annual high was 33 children in 2014. Last year there were 14 – seven boys and seven girls.
There has been no longitudinal study on long-term outcomes of the system, O'Rourke says, though one is 'being commissioned' by the Department of Children.
Crannóg Nua staff have an optimistic yet realistic approach.
'There is no quick fix,' says Oisin Mulchrone, deputy social care manager. 'They are coming from very challenging circumstances, some with family dynamics that are probably quite entrenched in challenges. It is hard to move away from that.'
Mulchrone says he 'couldn't imagine working anywhere else'.

'You see young people moving on and you want to see them doing well. People do this because they want to make a difference for the young people. It's not for the faint-hearted sometimes, but the good greatly outweighs the bad.'
For James (18) special care was 'probably the calmest time' in his life, says his mother Martha (not their real names).
By the time an order was made, James, who was 15 at the time, had more than 35 care placements in the preceding four months.
Explaining his background, Martha says James was a 'clingy' and anxious toddler. He was diagnosed with ADHD at six.
'He had no friends . . . He had an SNA (special needs assistant) from junior infants to fifth class.'
While in fifth class, James was expelled. His parents tried home schooling but his behaviour deteriorated. He was violent towards his siblings and parents. An incident at home resulted in gardaí being called and his parents reluctantly agreed to voluntary care.
'We thought he would finally get the help he needed,' says Martha.
Unable to find a foster placement due to his behaviour, Tusla contracted private providers to accommodate James in what are known as unregulated special emergency arrangements (SEAs).
'He was shipped around B&Bs, hotels, holiday homes. He spent nights in Garda stations, hospitals, care-staff's cars,' says Martha. 'He could be in Drogheda one night and the next night in Cork. He could be three nights there and then to Monaghan.'
She added: 'There was no stability, no care plan. He was being transported in taxis, his belongings in black plastic bags, living on takeaways.'
In his final weeks in SEAs, James was 'out of control', she says. 'He ransacked his placements; broke into staff cars; there were altercations with the guards. He accumulated criminal charges at this time too, something he never had before going into care.'
Before entering special care, James was assessed by a social worker with the Child and Adolescent Mental Health Service (CAHMS). She noted: 'Difficulty in engaging [him] at a time of extreme distress . . . significant recent trauma in number of recent placement moves and removal from family home likely to explain significant dysregulation at this time'.

Special care was the last option for James, says Martha, and agreeing to it was 'very distressing'.
'It took [James] about 12 to 16 weeks to settle. He was full of frustration, stripped of all liberties, feeling punished. He was there more than two years. Staff didn't just see a case file or a troubled teen, they saw him – his fears, his humour, intelligence and his pain.
'They set boundaries but also built trust day by day. They listened when he spoke, even when his words came out in anger. He slowly began to trust them back.'
Leaving special care was tumultuous, with aftercare planning ad hoc. James was initially offered only homeless services, but the morning he was to leave his family was told a city centre apartment with security-guards was available.
He remains without access to HSE adult psychiatric care. His health has deteriorated, he lost the apartment and has slept rough. Martha is hoping he will be provided with an after-care placement.
Tusla said it could not comment on an individual case but that SEAs were used when 'a regulated emergency placement is unavailable, and an immediate place of safety is required for a young person'.
Their use has declined – from 170 children last December to 57 at present. Where a child spends 'an extended period' in a SEA, 'there is increased oversight of the arrangement with additional supports'.
James's case epitomises problems in the wider care system that lead to 'additional pressure' on special care, says Terry Dignam, co-founder of Children's Residential and Aftercare Voluntary Association.
He points to an 'ongoing crisis in CAMHS', the decreasing availability of foster carers, a lack of residential placements, an 'over-reliance' on private providers and that almost 100 high-support beds were 'stripped out of the system' in 2014.
'We need far more early supports for families. If we had a properly functioning care system, with high-support beds to take in some of the kids falling into crisis, we wouldn't have such a reliance on special care,' he says. 'We would have fewer children escalating to that level because we would have the interventions earlier.'
The key obstacle to opening all 26 beds, says Mark Smith, Tusla's director of special care services, is recruiting and retaining staff in what is seen as the toughest job in social care.
To have 20 beds open, five more than the current 15, would require 35 additional staff, he says. Opening all 26 would require an additional 77. There are currently 110 whole-time equivalent (WTE) social care staff in the three units.

The sanctioning of a new grade of special care worker last year was 'a significant victory for Tusla', Smith says. The top pay rate on this grade is €68,169, on a 23-point scale closer aligned with that at the Oberstown child detention campus.
Two new staff are employed on this grade, with five at 'varying stages of recruitment', underlining continuing difficulties. Staff retention is improving, however. In the year to May, it stood at 84 per cent, up from 76 per cent a year earlier.
Solving the special care crisis, says Dignam, is not only up to Tusla, which 'gets a lot of flack'. It will require 'substantial investment' by the several agencies, including the HSE, across the system, the reopening of high-support beds, and 'vastly' improving CAMHS and adult mental health services.
Special care work is 'a great job if you commit to it', says O'Rourke.
'It's a job that's very, very rewarding. You see the young people here. They are not demons. They are not monsters. They are ordinary kids that have gone through some really difficult things.'

Two teenagers who were prescribed an anti-psychotic drug while undergoing treatment with the South Kerry Child and Adolescent and Mental Health Services have settled their High Court actions for a total of €140,000. In one of the cases, the then almost 10-year-old boy gained 3.5kg in weight in the six months he was on the drug Risperidone, which the High Court heard was not appropriate and should not have been prescribed. They had sued the HSE over the care they received at South Kerry Child and Adolescent Mental Health Services (Camhs). None of the children can be identified by order of the court. The settlements were reached after mediation. Robert Fitzpatrick SC, with Siun Leonowicz BL, told the court the first boy had been referred to the Camhs service when he was under 10 years of age and he was prescribed the anti-psychotic drug Risperidone. Counsel said the drug should never have been prescribed and it was dispensed for another five months in 2019. The young boy, he said, suffered side-effects, including weight-gain, and he had gained 3.5kg in weights over a 23-week period. At one stage, counsel said the boy was prescribed an appetite-suppressant medication, which counsel said was also inappropriate. Mr Fitzpatrick said the appetite suppressant medication appeared to be given in a misplaced effort to counteract the Risperidone, which should not have been prescribed. Counsel described it as a 'case of double error'. Approving a €65,000 settlement in the teenager's case, Mr Justice Paul Coffey said it was fair and reasonable, and he wished the boy the best for the future. In the second case, a 16-year-old boy settled his action for €75,000. Counsel said the boy when he was nine years old had been put on Risperidone and was taking it for five months in 2018. Counsel said the anti-psychotic was never appropriate for the child. Counsel said the boy had been put on an ADHD medication which he had taken before and from which he previously suffered side-effects. By putting the boy on the ADHD drug again, counsel said he had been needlessly put through side-effects. Approving the settlement, Mr Justice Paul Coffey conveyed his best wishes to the teenager. In another case a 16-year old boy was awarded €17,500 in relation to his care at South Kerry Camhs. Counsel told the court the boy, when he was six years old, had been assessed by the service, diagnosed with ADHD and started on medication. Counsel said his case related to a 23-month gap in later follow up. At one stage, counsel said the boy was prescribed the anti-psychotic drug Risperidone, but thanks ' to the good sense of his father, he never gave him the medication'. His case solely related to lost follow-up.

While children are storing cocaine in their school lockers, the centre's head of clinical services, Emma Kavanagh, described how young women feel like cocaine will not impede their weight-loss journeys or progress in the gym. 'If they were to use alcohol, it would negatively affect those things,' she also told 'So, cocaine is nearly kind of a loophole to get a buzz without having to ingest additional calories.' . This is up from 17 per cent in 2023 and is 'one of the sharpest single-year increases the Rutland Centre has recorded for any substance', the Dublin-based centre warned. Rutland CEO Meave Mullany told RTÉ Radio how women traditionally face more barriers to entering treatment than men. 'There's a lot more stigma and shame for women entering treatment,' she said. 'There's a lot more considerations around childcare, around family life, so they tend not to come forward for treatment as frequently or as often as men do. Ms Mullany said according to people coming in for treatment cocaine is 'literally everywhere'. 'It's in the lockers, it's in school, it's after sport,' she said. 'We even hear from clients coming into treatment that there's an app that people can use to order it by drones,' she remarked. In response to this crisis, the centre has announced plans to open a dedicated inpatient detox unit later this year. Read more More than 200 people received intensive treatment through Rutland's residential and outpatient programmes in 2024, as staff answered more than 16,800 calls and facilitated over 11,000 aftercare attendances. According to the Health Research Board's latest drug treatment figures, cocaine is now the most common problem drug among new treatment cases, accounting for over 30% of all new presentations, and overtaking cannabis for the first time. Men made up two-thirds (66 per cent) of those treated at the Rutland Centre in 2024, with women accounting for 34 per cent. The age group with the most people seeking help was those aged 25 to 44, who represent more than half of all clients. 'These figures highlight the age and gender realities of addiction in Ireland today, with younger adults and men continuing to face particularly acute risks,' the facility said in a statement. The Rutland report also revealed that 94 per cent of residential clients completed the full treatment programme, while 89per cent of those who moved into aftercare remained in active recovery. Many former clients attribute Rutland their life-changing recovery to the Rutland with one former client, Chris, saying that when he arrived four years ago, he was 'completely broken'. 'The 35 days in the house was the hardest of my life. I finally had to face me. 'Now I look back and recovery hasn't just been about sobriety, it's about growing up and reconnecting with the people I love.' He added: 'Halfway through, I wanted to leave, I wanted to run – but that same night something clicked, no one else was going to do this for me. I needed to show up for myself. What's happened since still blows my mind.'

Fertility treatment and the workplace: ‘It's a hugely personal thing to have to say'

One thing Tammy Murphy did not have to worry about when she and her partner were undergoing assisted reproduction treatment was the need to keep it a secret from her employer. A naturally open person, she did not hesitate to tell her manager and colleagues. In return, she got all the flexibility and understanding she needed over the three rounds of in vitro fertilisation (IVF) that it took before her partner, Leanne Doyle, gave birth to their son, Theo, two years ago. On their first attempt, the embryos did not implant; after the second round, she had a miscarriage at 10 weeks. Murphy's employer, the recruitment company Flexsource, which is part of the CPL group, has since incorporated fertility treatment supports into its 'family building' policies. Five days' leave per year is available for the person physically undergoing the treatment and two days for the supporting partner. However, recently published research would suggest that employers making specific provisions are still in the minority in Ireland. This is despite one in six adults, according to the World Health Organisation, experiencing infertility, which is defined as a failure to conceive after at least 12 months of regular, unprotected sexual intercourse. READ MORE About 80 per cent of people who had undergone IVF said their workplace did not have a fertility policy, according to a Sims IVF survey. Almost all respondents (98 per cent) agreed that treatment had an impact on their emotional wellbeing at work, while 83 per cent said it affected their ability to fulfil their work responsibilities. At support meetings organised by the National Infertility Support and Information Group (NISIG), people often talk about the workplace as being one of the biggest challenges when they are undergoing fertility treatment, says NISIG spokeswoman Caitríona Fitzpatrick. Fertility treatment involves multiple appointments, sometimes at short notice. In the absence of flexibility or dedicated time off, 'people use annual leave or sick leave and it's really neither of those things', she says. They can feel quite unwell after some of the appointments, particularly egg retrieval. Emotionally they might not feel connected to the workplace at that time, she points out. Yet employees often struggle in silence, maybe because they perceive it to be a taboo topic, or they fear that declaring they are trying to start a family may harm their career progression. But keeping it secret not only adds to the stress but also runs the risk that altered behaviour in the workplace may be wrongly interpreted, again to their detriment. NISIG believes that workplace awareness of fertility issues and a policy to support those having treatment is good for employees and employers alike. It welcomes a new guide for Irish companies produced by Sims IVF, entitled Navigating Fertility Treatment in the Workplace. It's just a hugely personal thing to have to say. It's not a conversation you want to be having until you're ready, and you're in a place where you can do it — NISIG spokeswoman Caitríona Fitzpatrick Sims IVF is one of the approved providers in the HSE IVF funding scheme that was launched in September 2023. Currently, heterosexual couples who meet the required criteria are entitled to one free cycle of IVF – or ICSI (intracytoplasmic sperm injection, ie sperm is injected directly into an egg), or up to three rounds of IUI (intrauterine insemination) treatment. At the end of June, eligibility for this scheme was extended to couples experiencing 'secondary infertility' , ie having difficulty conceiving a second child. However, there is no statutory entitlement to time off work during what is known to be both a physically and psychologically demanding and complex process. 'It is absolutely perverse,' Labour TD Ged Nash told the Dáil in January 2024, 'that we have correctly decided funded IVF is a public good, yet access could be restricted to those who can work flexibly, unless a statutory right to leave to access it is introduced.' He was speaking on a Labour Party Bill that seeks to give workers the right to leave for fertility treatment as well as early pregnancy loss. It is hardly surprising that the impetus for the Bill came from a workplace predominated by women and where flexibility and short-notice leave is particularly challenging – primary schools. Representations from the Irish National Teachers' Organisation prompted the current Labour leader Ivana Bacik , then a senator, to introduce the Organisation of Working Time (Reproductive Health Related Leave) Bill 2021. Last month, the Minister for Children, Disability and Equality, Norma Foley, when asked by Laois TD William Aird if she would support the implementation of that Bill, simply referred to ongoing research on relevant issues, adding: 'Family leave provisions are kept under review to ensure that they are appropriate to the needs of working parents.' Since the start of the HSE's assisted human reproduction treatments (AHR) scheme , there has been an average of 500 referrals per month to the six public regional fertility hubs. Many of these patients can be managed successfully at the hubs via a range of surgical and/or medical interventions and do not require further advanced tertiary treatment such as IVF. In 2024, the hubs made a total of 1,470 referrals to one of the eight HSE-authorised AHR providers. This year, 911 referrals had been made up to July 7th, according to the HSE. Photograph: Dara Mac Dónaill A review of the first 12 months of the scheme (September 2023 to August 2024), found 262 clinical pregnancies were reported by the HSE's fertility hubs. A further 79 couples were discharged with a clinical pregnancy from one of the private AHR providers contracted by the HSE. [ Eight healthy babies born in UK after IVF using DNA from three people Opens in new window ] 'It is important to note that relatively few couples had been discharged from a private provider by the end of August 2024, with most of the referred couples still undergoing investigation or treatment,' an HSE spokeswoman adds. 'While it is too soon to have meaningful data, the initial results from the service are in line with expectations.' Although there is undoubtedly much more openness around assisted reproduction, people still experience stigma, says Fitzpatrick. 'A lot of it is a self-stigma, in that they've kind of judged themselves. All that feeds into an emotional toll,' she says. People are much more likely to talk about it after they have been successful. 'If it's unsuccessful, or you're going through it, is where people keep it very quiet because I suppose they don't want to build up any kind of expectations and they're still only getting their heads around how to explain what they're doing.' They may also worry that the mere mention of fertility treatment might have an employer's mind jumping forward to the need for maternity leave, as hypothetical as it might be at that stage. At a time when a couple or individual may be investing thousands of euro in private fertility treatment, she says, the fear that they may be passed over for promotion or, say, leadership on a project, 'just compounds all this emotional stress'. NISIG spokeswoman Caitríona Fitzpatrick 'It's just a hugely personal thing to have to say. It's not a conversation you want to be having until you're ready, and you're in a place where you can do it.' Availing of a workplace policy would require a privacy trade-off, with disclosure at some level, but a clearly flagged and supportive path when doing this would help. Fitzpatrick says people would not need to indicate exactly where they were in the process. There are also challenges for employers in addressing these matters, including accommodating a need for time off at short notice, depending on the nature of the work. 'I think knowledge is power,' says Fitzpatrick. 'If they get to know this area, then they can work with their employees on it. As with lots of other areas like this, if an employee feels supported they become very loyal to that employer and it's very hard to put a price on that.' NISIG sees people who have left their jobs while undergoing treatment because they felt it was too stressful. 'Or they would take a sabbatical because they could not deal with that other pressure in the background and what they felt was a total lack of understanding.' Some really good, proactive employers, she says, ask NISIG to talk their HR department through what assisted reproduction involves and its impact on patients. They use that information to inform their own workplace policies. NISIG would like to see the provision of designated leave led by legislation but, in the meantime, hopes that 'a serious number' of employers will take the need on board 'so that it becomes the norm' to have guidance in the workplace. It should be the same for fertility treatment.' Then individuals and couples 'can make their decisions based around knowing', Fitzpatrick adds, 'as opposed to being halfway through their treatment and suddenly feeling like, 'I'm going to have to tell somebody,' and it complicates the whole thing.' The HR manager at Sims IVF, Niamh Doran, wrote the new guide for employers and fellow HR professionals, drawing on real-life experiences of clients, gathered by last year's survey, to highlight the challenges and offer possible solutions. Fostering open communication is key, she suggests, as is employees being able to trust their line manager or HR team to be understanding. 'It's just going to make people feel less like they're being watched. They won't feel like it's going to stunt their career growth, which I think is the number one concern, particularly for women,' Doran says. The guide includes a fertility policy template for companies to follow when creating their own policies. 'If there's not those examples out there, it's hard to know where to start. We're hoping that this is a jumping off point and people can then tailor it to their business needs.' Ibec declined to comment on issues raised in this article. Employee voices on fertility treatment and the workplace: 'I was told it was likely to not work and [will] have to keep trying, so how am I going to manage so it won't impact on my work?' 'Empathy drastically dropped after the first two rounds. My boss actually rolled his eyes when I said I was doing the fourth round.' 'I can see my employer is already trying to recruit for my role in case I go on maternity leave. This makes me uncomfortable as, depending how my treatment goes, I may never go on maternity leave.' 'I received support from my direct manager; the company overall did not know I was undergoing treatment.
