
Madras HC Orders Rape Convict's Prison Wages Be Split Between Children Of Victim And Wife

The court ruled that both children — the one born from the rape and the one from the convict's wife — must receive equal financial support.
In an extraordinary verdict, the Madurai Bench of the Madras High Court recently upheld the rape conviction of a factory foreman and directed jail authorities to extract labour from him in prison, with his wages to be split between two children — one born out of the sexual assault and the other from his lawful marriage.
The bench of Justice KK Ramakrishnan confirmed the conviction of the 40-year-old appellant, Paraman, under Section 376 of the Indian Penal Code. Court dismissed his plea that the sexual act was consensual, finding that the alleged consent was obtained through coercion, threat, and a false promise of marriage — rendering it invalid under law.
The judgment emphasised the vulnerability of the victim, a woman from the same Scheduled Caste community, who worked under Paraman at Saradha Match Factory in Puliparapatti village, Virudhunagar District. The high court found that Paraman used his position of authority to harass and ultimately sexually exploit her. When she became pregnant and sought support, he refused to marry her, prompting her to lodge a complaint in 2006.
While the initial police action was limited to charges of cheating and harassment, the judicial process evolved to frame charges of rape based on the victim's testimony and evidence. The trial court sentenced Paraman to seven years of rigorous imprisonment and imposed a fine of Rs 60,000 in 2019. Against this decision, he moved the high court.
Citing the victim's credible and consistent testimony, Justice Ramakrishnan relied on several Supreme Court precedents to underline that coercion, abuse of position, and false promises vitiate any alleged consent. 'Only due to the economic duress and constant fear she has succumbed to the accused and her consent is not a voluntary one, but has been obtained by coercion," the court observed.
'Extraordinary circumstances demand extraordinary remedy," the court noted, invoking landmark rulings from the apex court including Prithipal Singh v. State of Punjab (2012) to justify this deviation from the norm.
'The duty of this court does not end with the dismissal of the appeal by confirming the conviction and sentence imposed against the appellant…Mere conviction and sentence of imprisonment in the said circumstances can not meet the ends of justice in the eyes of the children," the court stated.
Accordingly, with a 'heavy heart", the high court directed the jail authorities to extract labour from the appellant and his salary is to be disbursed equally to the child born through the victim and his lawful wife.
The court also directed the jail authorities to submit a compliance report every six months.

The proposed increase would push Pakistan's defence budget to Rs 2,500 billion, further solidifying its focus on military expenditure at a time when its economy is struggling under the weight of an unprecedented debt burden. The country's economic health has been a growing concern. According to the latest Economic Survey, Pakistan's public debt has reached a record high of Rs 76,007 billion, a figure that has nearly doubled over the past four years. Just five years ago, Pakistan's debt stood at Rs 39,860 billion. To put this into perspective, a decade ago, Pakistan's public debt was a mere Rs 17,380 billion—indicating an almost five-fold increase in the past 10 years. The surge in debt is not limited to external borrowing. Domestic debt now stands at Rs 51,518 billion, while external debt accounts for Rs 24,489 billion. The Economic Survey warns that such a massive increase in debt could lead to serious economic vulnerabilities, including rising interest burdens that might cripple the country's fiscal sustainability. The survey also highlights that if left unaddressed, Pakistan could face long-term economic instability, affecting everything from social welfare to infrastructure development. World Bank figures reveal the stark reality. While India has lifted 171 million people from extreme poverty in the decade between 2011-12 and 2022-23, 1.9 million additional people fell into poverty in 2024-25 in Pakistan. The World Bank report on Pakistan in April said the country's 2.6 per cent economic growth 'remains insufficient to reduce poverty". The poverty rate is estimated to stand at 42.4 per cent (US$3.65/day 2017 PPP) in FY25 in Pakistan, 'virtually unchanged from last year", the report said. In a country where inflation is soaring, unemployment is high, and public services are underfunded, many question whether this continued emphasis on military spending is sustainable or responsible. With an economy teetering on the brink, Pakistan's fiscal mismanagement could risk further plunging the country into economic turmoil. As Pakistan's defence budget continues to rise, the population remains increasingly burdened by inflation, poverty, and a government that seems reluctant to make the tough decisions necessary for long-term economic recovery. These cards would help track the routes and distances women travel — from taluk to district to state level — and provide reliable data for reimbursements. The e-Governance Centre was also reportedly working on integrating Aadhaar numbers with the cards. However, this plan has since stalled. As the scheme nears its two-year mark, there has been no renewed effort or discussion to resume smart card multiple allegations have emerged regarding misuse of the scheme. Some women reportedly show Aadhaar cards from other states to avail of free rides, while others obtain tickets for long distances but disembark midway. There are also claims of inflated ticketing to draw extra reimbursements, causing losses to the said that the Finance Department has consistently raised objections about the lack of a smart card mechanism and the resulting ambiguity in expenditure. It has warned the Transport Department that without proper beneficiary verification, future reimbursements may be from the e-Governance Centre confirmed that while there was an initial plan to issue smart cards, no clear directive has been received since then. There is currently no active discussion or preparation underway for card distribution. The Finance Department insists that smart cards are vital for accurate data collection, preventing misuse, and potentially saving crores of rupees for the govt. Although funds continue to be released to avoid inconveniencing women or stalling the scheme, another formal reminder will soon be issued, sources said.
