The Delhi High Court has confirmed the dismissal of a commanding officer in the Indian Army, Samuel Kamalesan, who consistently refused to participate in regimental weekly religious parades due to his Christian faith, despite multiple counselling sessions and opportunities provided by his superiors.
Kamalesan challenged his termination and the denial of pension and gratuity, arguing that he had accompanied his troops to the mandir and gurdwara during weekly parades and festivals. He sought exemption only from entering the innermost sanctum during rituals, citing respect for his monotheistic Christian beliefs and his troops' sentiments.
His plea highlighted that the regiment maintained only a mandir and a gurdwara for its religious needs, not a 'Sarv Dharm Sthal" for all faiths. The court noted that the dismissal was based on his conduct and its negative impact on military discipline and unit cohesion, not solely on his Annual Confidential Report (ACR) ratings.
The HC emphasised the dedication of armed forces personnel and their ethos of placing the nation before self and religion. It observed that the armed forces are united by their uniform, not divided by religion, caste, or region, and commanding officers have a higher responsibility to ensure their troops can observe their religious practices.
Commissioned as a lieutenant in March 2017, Kamalesan served in the 3rd Cavalry Regiment, which includes Sikh, Jat, and Rajput personnel. He led a squadron primarily composed of Sikh soldiers and noted the absence of a Sarv Dharm Sthal, or church, on the premises.
Kamalesan claimed regular attendance at the mandir and gurdwara but sought to avoid the inner temple sanctum during rituals. The respondent argued that his consistent non-attendance at regimental parades was despite efforts to explain their significance. The Chief of Army Staff reviewed the records and deemed his retention undesirable due to misconduct.
The court dismissed the plea, underscoring the secular principles of the armed forces, despite regimental names and war cries that might appear religious to outsiders. It respected the religious beliefs of personnel but stressed the higher standard of discipline required in the armed forces.
The HC ruled that Kamalesan's prioritisation of his religion over a lawful command constituted indiscipline. It underscored that the armed forces and military leadership, not the courts, determine necessary actions for effective command and troop motivation. The termination order highlighted Kamalesan's behaviour as contrary to the Indian Army's secular ethos and detrimental to officer-troop camaraderie essential in combat.
The court concluded that a court-martial trial for Kamalesan's misconduct was impractical due to the sensitive nature involving religious beliefs and upheld the disciplinary action taken against him.

AAP MLA from Amritsar North and former IPS officer Kunwar Vijay Pratap Singh on Sunday raked up the 2015 Bargari sacrilege and also raised questions over the integrity of his own party's government on delivering justice. In a Facebook post, he shared a poster marking the sacrilege incident that took place at Burj Jawahar Singh Wala in Faridkot on June 1 and titled it 'Justice Denied'. 'Today marks 10 years since the beadbi (sacrilege) incident. Till now, it has not been decided which court will hear the case — whether the district court of Faridkot or that of Chandigarh. The investigation by the relevant SIT also remains incomplete,' he mentioned. He said, 'Similarly, the sacrilege incident in Bargari in September and October 2015 shook all of Punjab. The situation in that case is no different. The Kotkapura and Behbal Kalan police firing cases, which occurred on October 14, were also shelved.' 'Whenever I had the opportunity, I made every effort to raise this issue in the Punjab assembly. On October 9, 2021, after the high court's order regarding the Kotkapura firing, I resigned from my IPS position,' he said. According to Kunwar Vijay, 'Three months later, after Kejriwal assured me of justice, I joined the Aam Aadmi Party. If AAP's 92 MLAs were elected, the issue of sacrilege had big contribution to it. But today, I feel both ashamed and disheartened. In fact, I have faced constant oppression from the government machinery politically and if I am still alive today, it is only by God's grace.' 'There is, however, some solace for me and for the people of Punjab that the main accused admitted his guilt before the Akal Takht on December 2, 2024', he said. A former IPS officer who headed the SIT probing post-sacrilege police firing incidents that killed two Sikh protesters in 2015, Kunwar Vijay is known for his dissenting voice and raised questions over the AAP government publicly in past. He never misses an opportunity to take potshots at his party's government in Punjab, particularly targeting chief minister Bhagwant Mann. Recently, Singh questioned the arrest of Jalandhar Central MLA Raman Arora in a graft case, alleging the legislator was often seen hosting members of Mann's family. Prior to this, he had also criticised the state government over the deaths of 27 people due to the consumption of spurious liquor in the Majitha sub-division of Amritsar.

A day after the announcement by Damdami Taksal chief Harnam Singh Dhumma regarding preventing acting jathedar Giani Kuldeep Singh Gargaj from delivering a message from the platform of Akal Takht during an event marking Operation Bluestar anniversary on June 6, Gargaj called for panthic unity on Sunday. The announcement has left the Shiromani Gurdwara Parbandhak Committee (SGPC) worried as in such a situation, it may be challenging for it to maintain peace during the commemoration. On Monday, an SGPC delegation, led by president Harjinder Singh Dhami, will meet the Damdami Taksal chief. Reiterating that Gargaj's appointment was not made in accordance with the Sikh 'rehat maryada' (code of conduct), Dhumma had on Saturday said the community does not accept Gargaj as a legitimate jathedar, and any attempt by him to deliver a message would be strongly opposed by the Damdami Taksal and other Sikh organisations,' he said. Meanwhile, Simranjit Singh Mann, president of the Shiromani Akali Dal (Amritsar), said any attempt to silence Giani Gargaj is unjust and divisive. 'We will not allow such a misconduct. Sri Akal Takht Sahib is Sikhs' spiritual throne. Here, we must gather with humility and respect to remember our martyrs through prayer,' he said. 'From Abdali to Indira Gandhi, many have attacked Sri Akal Takht Sahib, but it has always stood firm. We urge Baba Harnam Singh Dhumma to uphold the sanctity of this Takht and show seriousness and respect in his statements,' he said. An SGPC official, requesting anonymity, said, 'Maintaining peace during the event will be a big challenge.' Harjinder Singh Dhami will lead an SGPC delegation to meet Dhumma on Monday. In a press release issued by the SGPC office, he stated that the purpose of the meeting with the head of Damdami Taksal is to strengthen the panthic unity and to prevent any kind of confrontation during the event. Dhami admitted to being concerned about the current situation but expressed confidence in finding a meaningful resolution. Meanwhile, Giani Gargaj also appealed to the entire Sikh community to commemorate these days with the spirit of panthic unity and pay respectful homage to the 'martyrs'. He said, 'The Sikh community can never forget the military attack of June 1984. The first week of June each year is a deeply emotional and solemn time for the Panth, when martyrs are remembered. These martyrs sacrificed their lives for the nation, and they will always hold a place of utmost respect in the hearts of the Sikhs'. Gargaj said, 'From time to time, certain forces have covertly attempted to prevent the Sikh community from remembering the martyrs of June 1984 and to sow division within the Khalsa Panth. However, the community has always remembered its martyrs with unwavering spirit (chardi kala) and will continue to do so. The panth needs unity, not division.'

The June 19 bypoll in the Nilambur Assembly constituency in Kerala is shaping up to be a fierce four-cornered contest with the addition of PV Anvar and Mohan George as the Trinamool Congress (AITC) and BJP candidates, respectively, in the fray. Anvar, whose resignation in January as a Left-backed Independent lawmaker had forced the bypoll, said on Sunday that he would file his nomination papers on June 2 as an AITC candidate after his persistent efforts to be inducted into the Congress-led UDF proved to be unsuccessful. He said he was forced to take the decision as the UDF 'closed its doors' on him. At a press conference at his home, the former MLA lashed out at Leader of Opposition VD Satheesan, terming him 'autocratic' and accusing him of blocking the path for him to be brought into the UDF. 'This bye-election is an opportunity for the common people of Nilambur to register their protest and grievances against the current LDF dispensation and the chief minister. Particularly, there are hardships being faced by the migrant settlers in hilly areas. We are fighting to win. We will get the anti-incumbency votes against the CM,' Anvar said. Anvar added that the UDF candidate Aryadan Shoukath would not succeed in the bypoll as he does not have the strength to counter the politics of Pinarayi Vijayan. The businessman-politician, who won from Nilambur in 2016 and 2021 as an LDF-backed Independent, broke ranks with the LDF last year after levelling a series of allegations against top cop MR Ajith Kumar and senior CPI(M) leader P Sasi. Once seen as a close confidante of CM Vijayan, Anvar gradually made his opposition to the chief minister the bulwark of his politics. After resigning as MLA, Anvar signalled his support to the UDF and had even said that he would not contest the bypoll. Though he tried relentlessly through talks with various UDF leaders to enter the alliance, it is widely assessed that his personal rivalry with Shoukath, a man he had defeated in 2016, proved to be the sore point in the discussions. Satheesan told reporters on Sunday, 'We closed the door for talks with Anvar because he keeps repeating the same allegations against our candidate Aryadan Shoukath.' Meanwhile, on the eve of the last day for filing nominations, the BJP fielded Mohan George, a lawyer who accepted the party's membership on Sunday and was long associated with the PJ Joseph-led Kerala Congress and Kerala Congress (B). George, a native of Nilambur, is a council member of the Mar Thoma Sabha, a prominent Church in the state, and the vice-president of the Mar Thoma Church in Chungathara. George told reporters after his nomination, 'There will be a strong fight here, no doubt. The BJP has a good influence in Nilambur and we seek the votes of every community. I decided to leave the Kerala Congress party because it is not strong here in Malappuram district.' The BJP, through George's candidacy, is seen as building a bridge with the Christian community in the constituency who are a strong vote-bank and hold influence particularly in the high-range areas. While the bye-election in Nilambur is scheduled on June 19, the votes will be counted on June 23. Swaraj a candidate with 'clean image': Kerala CM CM Pinarayi Vijayan, addressing his first LDF election convention in Nilambur on Sunday, exhorted voters and LDF cadres to back M Swaraj stating that he is a candidate with a clean image. 'He (Swaraj) is known to everyone. You have received the news of his candidacy with a lot of is a candidate with a clean image. He can always ask for votes from anyone with his head held high. Such large public attendance at this convention attests to it,' said the CM. At the same time, the CM also trained his guns on Anvar, saying that his 'betrayal' to the Left forced the bypoll. In his convention speech, the CM listed the achievements of his administration and claimed that the state has become a model for good governance.
