SNGP director flags challenges in removing encroachments

Hindustan Times15-07-2025
MUMBAI: The director of Sanjay Gandhi National Park, in his recent affidavit to the Bombay High Court, said 10 places -- in Uttan, Bhiwandi, Kalyan, Ambernath, Shahpur, and Murban -- were inspected on June 6 by concerned authorities, including the forest department and housing board officials, to relocate illegal encroachers at Sanjay Gandhi National Park and were found to be unsuitable. This is in response to the court's January orders in a contempt petition filed in 2023 by the Conservation Action Trust and its executive trustee, Debi Goenka, in the Bombay High Court, alleging non-compliance to its 2003 judgment directing removal of encroachments, rehabilitation of eligible encroachers, and construction of a boundary around the park.
The affidavit states that the inspected sites either lacked electricity, water supply, sewage and drainage facilities or fell under no development zones (NDZ) and Green Zones. Additionally, in May 2025, they were to identify eligible families for rehabilitation. However, due to non-cooperation by encroachers over unwarranted apprehensions, this could not take place. The survey period was then extended till the end of July 2025.
Another affidavit submitted on March 5, set a May 31 deadline to demolish commercial-use encroachment on the forest land. These were located among residential-use encroachment areas in tightly-packed hutment colonies, making it difficult to access for demolition. The July 11 affidavit states that these demolitions were initially planned for May 5 and 6. However, they were postponed because of the non-availability of police bandobast and then due to opposition from 2,000 to 2,500 people led by local political leaders. On May 26, a former corporator of the Thane Municipal Corporation (TMC) allegedly gathered a hostile crowd and obstructed the demolition squad. 'There was a very real possibility of violence breaking out against the Forest Department officials and staff along with the police personnel; the demolition program was abandoned,' the affidavit said.
The affidavit also highlighted that the state issued 18 Government Resolutions and granted an administrative sanction of ₹221 crore for constructing boundary walls around the SGNP Division. Out of this, the forest department received ₹74.28 crore in the FY 2024-2025 and paid it over to the Public Works Department on March 31. On July 10, the executive engineer from PWD sent a letter to the SGNP administration stating that tenders for 17 works of boundary-wall construction. The technical and financial bids received for another 10 tenders were under scrutiny.

HC reopens plea on safety lapses at construction sites post Bhiwandi mishap

On August 5, an iron rod from an under-construction metro rail site in Bhiwandi in neighbouring Thane district fell on a moving autorickshaw and pierced a 20-year-old passenger's head Press Trust of India Mumbai The Bombay High Court has reopened a 2024 plea on safety lapses at high-rise construction sites in light of an accident earlier this week in which an iron rod from an under-construction metro rail site fell on a moving autorickshaw in Bhiwandi, injuring a man. On August 5, an iron rod from an under-construction metro rail site in Bhiwandi in neighbouring Thane district fell on a moving autorickshaw and pierced a 20-year-old passenger's head. Expressing anguish over repeated safety breaches, a bench of Justices Girish Kulkarni and Arif Doctor noted that although a committee was formed in 2023, its recommendations had not been circulated to all planning authorities. In 2023, the high court had taken up a suo motu plea after two bystanders were killed when a cement block fell on them from the 52nd floor of an under-construction building in Worli. The HC had directed the formation of a committee to recommend safety measures. Quoting its 2023 order, the court on Thursday said it had "expressed a hope that none of the high-rise constructions in the city of Mumbai should make people vulnerable and prone to such accidents in which innocent people would get hurt or lose their lives". It further held that exposing people to such dangers in public areas amounted to a violation of their fundamental right to livelihood under Article 21 of the Constitution. The court on Thursday was informed that the committee had submitted its report. The bench then questioned if its recommendations were being implemented at construction sites that pose risks to the public. "Such concern of the court as on date is resurrected in view of the recent incident, in which an iron rod fell from the bridge under construction, and pierced the head of an autorickshaw passenger," the bench said. The court directed the BMC to place on record the expert committee's safety guidelines, so that the state government can forward them for implementation to all municipal and planning authorities. "These measures are in the larger public interest and therefore, expeditious action in this regard is required to be taken," the bench stressed, posting the matter for hearing on August 12. Supreme Court to take up petition seeking J&K's statehood today

The Supreme Court will take up a petition today that has sought directions to the government to restore Jammu and Kashmir's statehood within a specified timeframe. read more The Supreme Court will take up a petition on Friday that has sought the restoration of Jammu and Kashmir's statehood. In August 2019, the Narendra Modi government abrogated Article 370 that granted special status to J&K. It also bifurcated the state of J&K into two union territories of J&K and Ladakh. While the government has stated the commitment to the restoration of J&K's statehood, it has not given any timeline. The petition in the SC, filed by academic Zahoor Ahmad Bhat and social activist Khurshaid Ahmad Malik in October 2024, has sought directions to the government for the restoration of J&K's statehood within a specified timeframe, preferably within two months, according to Hindustan Times. STORY CONTINUES BELOW THIS AD In their petition, Bhat and Malik have said that 'the non-restoration of the status of statehood of Jammu & Kashmir in a timebound manner violates the idea of federalism which forms a part of the basic structure of the Constitution of India', as per the newspaper. They further said that the prolonged status of a union territory is unwarranted and calls for prompt action in accordance with the assurance given by the government in earlier proceedings before the Supreme Court. After the revocation of Article 370 was challenged in a clutch of pleas, the SC in December 2023 upheld the revocation and ordered that elections must be held in J&K before September 2024. However, the SC did not pass any ruling about the restoration of statehood and acknowledged the government's stated commitment to the restoration of statehood. In line with the SC's judgement, assembly elections were held in J&K in September and October 2024, leading to the formation of a government led by Omar Abdullah of J&K National Conference (NC). However, there has not been any announcement regarding the restoration of J&K's statehood.
