
Judge rules for developer, county in Chain of Lakes suit
Mar. 14—It appears there is one less obstacle to a developer's plans to build a RV park at Happy's Inn following a recent court ruling in Lincoln County.
District Judge Matt Cuffe ruled in favor March 4 of the county Board of Commissioners and Parks Family Real Estate.
Parks Family Real Estate and Happy's RV Park wants to build a 21-acre park which would include 69 recreational vehicle sites and 20 tent sites. The park would be located just north of U.S. 2 across from Happy's Inn.
The Board of Commissioners voted to approve a preliminary plat for the proposed RV park in September 2022.
Kris Cole of Parks Family Real Estate said he was happy with the ruling and the support of the community.
"We're still waiting on (Montana) DEQ and they (Thompson Chain of Lakes Stewardship Coalition) could appeal the judge's ruling, but we have no plans to change our plans for the park," Cole said in a Tuesday phone interview with The Western News. "We really appreciate the support we've received from the community."
Cole said things are also looking good in terms of the degradation permit application that is needed for the installation of a septic system.
"We don't have a time line for when work begins and ends, but we're five years into it and we're not giving up," Cole said. "It's a very stringent process to get approval and we'll look forward to that."
The coalition was formed in the summer of 2022 partially in response to the proposed commercial development.
Coalition Chair Karen Wickersham spoke to The Western News about Judge Cuffe's ruling.
"We are disappointed by the verdict, yet we remain committed to the Thompson Chain of Lakes Neighborhood Plan, which we believe is relevant," Wickersham said. "The Neighborhood Plan was developed over a three-year collaborative process that engaged a broad range of participants, including property owners, businesses and various other stakeholder groups.
"The plan establishes a shared community vision for the Thompson Chain of Lakes' future growth. It was approved by the county commissioners and incorporated into the Lincoln County Growth Policy in 2010. Our group stands by the plan and we are exploring our legal options," Wickersham said.
Opponents of the RV park are primarily concerned about its proximity to several spring-fed waterways on the Thompson Chain of Lakes. The group said the RV park is allowed to use up to 207,000 gallons of water per month with subsequent wastewater output. The group says this quantity will put homeowner's wells and lake levels at risk.
Cuffe heard arguments from attorneys representing both factions in December 2023. David K.W. Wilson, Jr. and Robert Farris-Olsen of the Helena firm Morrison, Sherwood, Wilson & Deola, argued for the Chain of Lakes Coalition.
In the argument for the coalition, Wilson talked then about the county adopting the Thompson Chain of Lakes Neighborhood Plan in 2010 with a goal of maintaining the natural resource values of the area.
"While the growth plan is not a regulatory document, the planners decided that RV parks shouldn't be located where it is proposed," Wilson said at the 2023 hearing. "We don't think Lincoln County gets off the hook because it didn't implement zoning in the area."
Those responsible for the 2010 Neighborhood Plan said, "maintaining the water quality of lakes, streams and wetlands is important. Many of the lakes are recharged through groundwater flows and wetland. Most of the lake shorelines, other than Crystal, Lavon and Bootjack lakes and the upper lobe of Upper Thompson, have very little shoreline development. The natural shorelines and well-vegetated character of the area help maintain good water supply."
At the December 2023 hearing, Alan F. McCormick of Missoula-based Garlington, Lohn and Robinson and Angela LeDuc of Kalispell-based Rocky Mountain Law Partners spoke for the county and the developer.
"In terms of the septic permits, the commissioners may have given their approval, but DEQ (Montana Department of Environmental Quality) still has to issue or deny the permit," McCormick said. "The county is only obligated to take public comment and submit it to the DEQ."
He also argued that local governments are prohibited from denying development based, "solely on non-compliance with a growth policy because zoning hasn't been implemented."
Among others in his ruling, Cuffe cited the fact that no allegations were made that the proposed RV park does not comply with the design standards in the county's subdivision regulations.
Cuffe also mentioned the county Planning Department's unanimous vote to recommend commissioners grant preliminary plat approval.
He also wrote that the Neighborhood Plan, which began its formation in 2005 by the Chain of Lakes Homeowner's Association in partnership with Plum Creek Timber Co., Lincoln Co., Montana Fish, Wildlife and Parks and Fisher River Valley Fire Rescue, states it is a "guide to use and development, as opposed to a regulatory document."
Cuffe also determined that the Chain of Lakes Stewardship Coalition's right to be heard and participate was not violated.
Many involved on either side of the matter cited concern for highway traffic speed in the area. The county sought a reduction from 70 miles per hour to 45 mph in the area from Crystal Lake Road to east of West Camp Road on U.S. 2.
But a 2023 Montana Department of Transportation study determined a decrease was not necessary. DOT officials cited a review of crashes from 2012-2021 with 34, including 13 with injuries and no fatal crashes. The study also said the highway was operating at 4% capacity.
MDT did suggest Happy's Inn should contact it and acquire permitting for temporary speed reductions during large events. Happy's Inn does utilize large signs during events to alert drivers.

Matthews to require annual audit of one organization after setting nonprofit funding threshold
MATTHEWS, N.C. (QUEEN CITY NEWS) — Matthews is going to require all organizations that receive at least $50,000 from the town to submit an annual audit – but only one group qualifies at this time. The Board of Commissioners initially was to consider requiring the audit for either all nonprofits who use town funds or annually receive direct or in-kind support excess of $75,000. A compromise of sorts was made, coming up with the $50,000 figure since it aligned with IRS tax-exempt guidelines. This threshold only covers the Matthews Alive festival. 'Is no one else concerned that Matthews Alive is the only organization from which we're requiring an audit,' asked Mayor John Higdon. Commissioner Gina Hoover agreed. 'There is wide margin, and when you add in in-kind support provided to Matthews Alive, that pushes them beyond six figures. That was where I felt comfortable creating the differential in the threshold.' Hawke added that there's another nonprofit that has requested more funding, and given commissioners' support later this year, would pass the $50,000 mark. 'For these other organizations, we essentially cut them a check and don't have direct involvement in anything else that they do,' she said. 'It's much different with Matthews Alive. We are intently involved in that event. That was the difference.' North Carolina statute states that if a city or county grants or appropriates $1,000 or more in any fiscal year to a nonprofit organization, the municipality may require that the group have an audit performed. If the nonprofit has an annual budget of less than $300,000, the town will provide an additional $5,000 in annual support to complete the audit. The policy was approved unanimously. GOP braces for first ‘test run' on codifying DOGE cuts
Congressional Republicans are gearing up for a major test of how easily they can lock in cuts sought by President Trump's Department of Government Efficiency (DOGE). Speaker Mike Johnson (R-La.) said he aims to have the House act swiftly on approving Trump's request for more than $9 billion in cuts to foreign aid and public broadcasting funding. That package is expected to hit the floor this week. 'We haven't done anything like this in a while, so this is probably, in some ways, a test run,' House Appropriations Chair Tom Cole (R-Okla.) told reporters. Trump last week sent Congress a request for $8.3 billion in cuts to the United States Agency for International Development (USAID) and foreign aid, and more than $1 billion in cuts to the Corporation for Public Broadcasting, which provides some funding to NPR and PBS. The request kick-starts a process that would allow Republicans to claw back funds for a list of programs on the administration's chopping block with just a simple majority in both chambers. That means Republicans wouldn't require Democratic votes in the Senate if they can stay mostly unified in greenlighting what's known as a rescissions package. But it's been decades since Congress has approved such a request to yank back funds previously greenlighted by lawmakers. Trump tried to use the same process to rescind funds in his first term but was unsuccessful, despite Republicans controlling the House, Senate and White House at the time. Republicans are bullish that this time will be different, however. '[Trump's] done this before, and they've got a great team, I think, in place,' Cole said. 'They've thought about these things a lot in the time in between his first and his second term.' 'They just seem to me to be much more sure-footed, and there's no question, the president has much more influence inside the Republican Party than he had during his first term,' Cole added. Still, some Republicans have expressed concerns about parts of the request. Senate Appropriations Committee Chair Susan Collins (R-Maine) voiced opposition last week to cutting the President's Emergency Plan for AIDS Relief (PEPFAR), saying Wednesday that the idea makes 'no sense' to her 'whatsoever.' 'Given the extraordinary record of PEPFAR in saving lives, it has literally saved millions of lives, and so I do not see a basis for cutting it,' she said. And not all Republicans are thrilled by the proposed cuts to public broadcasting in the plan, which calls for rescinding $535 million in both fiscal 2026 and 2027. 'You go to rural America, public television is how you get emergency broadcasting and all that kind of stuff,' Rep. Mike Simpson (R-Idaho), a spending cardinal, said Thursday. 'I look at Idaho Public Television, they're a great organization, and we don't see the politics that some states do in them, or at least they believe they see that and stuff.' However, Simpson said he still intends to support the overall package. 'I don't think in the long run, the rescissions are going to hurt them, because we're talking about the advanced appropriations and stuff like that.' 'What they're concerned about is, and should be, is the next year's appropriation process and stuff,' he continued. On its website, DOGE estimates that it's racked up $180 billion in savings as of June 3 through a combination of efforts like asset sales, contract cancellations and renegotiations, 'fraud and improper payment deletion, grant cancellations' and workforce reductions. And White House budget chief Russell Vought signaled further special requests to lock in more DOGE cuts could be on the way when pressed on the matter during a budget hearing last week, particularly as the administration's ongoing efforts to shrink the government have been tangled up in courts. But he also said it's 'very important' for this first package of cuts to pass, adding, 'If it does, it'll be worth the effort and we'll send up additional packages.' 'We are very anxious to see the reception from a vote standpoint in the House and the Senate,' Vought said, though he added, 'I'm less concerned about the House as I am in the Senate.' Some Republicans see the package introduced this week as potentially the easiest one to deal with, as many in the party have been critical of foreign aid and funds going to outlets like PBS and NPR, which they've accused of political bias. In a statement promoting the package on the social platform X, House Majority Leader Steve Scalise (R-La.) on Friday touted the president's request as cutting '$9.4 BILLION in wasteful spending' while holding 'bureaucrats accountable to the American people.' The package would target dollars for items like migration and refugee assistance that the administration says support activities that 'could be more fairly shared with non-U.S. Government donors,' USAID efforts they say have been used to 'fund radical gender and climate projects,' and development assistance they argued 'conflict with American values' and 'interfere with the sovereignty of other countries,' among other rescissions. Funding would also be eliminated for the United Nations Children's Fund, U.N. Development Program and the U.N. Population Fund under the proposal, as well as the World Health Organization and 'portions of the U.N. Regular Budget for the U.N. Human Rights Council and the U.N. Relief and Works Agency for Palestine Refugees in the Near East.' Democrats, meanwhile, have come out in strong opposition to the plan, accusing Trump of seeking political retribution and undermining foreign assistance efforts. They've also signaled trouble down the line when it comes time for both sides to negotiate a funding deal for fiscal 2026 — when Democratic support will likely be necessary to keep the government open in early fall. 'It's going to make it very difficult for us to do bipartisan bills if we believe that he's just going to send rescissions over for whatever they want or don't want in a bipartisan agreement,' Sen. Patty Murray (Wash.), top Democrat on the Senate Appropriations Committee, told The Hill this week. 'They need Democratic votes.' There's been some GOP frustration over the administration's handling of the annual funding work as well, as lawmakers on both sides have pressed the White House for more information about its budget plans in recent weeks. 'If we're getting to the point where we are right now, where we have a [funding stopgap], where we don't really have spend plans that are meaningful, now we have the administration transferring to the Congress their desires with rescission,' Sen. Lisa Murkowski (R-Alaska), a senior appropriator, said. 'I don't want to be a committee that no longer has a purpose. The role that we play is significant.' Copyright 2025 Nexstar Media, Inc.
