While Durban communities grapple with prolonged water outages the eThekwini Municipality has recorded a 57,81% in water distribution losses in its April 2025 financial report.

RESIDENTS have accused the eThekwini Municipality of allowing their money to literally go down the drain with "blatant disregard", given the fact that the city's water distribution loss stood at 57.81%.
As a result, having water on tap, daily, is like a roll of the dice for many communities in the municipality's area of jurisdiction because they have grown accustomed to constant outages that run for days and weeks in some instances.
While there seem no end in sight to eThekwini's water woes, still, ratepayers must brace themselves for possible tariff increases for water and other utilities that the city supplies to residents, in the coming weeks.
During an eThekwini Finance Committee meeting in April 2025, the municipality stated in a report that the water loss (57.81%) was above the norm which of 15 to 30%.
As it has done in the past, the municipality continued to blame illegal water connections, ageing infrastructure and damage to infrastructure due to the floods, as the breaches in their system.
On Thursday, the Reservoir Hills Ratepayers Association (RHRA) demanded immediate action and responses concerning the ongoing and unresolved water supply failures that have affected large parts of Clare Estate and Reservoir Hills.
This included an outage on May 5, which left surrounding communities without water for extended periods. Yogesh Naidoo, Director of RHRA stated that the failures were not isolated or unforeseen.
Naidoo said that between January 9 and 29, the RHRA issued multiple urgent notices to the municipality detailing:
•Over 60 burst pipes reported within days
•Repeated supply disruptions, some exceeding 10 days
•Failed or substandard repairs leading to immediate re-bursts
•Lack of skilled personnel, Pressure Relief Valve (PRV) regulations, and basic resources (e.g. backfill and asphalt)
•Nightly cut-offs allegedly linked to the Sherwood 3 Reservoir without public explanation
•Total breakdown of the municipality's complaint logging and response systems (call-centre, WhatsApp app).
'From January, the Water and Sanitation Department has repeatedly ignored or inadequately responded to warnings by the ratepayers and Ward 23 Councillor Alicia Kissoon,' he said.
Naidoo said that despite the documented failures, including requests to inspect PRVs and commission un-utilised infrastructure built at public expense, no substantive response or action plan was received by RHRA.

The current operational status of Sherwood 3 Reservoir and Wiggins Waterworks
Details of any planned repairs, scheduled upgrades, or supply interruptions
The name and contact details of the senior official responsible for the infrastructure
A detailed log of all reported pipe bursts and unresolved complaints in Ward 23 from January 1 to date, including steps taken.
Meanwhile, concerned resident Musaddiq Ebrahim said that the Bonela and Chesterville community had experienced water outages, with no supply at all on some days. Ebrahim said the community was at breaking point, which led to residents of Chesterville, who were also connected to the same reservoir, resorting to blocking the N2 freeway on multiple occasions, out of frustration.

Image: Ayanda Ndamane / Independent Newspapers Lawsuits related to the 2022 flood damage in Durban are piling up, with a claim of R540 million filed by affected businesses against the Department of Transport, Transnet, and the eThekwini Municipality. The claims filed at the Durban High Court indicate that the insurers of packaging companies (Corruseal Properties Limited and Corruseal Corrugated KZN Ltd) are suing for R540 m to cover the damage and the costs of recovering from the disaster. The Mercury reached out to the company several times but could not obtain a comment. Attempts to contact the Durban, Johannesburg, and Cape Town offices were also unsuccessful. Craig Woolley, a director at law firm Norton Rose Fulbright South Africa Inc., confirmed that they have filed the claim on behalf of the insurer relating to the 2022 flood damage. It is a subrogated recovery claim, whereby the insurer takes over the right to sue. This is the third subrogated lawsuit filed against the three defendants, with the insurer of Toyota South Africa and the insurer of the media company Caxton Publishers also filing lawsuits for R6.5 billion and R340m, respectively. In the latest claim, the first plaintiff is Corruseal Properties (Proprietary) Limited, while the second plaintiff is Corruseal Corrugated KZN (Proprietary) Ltd, which is listed as the second plaintiff. Transnet, the Department of Transport, and the eThekwini Municipality are listed as defendants. The second plaintiff conducts cardboard manufacturing, printing, and packaging from its premises in the Prospecton Industrial Area, located. The first plaintiff owns the premises from which the second plaintiff's business is conducted. The basis of the claims is that the three defendants owned and operated flood control equipment and failed in their duty of care to ensure that the equipment functioned optimally. Consequently, they failed at a critical moment, leading to floodwaters entering the business premises of the two plaintiffs and causing extensive damage. The claim specifies that three structures failed: the Umlaas Canal, the diversion berm, and the stormwater management system. According to the court papers, the claim states that the three defendants should have been aware that the failure of their infrastructure and the lack of maintenance of their flood control systems would result in flooding of the business premises. The court papers said as a result of the aforementioned circumstances, on or about 12 April 2022, the structural integrity of the diversion berm was compromised, causing it to collapse and resulting in stormwater flowing uncontrollably into the Prospecton Industrial Area and onto the plaintiffs' premises, causing extensive flooding and resultant damage. As a result of these events, the plaintiffs suffered damages amounting to R540 762 462.20, made up as follows: R417.8m for the fair and reasonable costs necessarily incurred in the repair and reinstatement of the plaintiffs' premises and property, and R122.9m for the second plaintiff's business interruption.

After years of hard work, late nights, and unwavering dedication, Naidoo, 26, of Raisethorpe proudly graduated with a law degree from UKZN, in 2020, and was ready to enter the legal profession. But life had other plans. Faced with her mother's worsening illness, she made the courageous decision to put her legal career on hold and start a home-based business - Blooming Platter. She hopes the business, which she started two weeks ago, will not only provide for her family, but give her the flexibility to be present for her mom. Naidoo was proud to see that residents from Raisethorpe and surrounding areas in Pietermaritzburg supported her during Lakshmi Pooja and Raksha Bandhan at her stall on Friday and Saturday. 'Everything was sold out in record time. Despite advertising since mid-July, people only secured orders after my post on Facebook. Even more people reached out after the article on the POST website and social media pages. This showed me the power of social media. 'It makes me feel hopeful especially since I have been working on this for a while. It reinforces that anything is possible if you work hard enough and if you choose to follow your passion. Image: Supplied Since her graduation, Naidoo has completed her Master's in law and took on flexible roles in academics at universities where she could. 'My parents had me late in life. I was their miracle baby. I have no siblings or extended family. My father passed away in 2019 at age 72. He suffered from dementia. 'My mother, who is 70, has many illnesses. She has mobility issues since she had a stroke three years ago and she is blind. Since last year, she has been getting worse.' She said she never lived a lavish lifestyle, with her father working part-time jobs and her mother being a housewife. 'I always wanted to do well, which is why I studied hard. To take care of my mother, I worked as a tutor and lecturer for UKZN and DUT, using my academics to help me. 'However, circumstances have changed, and I've now taken on the role of her full-time caregiver. Because of this, I've had to stop working as my mother only has me and we do not have any friends nor family.' Naidoo said they currently relied on her mom's old age pension. 'I need flexibility. I am alone. I will not put my mother in a home and caregivers are not an option because it costs money, which we do not have. Since my parents had me late, and my mother is much older, I know my time with her is limited, I will not sacrifice her for money.' Naidoo said she looked for remote work but jobs were scarce. 'I like business law. I have drafted contracts before, serving at places for free to gain experience, and I would like to work in an office one day but it is not possible right now." Hence, the Blooming Platter business was started just last week. 'The name of my business is because I see myself as a flower that has yet to bloom. I have been stagnant in my career but now I have the confidence to start blooming, beginning with this business, which I started with my savings. 'I do not have anyone to rely on, so from the money I got from tutoring and lecturing, I put it towards this business. Some kind people have also contributed towards my ingredients.' She said she learned to cook from an early age because her mother could no longer help. 'I taught myself to cook and make sweetmeats. My mother could not help much because of her vision. It has been many years since I have had my mother's cooking.' One day Naidoo hopes to diversify her business, not only selling food products. 'I would like to expand my business to build and sell other services, using my academics to hopefully one day help others. 'Many people always say, 'you were top of your class, you should have moved to Johannesburg and taken your mother' but it is not that simple. I have no support system besides my mother, so I cannot just take that leap.'

Calls for extension of eThekwini Municipality's debt relief programme

This is the view of professional bodies, including the Black Lawyers Association and the KwaZulu-Natal Legal Practitioners Association. The organisations have written to Mayor Cyril Xaba, urging the extension of the programme, stating that it has addressed serious challenges that had been stifling the property sector. The Mercury has seen the correspondence from these organisations addressed to Xaba. Their view is shared by ratepayers and opposition parties in the council, who believe the programme has provided much-needed relief for ratepayers. Mayoral spokesperson Mluleki Mntungwa confirmed that it had received the correspondence but said it would not be appropriate to discuss the matter through the media. The Special Debt Relief Programme was implemented by the municipality during May and June this year. The programme's structure offers a 50% write-off on qualifying arrears upon full settlement of the remaining balance. The Legal Practitioners Association stated that the initiative provided much-needed financial relief to ratepayers across the municipality, particularly those affected by economic hardship and undetected water leaks. It has contributed to smoother conveyancing processes and improved confidence in municipal cooperation,' said a representative from the Legal Practitioners Association. 'In light of its success and the ongoing financial challenges faced by many residents, we respectfully request that the municipality consider extending the Special Debt Relief Programme for a further period of three months. This extension would allow greater exposure of the relief to a wider public audience and ensure that more ratepayers—especially those who may have missed the initial window—can benefit from this important initiative. 'We also kindly request that, should the programme be extended, the municipality publish clear and comprehensive information regarding the eligibility criteria and required documentation. This should include specific guidance for: Individuals applying for relief Companies seeking to regularise their accounts Deceased estates, where executors or legal representatives may need to act on behalf of the estate The Black Lawyers Association confirmed they have written to the mayor and echoed the same sentiment in their letter. 'This intervention has made a meaningful difference for numerous residents and businesses, many of whom have faced financial strain due to prevailing economic pressures and undetected utility losses. 'By providing an opportunity to write off 50% on qualifying arrears upon settlement of the outstanding balance, the municipality demonstrated not only fiscal sensitivity but also a proactive commitment to social responsibility. Further, this demonstrates that we are led by a council which cares!' 'As legal professionals—many of whom work extensively in property law and municipal compliance—we have witnessed the tangible benefits of the initiative. 'Clients who had long been unable to finalise property transfers or access services due to account arrears were finally able to bring their accounts up to date. This has supported both the local property market and the broader legal ecosystem, fostering smoother transactional processes and increased legal certainty.' It urged the municipality to consider extending the programme for an additional four months. Asked about whether an extension should be considered, eThekwini Ratepayers and Residents Association president Ish Prahladh said: 'Actually, yes, it has had a positive impact on the property and business industry. Remember, all ratepayers and businesses are cash-strapped owing to our economy. It would definitely be a big help if it was extended.' IFP councillor Jonathan Annipen said the party fully supported the call to extend the programme. 'We believe this initiative has proven effective in addressing long-standing challenges faced by ratepayers and has helped to stabilise the property industry. Last month, the IFP submitted a motion to the council calling for the reinstatement of this programme. Unfortunately, this was rejected by the Speaker of council.
