SC slams WB's 10-yr exclusionary norm of continuous teaching
NEW DELHI: The
Supreme Court
has slammed the West Bengal govt's decision to deny teachers who had joined universities in West Bengal from other states the benefit of extension of retirement age from 60 to 65 years on the parochial ground that they had not taught in state-domiciled institutions for a continuous period of 10 years.
A bench of Justices P S Narasimha and Manoj Mishra said it can never be the intention of a state to deprive teachers of the benefit of retirement age extension despite their having requisite experience from universities outside its jurisdiction.
"Classifying employees based on past teaching experience from universities within or outside West Bengal, particularly at the verge of retirement, after having served for decades lacks nexus and discernible object," the bench said.
Writing the judgement, Justice Narasimha said, "When such decisions are subjected to strict scrutiny in judicial review, they unfortunately expose themselves as parochial, potentially undermining our resolve of fraternity".
He added, "Constitutional courts must be vigilant and identify such decisions, embedded in the nooks and crannies of public administration and set them aside, for they have the potentiality of triggering similar actions by other States and their Instrumentalities".

The bench said it is easy to adjudicate a dispute on the constitutional scale of equality, which can be asserted by a citizen as a fundamental right.
However, the principle of fraternity, one of the founding goals of the Constitution, rarely asserts itself.
"It is the duty of the constitutional court to recognise its erosion, even in the bylanes of public administration and to restore the essential 'We' to ensure the unity and integrity of the nation," said Justice Narasimha.

Tejashwi's name claim falls flat as EC hits back
1 2 Patna: RJD leader Tejashwi Prasad Yadav was left red-faced on Saturday after the Election Commission of India (ECI) confirmed that his name was indeed present in the draft electoral rolls released and uploaded to its website on Friday contrary to his claims. Tejashwi, in a hasty press conference held in Patna earlier in the day, alleged that his name was missing from the draft rolls despite having duly filled out the enumeration form and submitting it through the booth level officer (BLO). However, official records showed his name listed in the Digha assembly constituency with serial number 416 and house number 110. Patna district magistrate Thiyagarajan S M said Tejashwi's EPIC number – RAB0456228 –remained unchanged from 2020. It appeared that Tejashwi had been searching using an outdated EPIC number, RAB2916120, which he himself read aloud during the press conference, saying "records not found". Following the clarification, senior BJP leader and deputy CM Samrat Choudhary launched a scathing attack on the RJD leader. Jr colleges see red as edu dept order surrender of unfilled quota seats
Mumbai: In what junior colleges see as yet another instance of "high-handedness by the govt", the state's school education department has directed them to surrender all unfilled minority quota seats by Aug 2 and unfilled management quota seats by Aug 9. Until last year, surrendering these seats was voluntary, and colleges were allowed to fill them until the final round. So far, four rounds of first-year junior college (FYJC) admissions have been completed, with the fifth 'open-for-all' round set to begin soon. While colleges which are unable to fill their minority seats have already surrendered, some others do not wish to surrender at a short notice. Adding to their woes, several colleges are facing technical issues in updating minority students' data, as the process requires OTP verification through students. Some principals have written to the govt, requesting that colleges be allowed to fill these quota seats till the end of the admission process. A principal said that updating minority students' data on the FYJC admission portal is tedious as the system generates an OTP, which is sent to the students' registered numbers. "So we are expected to call each and every student and sometimes many are unresponsive," said a principal, adding the govt has sent the circular only two days before the deadline for minority admissions. Another principal said till last year the discretion to surrender the seats lied with the colleges. "Many colleges willingly surrender their minority seats as it gets added to the general pool, but that discretion should remain with the colleges. We have already submitted our arts and science vacant seats after the third round, but we do not wish to surrender the commerce seats. But the circular says that these seats will automatically go to the open category after Aug 2. We are requesting the govt to allow us to follow the process as it was last year," said the principal.
