India rejects arbitration court's IWT ruling: ‘Holds no legal standing'

India has rejected the award of the 'so-called Court of Arbitration' on issues of general interpretation of Indus Waters Treaty, which New Delhi has kept in abeyance following the April 22 Pahalgam terror attack.
Responding to queries on the latest award given by the Court of Arbitration, MEA spokesperson Randhir Jaiswal said, 'India has never accepted the legality, legitimacy, or competence of the so-called Court of Arbitration. Its pronouncements are therefore without jurisdiction, devoid of legal standing, and have no bearing on India's rights of utilisation of waters.'
'India also categorically rejects Pakistan's selective and misleading references to the so-called 'award',' Jaiswal said.
'As reiterated in our press release of 27 June 2025, the IWT stands in abeyance by a sovereign decision of the Government of India, taken in response to Pakistan's continued sponsorship of cross-border terrorism, including the barbaric Pahalgam attack,' he said.
On August 8, 2025, the Court of Arbitration, chaired by Prof Sean D Murphy of the US, gave an award that 'addresses certain questions concerning the overall interpretation and application of the Treaty, including in relation to Article III (which concerns the Western Rivers) and Paragraph 8 of Annexure D (which concerns new run-of-river hydro-electric plants that India may construct on the Western Rivers).'
India has not participated in the arbitration proceedings and has repeatedly objected to the competence of the court.
Earlier, the Court of Arbitration had given its Award on Competence on July 6, 2023, in which it held that India's non-appearance in these proceedings does not deprive the Court of Arbitration of competence. On June 27, it gave a Supplemental Award on Competence, stating that 'India's position that it is holding the Treaty in 'abeyance', however that position may be characterized as a matter of international law, does not deprive the Court of Arbitration of competence.' India has opposed the proceedings of the Court of Arbitration since its constitution in October 2022, saying it could not be 'compelled to recognise illegal and parallel proceedings not envisaged by the Treaty' and boycotted the court hearings. It, however, continued participating in the 'Treaty-consistent Neutral Expert proceedings'.

Misri also called on Nepal's President Ramchandra Paudel and conveyed greetings from the Indian leadership. During the meeting, he briefed the President on the progress in bilateral ties. Announcing his arrival, the Indian Embassy said: "Foreign Secretary of India Vikram Misri arrives in Kathmandu for an official visit, which reflects the tradition of regular high-level exchanges between India and Nepal, and reaffirms the commitment to the Neighbourhood First policy." In a statement issued on Friday ahead of Misri's visit, the Ministry of External Affairs (MEA) said: "India and Nepal share strong and friendly ties, which have seen concrete progress in recent years in diverse areas of cooperation. India attaches high priority to its relations with Nepal under its Neighbourhood First policy. Foreign Secretary's upcoming visit continues the tradition of regular high-level exchanges between the two countries and will be an opportunity to further advance our bilateral ties." According to Nepal's Ministry of Foreign Affairs, during the visit, the two Foreign Secretaries will hold discussions on various aspects of the Nepal-India partnership, with a focus on connectivity, development cooperation, and other matters of mutual interest. During his two-day visit, Chinese Foreign Minister Wang Yi will hold bilateral talks with his Indian counterpart, S. Jaishankar, on Monday evening to lay the groundwork for Prime Minister Narendra Modi's visit to China later this month. Wang will also hold the 24th round of Special Representatives (SR) dialogue on the boundary issue with National Security Adviser (NSA) Ajit Doval on Tuesday. Later in the evening, Wang will call on Modi. Both Wang and Doval are designated special representatives for the boundary talks. Some of the issues likely to be discussed during Wang and Jaishankar's meeting include further de-escalation on the border, resumption of direct flight services, and border trade through all the designated trade points — Lipulekh Pass in Uttarakhand, Shipki La Pass in Himachal Pradesh, and Nathula Pass in Sikkim. According to the Ministry of External Affairs (MEA), Wang will call on PM Modi at his 7 Lok Kalyan Marg residence at 5:30 pm on Tuesday. The PM will travel to Tianjin, China, to attend the Shanghai Cooperation Organisation (SCO) Summit on August 31 and September 1, after his visit to Japan starting on August 29. In Tianjin, Modi is scheduled to hold a bilateral meeting with Chinese President Xi Jinping on the sidelines of the summit. NSA Doval had travelled to China in December last year and held the SR talks with Wang. Since then, Jaishankar has met Wang on the sidelines of multilateral forums, including a meeting in Beijing in July, while Doval last met Wang in June. The Modi-Xi meeting in Kazan on October 23, 2024, helped overcome friction after the Galwan Valley military clashes of June 2020, paving the way for the normalisation of ties between the two countries, including a disengagement pact for Depsang and Demchok.

The visit of the Chinese leader comes amid increasing tensions in India-US relations following President Donald Trump doubling tariffs on India to 50 per cent. Wang Yi will land in New Delhi at around 4:15 pm on Monday and will meet Jaishankar for bilateral talks at around 6 pm. Meanwhile, Wang and NSA Doval are scheduled to hold a new edition of Special Representatives (SR) dialogue on the boundary question at 11 am on Tuesday. He will then call on PM Modi at his 7 Lok Kalyan Marg residence at 5:30 pm on Tuesday.
