HC orders bring shift in real estate sector, protect homebuyers' interests
Experts believe that the monopoly of developers is finally diminishing.
Hearing a plea from an allottee's association of a major housing project at Paikarapur in Kalinga Nagar, the Orissa HC brought a stay on the construction of an approach road by the developer to another of his projects since it was allegedly taken up in the common area of the existing housing project.
The builder, in this context, was executing a housing project in phases, which was never disclosed to the owners of the first project.
The builder fraudulently obtained plan approval from authorities and forcefully demolished a boundary wall, which was in the common area of the first project.
"According to the Apartment Ownership Act, the builder should hand over the common areas and the facilities to us and has no rights on the land, but here the builder used force. We approached the HC and received a verdict in our favour," said president of the housing society Ajit Kumar Choudhury.
In another verdict, the Orissa HC adjourned the matter in a case filed by a developers' association seeking a change in an ORERA notification, which says that all developers should keep 1% of the project value in its account for five years to cover expenses for any structural damage.
As per rules, the closure of a project can only be announced, and an occupancy certificate issued to a project if developers adhere to keeping the 1% of the project value, but it was challenged in the HC, and the verdict went in favour of the rules.
"ORERA in its notification mentioned that 1% amount should be kept in its account as security, which is to be utilised for maintenance till five years. A city-based developers' association challenged this notification, but the matter was adjourned," said real estate expert Bimalendu Pradhan.
Another case was filed a few months back to ensure appointments of the chairperson and members of ORERA, as all three positions went vacant since May 2025.
In the meantime, the govt has filled up all positions but doubts have been raised about the qualifications of one of the appointed members.
The HC, hearing the case on June 25, kept the matter and gave a next date of hearing. "The orders passed by the High Court recently have instilled hope among the buyers that they can fight for their own rights and win," Pradhan said.
In another case, a complaint was raised on two major issues: Was BDA correct in giving plan approval to a project within a BMC area after the power to approve plans was delegated from BDA to BMC in 2015, and was the revised plan valid? The HC asked the BMC to dispose of the matter in two months.
In yet another case, the HC heard whether a project being executed in phases should have one association or multiple ones. The matter was challenged by a major city-based developer, on which the HC brought a stay order on the use of common areas.

Despite the Brihanmumbai Municipal Corporation (BMC) spending thousands of crores in flood prevention, several parts of Mumbai went under water on Tuesday as heavy rains created havoc in the maximum city. The BMC in its climate budget for the financial year 2025-26 had earmarked Rs 15,048 crore for urban flooding and water resource management–accounting for 88 per cent of the overall climate budget and 20 per cent of BMC's overall annual civic budget of Rs 74,400 crore. The allocated amount also includes the Rs 2,200 crore fund, which the BMC had earmarked for the storm water department (SWD) which is responsible for the flood mitigation in the ongoing financial year. The civic officials, however, attributed the waterlogging and flooding across the city to the continuous heavy rain. Data recorded in the BMC's automatic weather system (AWS) showed that several areas in Mumbai recorded rain exceeding the 300-mm mark on Tuesday. According to the BMC's data, some of the pockets that recorded very high rain include the Chincholi (Malad) which recorded 369 mm of rain, followed by 337 mm at Kandivali, 305 mm at Dindoshi, 300 mm each at Dadar and Magathane, 293 mm at Vikhroli, 290 mm at Powai, 288 mm at Mulund and 265 mm at Fosburry (Azad Maidan – Colaba). As rain intensified during the wee hours of Tuesday, almost all these areas got submerged disrupting traffic and regular flow of life. The BMC's ambitious Rs 130 crore pumping station at Hind Mata also didn't come effective as the entire junction went under water for the second consecutive day on Tuesday. The BMC officials also said that in the past four days more than 1,600 crore litres of water have been channelled out of Mumbai which is twice the storage capacity of Tulsi Lake that has a capacity of 800 crore litre. 'Between August 16 and 19, all the six pumping stations of Mumbai along with 540 portable dewatering pumps were working continuously and during this period a total of 1,645 crore litre of water have been channelled out from Mumbai by these pumps collectively,' an official said. The six pumping stations are located at Haji Ali, Worli, Cleveland Bunder, Reay Road, Irla (Khar) and Gazdarbandh (Juhu). In total, these facilities house 43 pumps and civic officials maintained that they have been operating for over 761 hours between the four-day period. 'Even though the pumps are operating relentlessly, the water is still accumulating at certain places because no city is equipped to handle 100 mm of rain within few hours. Earlier on Monday we recorded 200 mm of rain within a five-hour period and on Tuesday the quantum of rain rose to 300 mm. In addition to this there was also a high tide because of which there was an automatic inflow of water since the outfalls continued to stay underwater for many hours leading to delayed discharge of water,' said the official. 'Therefore, it was quite obvious that water will accumulate for few hours. After a two-hour period, regular movement of trains resumed and by 5 pm water started to recede from places,' the official added. Further, the BMC's data showed that of the six pumping stations, the highest quantum of water was channelled out from Irla pumping station at 3,768 million litres, followed by 2,906 million litres at Cleveland Bunder and 2,870 million litres at Gazdarbandh. Besides these, the 540 dewatering pumps had channelled out 182.5 crore litres of water on Tuesday within a six-hour period.

Bombay HC quashes notice issued by magistrate to HDFC Bank CEO in criminal defamation complaint
The Bombay High Court earlier this month quashed a notice issued to HDFC Bank and its Managing Director and CEO Sashidhar Jagdishan by the magistrate court in a criminal defamation complaint filed by Lilavati Kirtilal Mehta Medical Trust (LKMM Trust), which oversees the Lilavati Hospital in Bandra (West). The HC held that the Judicial Magistrate First Class (JMFC), Girgaon had issued notice to Jagdishan in contravention of procedure laid down under the Bhartiya Nagarik Suraksha Sanhita, 2023 (BNSS). The magistrate on the same day issued notice to the Bank, Jagdishan and others. The Trust, in its criminal complaint had alleged that the Bank and Jagdishan had made 'malicious and derogatory' statements against the Trust and its permanent trustee Prashant Mehta. Aggrieved by the notice issued in criminal defamation complaint, Jagdishan approached the HC. Senior advocates Ravi Kadam and Sudeep Pasbola for Jagdishan argued that the magistrate had issued the notice on the same day the complaint was filed and order to issue notice was made without recording complainant's sworn verification, which was mandated as per the law. On the other hand, senior advocate Aabad Ponda for the Trust argued that the magistrate was entitled to issue notice before taking cognisance of the case. The Trust argued that section 223 of Bhartiya Nagrik Suraksha Sanhita (BNSS) provided that the court has to hear the accused before taking cognisance of the complaint, which the court rejected and said the same was incorrect if the main provision and the proviso of the section were considered together. Justice Shriram M Modak emphasised that verification of complainant and witnesses after filing of private complaint was necessary and the proposed accused was required to be heard. 'If we consider the chronology, it shows that after filing of complaint there has to be verification of the complainant and witnesses and when prior to decision on taking cognizance is taken, the accused needs to be heard. Hearing the accused cannot be interpreted prior to recording the verification and the statement of witnesses if any,' Justice Modak observed. 'There is a purpose of recording the verification. It gives an opportunity to the Magistrate to ascertain whether to proceed further or not, the judge added and quashed and set aside the order of issuance of notice to proposed accused Jagdishan. The court clarified that the magistrate was at liberty to proceed with the matter by recording the verification of the Complainant and all witnesses, if any and then pass the appropriate order. The Trust has also filed a defamation suit in Bombay HC against the HDFC Bank and Jagdishan seeking damages of Rs. 1,000 crore and the same is pending before the court. Meanwhile, Jagdishan had filed a criminal writ petition challenging FIR registered against him on a complaint filed by the Trust, accusing him of accepting a bribe of Rs 2.05 crore to help a group consisting of one Chetan Mehta and other erstwhile trustees to retain alleged illegal control over the trust. The next hearing on Jagdishan's writ plea is scheduled on August 20.

External Affairs Minister S Jaishankar began a three-day visit to Moscow on Tuesday to strengthen the 'time-tested' India-Russia partnership. The visit comes amid tensions in India's ties with the US, following President Donald Trump's decision to double tariffs on Indian goods to 50 per cent, including an additional 25 per cent penalty for importing Russian crude oil. The Ministry of External Affairs (MEA), announcing the trip, said Jaishankar will co-chair the 26th Session of the India-Russia Inter-Governmental Commission on Trade, Economic, Scientific, Technological and Cultural Cooperation on Wednesday. Amid continuous rainfall in Mumbai, Vihar lake, one of the city's key drinking water sources, started overflowing on Monday afternoon, the Brihanmumbai Municipal Corporation (BMC) said. With a storage capacity of 2,769.8 crore litres, Vihar became the sixth of seven reservoirs supplying water to Mumbai to overflow, providing relief to residents. Located in the Sanjay Gandhi National Park, the lake overflowed at 2.45 pm, according to the BMC. Last year, the lake overflowed nearly a month earlier, on 25 July. A day before, Tulsi lake had also overflowed following heavy rainfall in Mumbai and its suburbs. More than 18 lakh women used free bus travel under Andhra Pradesh's recently launched 'Stree Shakti' scheme on Monday initiative, a poll promise of Chief Minister N Chandrababu Naidu ahead of the 2024 elections, was launched on 15 August. 'On Monday alone, over 18 lakh women availed themselves of zero-fare tickets, saving more than Rs 7 crore in a single day,' an official release stated. Monday marked the first working day since the launch of the scheme.
