Firm taken to court over ‘referral fee' allegedly owed

A former Bayleys agent has taken the company to court for allegedly reneging on his share of the commission on a $30 million Frankton land sale.
The case, which remains unresolved, features high-profile property developer Kurt Gibbons, a former Aucklander now developing more than 200 homes on the land near the Five Mile shopping centre.
Ashley Fogel claimed he was owed a "referral fee" for introducing the land to Mr Gibbons, who ultimately bought it in October 2023 through his company Gibbons & Co.
At a hearing in the High Court in February, defendants Bayleys Real Estate Ltd, referred to in the judgement as "Bayleys Auckland", asked the court for summary judgement — to resolve the dispute without going to a full trial.
The company argued it had no contractual relationship with Mr Fogel and had not benefitted from him introducing Mr Gibbons to the land.
In the decision, Associate Judge Dale Lester said Mr Fogel was a contractor with the company's Otago offshoot, Bayleys Queenstown, until July 2023, when his contract was terminated because of alleged "unethical conduct" — a claim Mr Fogel disputes.
He was told at the same time if Mr Gibbons went on to buy the land, he would be paid a referral fee amounting to 30% of the local agency's share of the commission.
About a fortnight later, Mr Fogel told Bayleys Queenstown managing director David Gubb Mr Gibbons was interested in the land.
He told Mr Gubb if a sale eventuated, he wanted 50% of the "list and sell" — effectively half the total commission.
Mr Gubb replied: "OK with a 50% commission split."
But the dispute arose when the local agency's sales manager, Steve Rendall, told Mr Fogel in an August email his share would be 25% of the total.
Bayleys Queenstown would receive 25%, "as would have been the case had you remained a salesperson with the business", while Bayleys Auckland would get the remaining 50%.
Mr Rendall told him Mr Gubb had meant 50% of the local agency's share, and 25% of the total commission was a "pretty generous offer" given he was no longer with Bayleys.
Mr Gibbons, who in an affidavit said he had been interested in the land in July, but the price had not been right, went on to buy it after seeing it advertised in October.
In the judgement, Associate Judge Lester said Mr Fogel had an arguable case that Bayleys Queenstown had reneged on his agreement with Mr Gubb on a commission split and dismissed its application for summary judgement.
He also found Bayleys Auckland was not entitled to a summary judgement, because Mr Fogel had an arguable case he was entitled to a commission, regardless of whether he had a contractual relationship with the company or not.
Mr Gibbons had become interested in the land after Mr Fogel introduced him to it, which had arguably "served as a springboard for his renewed interest" when he saw it being advertised in October, and Bayleys Auckland had benefited from that.
The company would have known any agent who introduced a buyer would expect to be paid, and Mr Fogel had no contractual right to be paid by its Queenstown agency, Associate Judge Lester said.

It's 9.30 on a Friday morning at Costco and already the line is spilling out the door. Most of those in the queue are here for another delivery of Costco's butter, which has risen to fame due to its price, at $9.99 a kilo. It's become so popular that on Thursday Costco put a limit on it – a maximum of 30 each of the salted and unsalted Kirkland's butter, which comes pre-packed into slabs of 10 individual kilos. Waiting at the door is Aucklander Lisa Blake, who owns a dessert business. She said the cheaper butter helps keep her costs down. "I've saved $600 this morning," Blake said. "So it cost me $600, but I've saved $600 'cause it's twice the price at the supermarket – and it's New Zealand butter made in Hokitika." She had to make an hour-long drive from Papakura to buy it, she said, but it was still worth it as the butter at her local supermarket costed up to $26 per kilo. "I don't really want to put my prices up." Another customer, Mathew Watson, travelled up from Taranaki just to visit Costco. He is relocating to the South Island soon and will freeze his butter stash to take with him. "I'm bulk buying – moving to the South Island soon, so I'll take it with me." Butter prices across the motu have risen significantly in the past year. Stats NZ data showed butter prices were up 65.3% in the last 12 months to April 2025. Another shopper told RNZ she buys from Costco once a week for herself and elderly members of her community in Waiuku. She had previously even waited overnight in the car park so she could be first in line. "I took a whole pile down to my family down the line, last week. They're elderly – they can't afford butter – and our kaumātua shouldn't be going without butter," she said. "They've retired, they shouldn't be struggling to get butter." Courtney Manica had driven from Torbay on the North Shore to see how many blocks of butter she could buy before it sold out. "For the 400 grams it's like $8.99 [elsewhere], and I can't justify spending that. But $10 for a kg is good." She was buying for friends and family who were working and could not make it today. "A friend who runs a bakery, she is saving up to $800 a month on butter because she's coming to Costco," Manica said. A man who helped run a cafe in West Auckland said he was at Costco to save on butter and eggs. He had bought the maximum amount of butter allowed, 30 blocks of each. The cafe had to put its prices up recently to match grocery costs, he said. "This is a massive saving. Butter is in everything – same as eggs – so a very precious commodity." Gavin Senior, another local from Auckland said he was now shopping at Costco for his butter because the prices at his local supermarket had skyrocketed. Over the last couple of years his family has had to be careful with spending. His adult children had also moved home as it was too expensive for them to live elsewhere. "We've just gone back to being more budget, eating more budget. Buying from this place helps 'cause they sell in bulk, so I'm breaking stuff down and separating it in the freezer." At the nearby Westgate Pak'nSave, 500g of butter blocks ranged from $8.99 to $10.99. Woolworths in Westgate had similar prices, from $8.50 to $10.89 for 500g. Checkpoint approached Costco asking why they had introduced a limit to their blocks of butter. They declined to comment. Frankton units meet pent-up demand

An unparalleled number of planned housing complexes in and around Queenstown's Frankton Flats is meeting a range of market demand, including even sub-$700,000 units. About to get under way is Safari Group's first local post-Covid development, Mountain Oak. It's a 141-unit residential complex in Remarkables Park that has a starting price of $639,000 — "the lowest entry point in the market", Bayleys projects GM Gavin Lloyd says. Gibbons Co has also launched The Crest Chalets above Country Lane, featuring 86 one-bedroom chalets from $669,000 and 14 one-bedroom cabins from $689,000. The developer's also finishing off the 226-unit two-bedroom Five Mile Villas, priced from $869,000. About 250 people turned out for its first showhome opening early this month. Local Bayleys managing director David Gubb says that sends a clear signal. "Queenstown's market is hungry for quality, attainable housing, and Five Mile Villas is meeting that demand head-on." The showhome was "a litmus test for pent-up demand in a market constrained by land supply, planning challenges and construction costs". "What's encouraging is this isn't speculative demand, it's grounded in need. First-home buyers, key workers and investors are responding to fundamentals — location, design efficiency and long-term rental viability — not hype." A third Gibbons Co complex, the premium Lakehouse Villas, off Frankton Rd, comprises 63 architecturally designed, freehold homes overlooking Frankton Arm. Ninety percent sold within six months of release. "Flexibility to use these homes for personal and visitor accommodation is a game-changer," Suzie Wingglesworth, Bayleys' national director projects says. She notes Redwood Group also has year-round visitor accommodation consent for the 180 residences in its three-stage Kawarau Villas project near Remarkables Park Town Centre. Bayleys' local CEO Stacy Coburn notes council has also helped by rezoning land resulting from its spatial plan. An example, he says, is the 27-hectare Frankton North area, opposite Five Mile, where Latitude 45's developing Waipuna Rise — a boutique collection of apartments and terrace homes with self-contained studios. Development's also about to start on a huge worker housing complex on the corner of the state highway and Hansen Rd — initially on top of a car storage building. Coburn says Frankton lends itself to medium-density apartments. "And when you see a growth rate annually between 8% and 9% for Queenstown, we've got to allow for this growing population — as long as the infrastructure tries to align." He also notes the investor market's back, spurred in part by the return of tax deductability. Short A-frame timeframe The developer of The Crest Chalets — 100 proposed one-bedroom residential units above Queenstown's Country Lane precinct — hopes to start work on-site in October with a completion date 12 months later. Mountain Scene revealed this month Kurt Gibbons' Gibbons Co has applied for resource consent for 86 A-frame chalets, and 14 elevated single-level cabins off Hansen Rd, having bought the 3.1396ha block last October. He's also applied for six business units on just over 11,000sqm of flat land at the bottom of the site. Gibbon says his aim is to provide freehold product below $1million "and that doesn't have body corporate fees and anything else associated with it". "The theme of this stunning project is the mountains, and each property comes with the most spectacular view," local Bayleys salesperson Sarena Glass says. "The high-end design is similar to what you would find in the European alps, there's nothing else quite like this in Queenstown." The architect's Designgroup Stapleton Elliott in partnership with Gibbons Co.
