
Consent of women employees willing to work at night compulsory in Odisha
Labour and Employee's State Insurance Department in the notification said the consent of women employees willing to work at night would have to be taken in writing while there will be at least three women employees, which may include onsite woman employer.
'No adolescent will be allowed to work whether as an employee or otherwise in any establishment during night,' the government made it clear.
The conditions for engaging women in night shifts say adequate transportation facilities with GPS tracking system to pick-up and drop women employees at or near their residence would have to be provided. The establishment would obtain bio-data and police verification of each driver of the night transportation vehicle, whether employed directly or through service provider.
'The employer will provide toilet or washroom and drinking water facilities near the workplace where such women employees are employed, with provisions of closed-circuit television (CCTV) surveillance and proper lighting including the passages towards conveniences,' the notification elaborates.
Dedicated telephone numbers of the establishment along with government toll-free helpline number for women (181) and Labour & ESI Department Helpline number 18003456703 will be displayed prominently and conspicuously at the establishment and inside vehicles used for transportation of workers, it says.
'The employer will ensure that there will not be less than eight consecutive hours of rest between the last shift and the night shift, whenever the duty of a woman employee is changed from day shift to night shift and vice versa,' the notification further delineates
The State Government has made it mandatory for complying of the provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (14 of 2023).
'Any employer engaging women employees during night, will submit a self-certification in the prescribed proforma, electronically, in the designated portal of the department, that he or she has provided all the facilities as mentioned in this notification and will take due care and diligence regarding the safety, security and dignity of women employees,' the State Government says.
Violation of the condition would attract penalty under section 35 of the Odisha Shops and Commercial Establishments Act, 1956, the notification mentions.

Woman working as domestic help held with Rs 14 lakh MD drug in Thane
Thane, Aug 7 (PTI) Police have arrested a 25-year-old woman who worked as a domestic help after seizing MD drug (mephedrone) valued at Rs 14 lakh from her in Maharashtra's Thane district, officials said on Thursday. Naushin Mainuddin Sheikh, resident of Mumbra, was apprehended on Tuesday evening while she was found moving in a suspicious manner on a road near a defunct hotel in Ulhasnagar, an official from Hill Line police station said. She was stopped and during checking, the police found her in possession of 71.03 grams of MD (mephedrone), a synthetic drug banned under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, he said. The estimated market value of the seized contraband is Rs 14,31,120, the official said. During her interrogation, the accused claimed she had procured the drug for sale from a resident of Nalla Sopara in neighbouring Palghar district and efforts were on to nab him, he said. A case was registered against the accused under relevant sections of the NDPS Act. 'We are currently investigating the source of the contraband and its intended recipients," the official added. KOCHI: In an odd move, the Ernakulam Chief Judicial Magistrate Court has directed the Kochi city police to register a case against Malayalam actor Swetha Menon on charges of 'transmitting sexually explicit content' and 'indecent representation' of women through her roles in certain films, some of them widely acclaimed ones. The case, filed on Wednesday by the Ernakulam central police, stems from a complaint filed by activist Martin Menacherry, who claims Swetha earned money from obscene films. The charges, under the Information Technology Act for transmitting sexually explicit content and the Indecent Representation of Women (Prohibition) Act, cite her roles in films like Paleri Manikyam: Oru Pathira Kolapathakathinte Katha, Rathinirvedam, Kalimannu (which included her real-life childbirth), and a condom brand advertisement, alleging clips from these have appeared on social media and pornographic websites. Responding to the controversy, Kalimannu director Blessy suspects the move is planned. 'Even before the release of Kalimannu in 2012, there were controversies and protests against the film and the artists. But once the film was released with a CBFC certificate, those creating issues went silent since there was no obscene content. Now, after 12 years, some people are filing complaints. I suspect a conspiracy behind this,' Blessy told TNIE. Initially, the police reportedly took no action on the complaint.
