Land Reforms Aim To End Stalled Development In Papua New Guinea

Reforms to land laws in Papua New Guinea should ensure that landowners have more control over their land.
New legislation introduced by the country's Deputy Prime Minister John Rosso would reform six land-related laws.
Rosso says the changes are essential to securing the country's future and safeguarding the rights of landowners.
Prime Minister James Marape commended Rosso for spearheading the reforms.
'Land is our people's greatest inheritance-our playground, our home, our heritage. Every Papua New Guinean is connected to a piece of land somewhere in this country. We must protect it,' Marape told parliament.
RNZ Pacific spoke with its PNG correspondent Scott Waide about the government's motivations for the changes.
(This transcript has been edited for brevity and clarity.)
Scott Waide: The Lands Department has been, for want of a better word, terminally ill, for many years. It has had legislation that dates back to the colonial era.
Papua New Guinea has moved on [and] moved forward with a lot of things. But the [land] legislations have been a hindering mechanism for any form of large scale development, like farming [and] real estate development. Those laws have been a hindrance to much of that development, and also the mobilisation of customary land.
Previously, with the old laws, customary landowners could not adequately mobilise and get loans to develop their land, because the laws [and banks] did not recognise customary land ownership, and the accompanying attempts to allow for that development of customary land.
It has posed a lot of complications in terms of mining development, logging [and] farming. The changes that have been introduced allow for both protection of customary landowners and the possibility of them venturing into large scale businesses.
Don Wiseman: It has being brought in by the Deputy Prime Minister John Rosso. What specifically is he going to do? You have outlined the issues that have existed over land for a long time, but are they going to be overcome with this new legislation?
SW: Yes, many of the problems that have existed for many, many years – from a very, very old system, a manual system, when the rest of the world is operating digitally.
We have had instances where they have been dual titles issued, issued titles over land that have gone missing, because people are reproducing those titles manually.
There is an electronic system that has been introduced as well within the Lands Department, and that is meant to reduce the instances of corruption that have long existed.
A lot of the reforms have happened very quietly within the Lands Department. The other reforms that complement the development of housing, which is a big need in Papua New Guinea, support the development of customary land as well.
So customary land owners can partner with government or with private organisations and develop housing, cheap housing for other Papua New Guineans.
DW: Prime Minister James Marape says this will save the land that is still held, but it is clearly not going to undo a lot of the mistakes from the past, and they have been so many of those, particularly to do with the forestry and so on.
SW: Yes, that is a an issue that I have spoken to a few land experts as well around. And that is going to be a huge challenge to undo all of that.
The other side to it is that there are customary landowners who also sell their own land for cash. The legislations that have been put in place, in the some of the policies have actually banned the sale of customary land to individual parties as well. So, it offers some level of protection for customary land owners.
There needs to be a lot of awareness as well for customary landowners to understand how the law benefits them, and that is going to also take a while.

The proposed legislation stems from a clause in National's coalition deal with NZ First, which promised to revisit the Marine and Coastal Area (Takutai Moana) Act. That commitment was driven by fears that a 2023 Court of Appeal decision could have made it significantly easier for Māori groups to win recognition of customary rights over parts of the coastline. The government introduced a bill to Parliament last year to prevent that, but it hit pause in December after the Supreme Court effectively overturned the earlier ruling. At the time, Justice Minister Paul Goldsmith welcomed the development and said ministers would take time to reassess their plans. Today Goldsmith confirmed to RNZ that Cabinet had agreed to press ahead with the law change regardless, and to pass it before October. "Everybody in New Zealand has an interest in what goes on in the coastline, and we're trying our best to get that balance right." Goldsmith said he was not convinced that the Supreme Court ruling had set a high enough test for judging whether customary rights should be granted. "We've had a couple of cases that have been decided since then - which have shown almost 100 percent of the coastline and those areas being granted customary marine title - which confirmed to us that the Supreme Court test still didn't achieve the balance that we think the legislation set out to achieve." Asked whether he expected an upswell of protest, Goldsmith said that had been an earlier concern but: "time will tell". "There's been a wide variety of views, some in favour, some against, but we think this is the right thing to do." The legislation was one of the key objections raised by Ngāpuhi leaders last year when they walked out on a meeting with Prime Minister Christopher Luxon in protest. More than 200 applications for customary marine title are making their way through the courts. Under the amendment bill, any court decisions issued after 25 July 2024 will need to be reconsidered. That would appear to cover seven cases involving various iwi from around the country. "I understand their frustration over that," Goldsmith said. "But we believe it is very important to get this right, because it affects the whole of New Zealand." Goldsmith said the government had set aside about $15 million to cover the additional legal costs. The Marine and Coastal Area Act was originally passed by the National-led government in 2011, replacing the controversial Foreshore and Seabed Act 2004, which had extinguished Māori customary rights in favour of Crown ownership. The 2004 law - introduced by Helen Clark's Labour government - provoked widespread protest and led to the creation of the Māori Party, now known as Te Pāti Māori. National's 2011 replacement declared that no one owned the foreshore and seabed but allowed Māori groups to seek to recognition of their rights - or "Customary Marine Title" - through the courts or in direct negotiations with the Crown. Customary title recognises exclusive Māori rights to parts of the foreshore and seabed, provided certain legal tests are met, including proving continuous and "exclusive" use of the area since 1840 without substantial interruption. The 2023 Court of Appeal ruling, however, declared that groups only needed to show they had enough control over the area that they could keep others from using it, and that situations where the law itself had prevented them from doing so could be ignored. The Supreme Court subsequently overturned that, saying the Court of Appeal had taken an unduly narrow approach in its interpretation.

10,000 kimonos… 10,000 unanswered questions. On Saturday morning at 9.57am, I joined a humming, 20-strong throng of Cantabrians champing at the bit for the City Mission op shop on Barbadoes Street to throw open their doors. 'It's like a Black Friday sale,' one woman mused, adjusting her empty tote bags in anticipation. 'Let us in, let us in,' another guy quietly chanted, raising an invisible pitchfork in jest. We were all united by one sweeping affliction that suddenly had Ōtautahi in a chokehold: kimono madness. It began with a Facebook post made by the Christchurch City Mission in the middle of an idle Tuesday afternoon. 'Life is full of surprises and topping our list this week is … thousands of kimonos,' the post reads. 'A generous donation of three packed truckloads of kimonos are coming to our Barbadoes Street op shop. Thousands! They are going out the door fast at $2 a pop, so this is your big chance if you have ever fancied owning/wearing one. Arigato!' Soon enough, the post had hundreds of comments and shares, with IRL queues forming out the door of both the Barbadoes Street and Sydenham City Mission stores. 'It's a kimono frenzy,' City Mission retail team leader Josie Cox told RNZ. 'We're selling them for $2 each and they've just gone mad. This morning there were probably 40 people waiting to come in.' The stock arrived by way of three trucks and two vans, and staff couldn't restock the bins fast enough. Any seasoned op shopper is always chasing the dream of stumbling across a rare or weird find, be it a war relic, a treasured timepiece, or even a purse containing a family mystery. But this opshop drop was on another scale of novelty and luxury entirely – 10,000 unique pieces, all in perfect condition, from a mysterious private donor. Where did they all come from? Why so, so, so many? Why central Christchurch? Why now? And, once again, why so, so, so many? I contacted a local kimono historian – who wished to stay anonymous but described themself as 'a detective analysing each and every kimono' – to see what they reckoned. 'A very unusual story,' they wrote, positing the collection may have recently come into the ownership of someone seeking 'a quick resolution.' As for the value, they estimated the total collection would have cost between $10,000-$30,000 to buy in Japan, and at least $5000 to import. Beyond the monetary value, they also explained the historical and cultural significance. 'Kimono were refined over the past 1000 years to the garment we see today,' they said, explaining how the garment is now mostly used as formal wear for the wealthy on special cultural occasions in Japan. 'No fashion designer has ever been able to improve it. The design is perfect,' they wrote, adding that each one is also completely unique: 'your kimono has no copies.' Karen Healey was one of the Cantabrians lucky enough to nab a couple of the peerless $2 pieces for herself from the Barbadoes Street op shop, after hearing about the donation from a fellow customer at The Fabric Store. 'The second you walked in, there were all these people clustered around these two big bins right at the front – anyone opening the door was hit with kimono,' she described. 'It was a brief little miracle… a dusty, noisy, magical experience.' While Healey says everyone was being 'very kind and considerate' when she visited, Anissa Trinder, aka vintage seller Spice Kotiro, told a different story. Trinder was there 'on a whim' as the multiple trucks arrived, and says that people 'immediately just started going crazy' for the kimonos. She picked up a kimono that she liked the look of, and another woman snatched it right out of her hands. 'I just thought, 'man, fuck this. I do not need a kimono that bad'.' Being a reseller herself, I asked Trinder about the $2 price point and the fact that several are already being resold on Facebook Marketplace for much more. 'The City Mission obviously just wanted to move them through, and they sold them all within the week, which is really beneficial for them,' she said. 'I think it's crazy that lots of them are on Marketplace, especially because it was such a public Christchurch phenomenon and everyone was talking about them.' Healey purchased three kimonos, one yukata and a haori. 'The fabric and the patterning is really what I'm after, so they will be reborn as garments that will be loved and treasured in a slightly different form,' she said. 'And it will make a good story – this shirt came from one of the kimono.' After snatch-gate, Trinder didn't buy anything. 'I am very specific with my style and the things that I sell,' she said. 'I'm also wary of cultural appropriation and all that stuff.' That's another interesting consideration to mull over – is it a risk to have this many kimonos unleashed in a place which still boasts an alarming number of white dreadlocks? While my mystery kimono historian maintained that anyone from 'DJs to traditional Japanese housewives' can now wear a kimono, opinions differ on the mainstream popularisation of the garment. (I also reached out to the Japanese Society of Canterbury for comment, but am yet to hear back). For those who were lucky enough to nab one (or, as Healey observed in one customer, one hundred) of these pieces, there's also delicate care concerns. The kimono expert recommended they are stored flat, ideally in kimono-friendly paper, in a drawer with silica gel and mothballs. As for washing? Go for a hand wash in cold water. 'Must be immersed in a bath to avoid bubbles,' they added. 'Wet area will transfer dye to any dry area, so bubbles are the enemy.' All of the above info would have been useful if, when the doors of the op shop swung open like a saloon on Saturday morning, there had been any of the elusive kimonos left. Alas, we were all about 48 hours too late. I poked about the rest of the store, nabbing a pristine $1 rubber chicken, as multiple bereft women with sharp grey bobs and statement glasses processed the news. 'The kimonos have all sold out, I'm so sorry,' the shopkeeper said gently. 'Now they are just a distant memory.'
