A 59-year-old police captain accused of raping and sexually assaulting two trainees at the Tshwane Police Training Academy has been released on bail.
He appeared in the Pretoria Magistrate's Court on Monday for the outcome of his bail application.
The police captain is an instructor at the academy located in Pretoria West, is facing charges of rape and sexual assault.
The magistrate granted the accused R8 000 bail, a decision welcomed by his legal team.
Rape accused Tshwane Police Training Academy captain granted bail
Attorney Andrew Maoba told eNCA on Monday that the defence did not believe there was a basis for the state to oppose the officer's release on bail.
'We had foreseen that there was no need for these bail proceedings in any event to be opposed because the law in respect of bail is quite trite in South Africa, and it's not digging into the guilt or the innocence of the accused person.
'The test for bail proceedings, as we have indicated in court, substantiated with a case law, is whether the accused person or the applicant will stand trial, and he will not evade liability,' he said.
Maoba further stated that the court's ruling indicated the strength of the bail application put forward by the defence.
'Unsurprisingly, the magistrate granted my client bail today.'

Meanwhile, the Police and Prisons Civil Rights Union (Popcru) expressed concern over the allegations and encouraged trainees to speak out.
'The trainees at all various academics must not feel intimidated. When there are such incidents, they must come out, not die in silence and report them,' Gauteng deputy chairperson Solly Mathe said.
Mathe added that Popcru had called on the South African Police Service (Saps) to implement preventative measures.
'They must create a space where it would be easy for trainees to come out and report such incident because we totally condemn this action.'
Rape incident
It is alleged that on 6 May, the captain called a 20-year-old trainee into his office while she was walking with her colleagues to their sleeping quarters.
While in the office, the accused locked the door and told the trainee that if she did not sleep with him, he would issue her a misconduct letter related to an incident from April, during which the police captain accused her of failing to salute him.
A second trainee came forward with allegations that the same captain sexually assaulted her in March this year, following his arrest on 7 May.
More victims may still come forward as the Independent Police Investigative Directorate (IPID) continues its investigation into other possible incidents.

The police officer has since been suspended.
According to the police, Gauteng recorded the highest number of reported rape cases involving police officers in the previous financial year, with just under 30 cases.
While other provinces saw a decline in such incidents, Gauteng experienced an increase of approximately 35%.
Notably, more of these cases involved officers allegedly committing rape while on duty, compared to those reported while they were off duty.

Image: File An accused wife abuser who is alleged to have violently attacked his wife on their ninth wedding anniversary, and faces possible life imprisonment, will remain behind bars after his second attempt for bail was denied by the Western Cape High Court. The 37-year-old father of four was a fisherman in Mossel Bay up until his incarceration in May last year and faces a charge of attempted murder. He sought to appeal against his bail application, which was heard and denied in the Mossel Bay Magistrate's Court. The lower court found that the man would endanger the life of the complainant, and it was not in the interests of justice to have him released. According to court documents, on May 18, last year, the couple had celebrated their anniversary, but the occasion turned sombre when the man accused his wife of infidelity and began beating her with his fists. During his second bail hearing, the man, adamant that he could only afford R300 bail, denied the charges against him and claimed that he caught his wife in bed with another person. The man is expected to go on trial on November 7. The court documents read: 'The State led evidence that the appellant had assaulted the complainant, including by striking her with a hammer so hard that her arm was broken. The medical evidence suggested that the injuries were life-threatening, and photographs put up by the State revealed severe harm to the complainant's face and body. 'Not only this, but evidence was led to show that he had previously assaulted the complainant, and that the complainant had been raped by the appellant's brother in the presence of the appellant and thereafter he had asked the complainant to withdraw charges against his brother. The State also adduced evidence that the complainant is very afraid of the appellant.' In arriving at his decision, Judge Darryl Cooke at the high court said that while he considered the possibility of imposing bail conditions, he was not convinced that this would sufficiently reduce the risk of harm to the complainant. This was also weighed against the man's disposition to violence, as is evident from his past conduct, and the prevalence of gender-based violence in South Africa. Chief Specialist Scientist at the South African Medical Research Council, Professor Naeemah Abrahams, cited statistics that in South Africa, since 2009, three women are killed by an intimate partner per day. Commenting on gender-based violence and reforms needed, Professor Amanda Gouws previously said South Africa had one of the best national gender machineries globally, but this has since been crippled, and there is currently no coherent, active women's or feminist movement. 'Activism now takes the form of sporadic issue-driven action, such as the campaigns by #TotalShutDown and #EndRapeCulture. While this type of activism is laudable, it does not sustain pressure on the government for action. 'There is thus no simple suggestion for how to reduce gender-based violence. All interventions are contextual and political and need to address different dimensions of a multi-dimensional problem,' Professor Gouws had said.

Calls for the arrest of murder accused Zimbabwe national Jabulani Thabang Moyo are intensifying, Roodepoort Record reports. This after the fatal shootings of two police officers, 51-year-old Warrant Officer Vuyisile Sintwa, and 45-year-old Sergeant Simon Masenye, in the Roodepoort CBD on August 8. When the incident occurred, the officers were transporting Moyo to Boksburg prison from the Roodepoort Magistrate's Court, where he appeared on a charge of business robbery. New information with regard to what transpired on the day is slowly surfacing: According to reports, Warrant Officer Sintwa, attached to Roodepoort police station, was shot inside the vehicle while it was stationary outside the BP garage at Albertina Sisulu Drive and Kroon Street. He was rushed to Millpark Hospital, where he was declared dead on arrival. Sergeant Masenye, a detective at Florida police station, allegedly tried to flee, but was caught in the crossfire and killed on the scene. The Roodepoort Record has learned that CCTV footage shows the suspect, Moyo, fleeing the scene in the state vehicle, which was later discovered abandoned in Onslow Avenue, Horison, just a few kilometers from the crime scene. Police have issued a R150 000 reward for information leading to his arrest. In a statement, the Gauteng Provincial Legislature's Portfolio Committee on Community Safety chairperson, Bandile Masuku, has expressed deep outrage following the incident. 'The committee views this heinous act not only as an attack on our law enforcement officers, but also a direct assault on the rule of law and the safety of our communities,' he says. 'The committee calls on the police and all relevant law enforcement agencies to act swiftly and decisively in apprehending the suspect. No one should be allowed to evade justice after committing such a despicable crime. 'The murder of police officers, who are entrusted with the critical responsibility of protecting our citizens, must be met with the full might of the law.' Masuku adds the committee demands that the suspect be hunted down, arrested, and made an example of to send a clear message that such violence will not be tolerated. 'Furthermore, the committee calls on government to strengthen mechanisms that ensure the safety of police officers and create a conducive working environment for them. 'Police officers must be empowered and supported in their duties, including being allowed to use necessary force when their lives are in imminent danger.' The Police and Prisons Civil Rights Union (Popcru), also expressed shock at the incident. 'These murders are not just an attack on our members but an attack on the very fabric of law enforcement and public safety in our communities,' reads their statement. 'The cold-blooded killing of officers in the line of duty underscores the extreme risks faced daily by police officers and highlights the urgent need for stronger measures to protect them.' Both entities have expressed their heartfelt condolences to the families, colleagues, and friends of the slain officers, and called on community members to come forward with any information that may lead to Moyo's arrest. After facing murder, theft and firearms-related charges, Karen Webb walked free from the city's Magistrate's Court on Thursday under strict bail conditions, ending a drawn-out legal battle that began with her arrest in February 2024. After 18 months behind bars and multiple failed bail attempts, beleaguered Gqeberha firearms dealer Karen Webb walked out of the city's Magistrate's Court with an enormous smile on her face. Flanked by her parents and attorney, Webb took her first breath of free air since her arrest in February 2024 after she was granted bail on two separate cases on Thursday. 'Write a nice article about me,' she told journalists as she got behind the driver's seat of her parents' car and drove off. In addition to two murder charges, the 41-year-old faces 14 counts of theft, fraud and forgery, several charges related to the Firearms Control Act pertaining to the unauthorised transport of weapons, failure to report the loss or theft of weapons, unauthorised production of ammunition and providing firearms training while uncertified to do so, among other charges. The charges relate to allegations that Webb supplied firearms to criminal elements across the country, stole money and firearms from customers and provided uncertified firearms training. While she did not pull the trigger in the two murder charges against her, she is accused of providing the firearms to the violent criminals who committed the crimes. Shortly after Webb's arrest for alleged theft of firearms, her initial formal bail application was dismissed and a subsequent application based on new facts was also refused. A few months ago, she approached the Eastern Cape Division of the High Court in Makhanda to appeal against the decision and was granted bail in the amount of R10,000. However, several more charges had been brought against her, including the murder charges, meaning an entirely new bail application was undertaken. Webb was also charged with being in possession of contraband while in custody at the North End Prison after she was allegedly twice found in possession of a cellphone. She returned to court on Thursday for judgment in the bail application, which included the murder and firearms-related charges. In the judgment, Magistrate Maharaj found that the State did not present a strong enough case to prevent Webb's release from custody. She said while the charges against Webb were very serious, the State's reasons for opposing bail were not persuasive enough. Despite several pending cases against her, Maharaj said Webb had no previous convictions, and the fact that she had a minor daughter and elderly parents in the city was enough to prevent her from fleeing and evading her trial. She said there was also not enough proof before court that Webb might tamper with evidence, attempt to influence witnesses or disturb the public order. Strict conditions Maharaj set strict bail conditions – house arrest between 6pm and 6am, Webb must report to her local police station three times a week, and the investigating officers must be notified before any travel outside Gqeberha. Maharaj transferred the matter to another court where Magistrate Ralton Basterman presided over Webb's bail application related to the cellphones she allegedly smuggled into prison. Webb's attorney, Peter Daubermann, instructed by Louis van Rensburg, told the court he had been in contact with the acting director of public prosecutions, advocate Marius Stander, and made representations that his client should be released on warning. In his submissions, Daubermann said the cellphone charges were 'petty offences that paled in comparison to the other cases against her on which she was already granted bail'. After some back-and-forth between Daubermann and prosecutor Asavela Dweba, Stander contacted the State attorneys and instructed them that bail should not be opposed. Basterman subsequently granted Webb bail in the amount of R1,000 and said no additional bail conditions were required as the conditions of her other bail proceedings were adequate. Upon leaving the courthouse, Webb hugged Van Rensburg before helping her wheelchair-bound mother into their car and driving off. She is expected to return to court on 22 August, when a trial date could possibly be determined. During a previous bail application, it was revealed that more than 1,250 firearms that had allegedly been in her care were still missing. More than 100 firearms linked to Webb have already been recovered from crime scenes across the country. According to an affidavit read into the record by State advocate Liezel Landman on behalf of Detective Sergeant JJ Botha, the weapons disappeared before Webb's arrest in February 2024 and have not been recovered.
