Employee of security company freed on charges of trafficking nearly 31 kg drugs
KUALA LUMPUR: The Shah Alam High Court has acquitted and discharged an employee of a security company on four charges of trafficking 30,891.7 grammes of drugs four years ago.
Lawyer Nabila Habib, representing S. Sukumaran, when contacted by reporters today, said Judicial Commissioner Dr Wendy Ooi Su Ghee, in her decision yesterday, ordered her client to be freed after finding that the prosecution had failed to establish a prima facie in the case at the end of the prosecution case.
'The court found that there was doubt in the identity of the case items, which were drugs, and there was doubt that the drugs seized were the same as those presented in court.
'In addition, the court found that there was a serious increase in the total weight of the drugs after they were seized from the accused,' said Nabila.
According to the four charges, Sukumaran, 31, was charged with trafficking heroin weighing 1,945.4 grams, Monoacetylmorphines (638 grammes) and Methamphetamine (28,308.3 grammes).
He was charged with committing the offence at a house in Bandar Kinrara Puchong, Selangor, and at a parking lot in Bandar Kinrara Puchong, at 1.30 pm and 2.15 pm on May 17, 2021.
He was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which is punishable under Section 39B(2) of the same law, and faced the death penalty or life imprisonment and whipping of not less than 12 strokes of the cane if convicted.

SHAH ALAM, June 14 — The Royal Malaysia Customs Department (Customs) foiled four drug smuggling attempts and seized 22,348 grams (g) of drugs worth RM2.61 million from the Kuala Lumpur International Airport (KLIA) Pos Malaysia Mail and Courier Centre in April. Selangor Customs director Tun Norlela Azumi Ramli said the first seizure involved an export courier box containing 2,609 g of cannabis worth RM193,943 on April 18, while the second seizure occurred when Selangor Customs inspected two courier boxes on April 28 containing 8,935 g of cannabis flowers worth RM905,618. The third seizure occurred on April 29, with 7,344 g of cannabis flowers worth RM719,712 seized and the fourth seizure involved 4,000 g of methamphetamine worth RM800,000 found in two courier boxes on the same day. She said that the syndicate behind the smuggling also made false declarations about the courier boxes. The seized drugs have been taken to the North Port Customs Office for further investigation and the cases are being investigated under Section 39B of the Dangerous Drugs Act 1952. — Bernama

Miri cops nab man with RM220,000 worth of drugs during hotel raid

MIRI (June 13): A local man has been arrested and drugs worth over RM220,000 seized following a police raid on a hotel room here earlier this week. Miri police chief, ACP Mohd Farhan Lee Abdullah, said the raid, conducted at 9.50am on June 11, involved personnel from the Miri Narcotics Criminal Investigation Division and Marudi district police. 'The 41-year-old suspect was arrested along with a suitcase containing around 7 kilogrammes (kg) of suspected methamphetamine, with the total value estimated at RM224,000,' he told a press conference today, adding that the suspect's urine test returned positive for drug use. Initial investigations revealed the suspect, who has prior criminal records, was acting as a drug transporter for a syndicate. The drugs were intended for distribution in Sabah, and he was believed to be paid RM2,000 per kilogram transported. 'The drugs confiscated are believed to be enough to supply 7,000 drug users,' Mohd Farhan added. The suspect is currently under a seven-day remand from June 12 to 19, and the case is being investigated under Section 39B of the Dangerous Drugs Act 1952, which carries the mandatory death penalty or life imprisonment. If there is no death sentence, the offender faces no fewer than 12 strokes of the cane. Mohd Farhan thanked the public for sharing information that led to the successful operation and urged continued cooperation in the fight against drugs. Yusoff Rawther gives cops seven days to provide update over report lodged in 2024
KUALA LUMPUR: Former research assistant Muhammed Yusoff Rawther is giving the police seven days to provide an update on a police report he lodged almost a year ago. In a letter addressed to Inspector-General of Police Tan Sri Razaruddin Husain, his solicitor Law Practice of Rafique demanded a response to the report lodged on Sept 12, 2024. In the report, Muhammed Yusoff claimed that he was a victim of entrapment by two individuals. His lawyers wanted to know if the two individuals named in the report, both politicians, had been called for investigation or to have their statements recorded. "We await an answer from Tan Sri in seven days. Should there be no reply, we reserve our client's right to pursue further legal action," it said in the letter Friday (June 13). On Thursday (June 12), the High Court acquitted Muhammed Yusoff from two charges of drug trafficking and possession of two imitation firearms. Justice Muhammad Jamil Hussin, in his decision at the end of the prosecution's case, said the prosecution had failed to prove a prima facie against Muhammed Yusoff. He had been accused of having control, custody and possession of two imitation pistols and 305g of cannabis. Muhammed Yusoff claimed that he was a victim and had been framed. The court said the police did not carry out any investigation to verify the claim. Justice Muhammad Jamil said this failure to investigate denied the accused's right to a fair trial and therefore it was not safe to call for his defence. On Sept 12, 2024, Muhammed Yusoff was accused of trafficking 305g of cannabis, found in his vehicle near the Kuala Lumpur police headquarters at 10.15am on Sept 6, 2024. He was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries a sentence of life imprisonment and at least 12 strokes of the cane, upon conviction. Muhammed Yusoff was also charged with possessing two imitation firearms by the roadside near a condominium on Jalan Bukit Kiara at 9.25am the same day.
