Wan Ahmad Farid to be sworn in as Chief Justice tomorrow
KUALA LUMPUR: Datuk Wan Ahmad Farid Wan Salleh, who has been appointed as the 17th Chief Justice, will be sworn in tomorrow. Wan Ahmad Farid, 62, succeeds Tun Tengku Maimun Tuan Mat, who retired on July 2. The swearing-in ceremony and the handover of the letter of appointment are scheduled to take place at Istana Negara. In addition to Wan Ahmad Farid, eight newly appointed Court of Appeal Judges and 14 High Court Judges are also expected to be sworn in. Also appointed are Federal Court Judge Datuk Abu Bakar Jais as the President of the Court of Appeal, and Datuk Azizah Nawawi as the Chief Judge of Sabah and Sarawak, replacing their respective predecessors who are due to retire. Wan Ahmad Farid, who hails from Kuala Terengganu, was appointed as a Court of Appeal Judge on Nov 12, last year. He received a law degree from the University of West London in 1985, and received a Certificate in Legal Practice from Universiti Malaya in 1986. His legal career began as an advocate and solicitor at the law firm Messrs Adnan and Wee in Kuala Terengganu, where he served from 1987 to 2003. In addition to his legal career, he was active in administration and politics, having served as political secretary to former prime minister Tun Abdullah Ahmad Badawi from 2003 to 2008, before being appointed as deputy home minister from 2008 to 2009. Between 2011 and 2015, he returned to legal practice as an advocate and solicitor at Messrs Wan Farid and Surin in Kuala Lumpur. Wan Ahmad Farid began his judicial career as a Judicial Commissioner at the Shah Alam High Court, the Kuala Lumpur High Court, and the Kota Baru High Court from 2015 to 2019. He was subsequently appointed as a High Court Judge from 2019 to 2024, serving at the Kota Bharu High Court, the Shah Alam High Court (Special Powers Division), and the Kuala Lumpur High Court (Special Powers Division 3). In 2024, he played a key role in delivering judgment in a suit filed by lawyer Dr Syed Iskandar Syed Jaafar Al Mahdzar concerning the Yang di-Pertuan Agong's powers in declaring a state of emergency. In his ruling, Wan Ahmad Farid held that the Yang di-Pertuan Agong's power to declare an emergency under Article 150 of the Federal Constitution is non-justiciable and therefore cannot be reviewed by the courts. Wan Ahmad Farid was also part of the panel of judges that heard a Federal Court case involving a land dispute over 263.272 acres at Duta Enclave, involving Semantan Estate Sdn Bhd.

Courts cannot impose minimum jail term in drug trafficking cases, says Federal Court
PUTRAJAYA: A car wash employee's attempt to reduce his 30-year jail term for trafficking 7.2kg of drugs was dismissed by the Federal Court, which ruled that the Court of Appeal had already imposed the minimum sentence allowed by the law. A three-member bench chaired by Datuk Nordin Hassan rejected the appeal by Chui Kah Fai, 37, who was spared the death penalty and instead sentenced to 30 years in jail and 12 strokes of the rotan by the appellate court. Nordin delivered his decision after hearing from court appointed lawyer Lee Teong Tooi, who only submitted on Chui's sentence as he had withdrawn his appeal on the conviction at the appeals court. Lee told the judges that he had explained to Chui that he had been imposed with the lowest punishment for a drug trafficking offence. He said Chui, however, was adamant in filing an appeal on the jail sentence and hoped for a further reduction. "This is his (Chui) first offence and he hopes to be released earlier," said Lee. To this, Nordin had asked Lee to explain to Chui that the jail sentence cannot be further lowered. "This is because under the Criminal Justice Act, there is only one punishment and that is 30 years (deemed as life imprisonment) and 12 strokes of the cane. "Explain to him that we have heard the submissions but the court is bound by the law and that sentence cannot be relaxed. Therefore, this appeal is dismissed," said the judge. Deputy public prosecutor Ng Siew Wee appeared for the prosecution. In 2022, the Shah Alam High Court convicted Chui of trafficking 7.2kg of methamphetamine and sentenced him to death by hanging. Chui subsequently filed an appeal at the CoA. However, during a hearing in March last year, Chui agreed to withdraw his appeal on the conviction and agreed to be alternatively sentenced to 30 years and 12 strokes of the cane as substitution to the death penalty. He was found guilty of trafficking the drugs in a luggage bag at about 5.10pm at the Kuala Lumpur International Airport on Sept 27, 2019. The offence comes under Section 39B(1)(a) of the Dangerous Drugs Act and punishable under Section 39B(2). The facts of the case read that enforcers had detected suspicious images on the scan machine but Chui claimed it was underwear and then food. He tried to bribe an enforcer with RM10,000 to prevent arrest and said he no longer wanted the luggage. A search revealed 10 packs of drugs wrapped in aluminium foil hidden between clothings. Tests by a chemist on the drugs confirmed it was methamphetamine. In his defence, Chui testified that he was asked by his employer to send a baggage containing premium tea to Kota Kinabalu, Sabah and that his accommodation and travel expenses would be covered. During his arrest, Chui denied the clothings and the contents in the luggage belonged to him. The trial judge found that Chui's defence that he was an innocent carrier was made up and mere denial.

Former celebrity preacher's prison sentence reduced to 12 years upon appeal
PETALING JAYA: The Shah Alam High Court has reduced former celebrity preacher Azman Syah Alias's jail term from 24 to 12 years after ruling that his sentences should be served concurrently rather than consecutively, Kosmo reports. High Court Judge Shamsulbahri Ibrahim delivered this decision after considering written and oral arguments from both defense and prosecution teams. The court maintained the punishment of two strokes of the rotan. 'Since the two counts of physical sexual assault involved identical witnesses and are components of the same case, I find it appropriate for the sentences to run concurrently,' Shamsulbahri was quoted as saying. Defense counsel Fahmi Adilah argued that both charges originated from the same case with the same victim and witnesses. He claimed the sessions court had failed to consider Section 102 of the Subordinate Courts Act, which places a 20-year cap on total sentencing. Fahmi contended that High Court intervention was warranted as the trial proceeded without delays under a single case number. Meanwhile, deputy public prosecutor Tengku Najiha Zahari countered that the sessions court's original ruling was reasonable and not excessive. She maintained there was no continuity of action in the case, and although the trial consolidated witnesses, this didn't justify concurrent sentencing. She urged the court to prioritize public interest, noting that Azman's position as a religious figure and the victim's young age called for strict punishment. Previously, the sessions court had sentenced 44-year-old Azman to 12 years imprisonment and one stroke of the rotan for each offense, with prison terms to be served consecutively. Azman popularly known as PU Azman faced charges of sexually assaulting a 17-year-old boy at a homestay in Kampung Sungai Udang, Klang on February 20 and June 29, 2022. The charges were brought under Section 14(a) of the Sexual Offences Against Children Act 2017, which provides for imprisonment up to 20 years and caning upon conviction.
