Ex-celebrity preacher's jail term cut to 12 years on appeal

PETALING JAYA: The Shah Alam High Court has reduced former celebrity preacher Azman Syah Alias's jail term from 24 to 12 years after ruling that his sentences should be served concurrently rather than consecutively, Kosmo reports.
High Court Judge Shamsulbahri Ibrahim delivered this decision after considering written and oral arguments from both defense and prosecution teams. The court maintained the punishment of two strokes of the rotan.
'Since the two counts of physical sexual assault involved identical witnesses and are components of the same case, I find it appropriate for the sentences to run concurrently,' Shamsulbahri was quoted as saying.

Defense counsel Fahmi Adilah argued that both charges originated from the same case with the same victim and witnesses.
He claimed the sessions court had failed to consider Section 102 of the Subordinate Courts Act, which places a 20-year cap on total sentencing.
Fahmi contended that High Court intervention was warranted as the trial proceeded without delays under a single case number.
Meanwhile, deputy public prosecutor Tengku Najiha Zahari countered that the sessions court's original ruling was reasonable and not excessive.
She maintained there was no continuity of action in the case, and although the trial consolidated witnesses, this didn't justify concurrent sentencing.
She urged the court to prioritize public interest, noting that Azman's position as a religious figure and the victim's young age called for strict punishment.

Previously, the sessions court had sentenced 44-year-old Azman to 12 years imprisonment and one stroke of the rotan for each offense, with prison terms to be served consecutively.
Azman popularly known as PU Azman faced charges of sexually assaulting a 17-year-old boy at a homestay in Kampung Sungai Udang, Klang on February 20 and June 29, 2022.
The charges were brought under Section 14(a) of the Sexual Offences Against Children Act 2017, which provides for imprisonment up to 20 years and caning upon conviction.

Magistrate Romario Jonoi convicted Wilson Peter, 28, on his own guilty plea to a charge under Section 324 of the Penal Code, which carries a prison term of up to 10 years, or a fine, or whipping, or any two of the punishments. The offence was committed in a hotel room at Jalan Mission here at around 8.30pm on May 29 this year. According to the facts of the case, the complainant – an Indian national – was in the hotel room when an unknown man, later identified as the accused, entered and attacked him with a liquor bottle. The attacker struck the left side and back of the victim's head, and also took several documents and items belonging to the victim. Acting on a report filed by the victim, police arrested Wilson at about 11.50pm the same day along Jalan Tan Sri. Investigations revealed that prior to the incident, Wilson was involved in an argument with the complainant, and had attacked and injured the victim with the glass bottle out of anger. KUALA LUMPUR: A tailor claimed trial at the Ampang Sessions Court today to a charge of using criminal force to outrage the modesty of a disabled teenage girl last month. Muhammad Arif Zulfakar Abdul Razak, 25, entered his plea before judge Nurulizwan Ahmad Zubir after the charge was read out to him. He is accused of committing the offence against the victim,17, at 6.30pm in a toilet at a building in Taman Keramat early last month. The charge, framed under Section 354 of the Penal Code, carries a maximum penalty of 10 years' imprisonment, a fine, whipping, or any two punishments, upon conviction. Deputy public prosecutor Norhidayah Abdullah Sani proposed bail at RM6,000 and requested an additional condition prohibiting the accused from approaching the victim or any prosecution witnesses. In mitigation, lawyer Lingswaran Singh appealed for a lower bail amount, citing that the accused is the sole breadwinner for his family. The court set bail at RM4,000 and allowed the prosecution's request for the additional condition. The case was fixed for mention on July 21.
