Luthuli reopened inquest adjourned after witness breaks down
An inquest into the mysterious death of the late ANC president-general chief Albert Luthuli had to be adjourned in the Pietermaritzburg high court on Tuesday after a witness who was giving his testimony became emotional.
Mohomed Manjoo, who was a clerk at Stanger hospital where Luthuli was admitted after he was found injured on a railway line, broke down when he gave his testimony.
Manjoo became emotional when describing a situation at the hospital after Luthuli's admission. He said one or two nurses cried when they saw Luthuli being stretchered into a ward.
Shortly after describing the nurses' situation at the hospital at a time, Manjoo broke down. Judge Nompumelelo Radebe ordered the adjournment and asked the court to provide him with water. Manjoo is expected to resume his evidence on Wednesday.
In his earlier evidence, Manjoo told the court he didn't see any injuries on Luthuli when he was admitted at the hospital.
'Mr Zwane, the ambulance driver who was pushing his stretcher, came past by my desk in the reception; they were about 1m away from me. I stood up and saw that it was the chief who was being stretchered and I also noticed that he had no visible injuries in his body,' said Manjoo.
He disputed a claim by Zwane that Luthuli was hit by a train.
'The condition of Luthuli when he was admitted at the hospital didn't suggest that he was hit by a train; if he was hit by a train he was going to be in a critical situation,' he said. Manjoo said Luthuli was not conscious when admitted to the hospital.
'He was able to look around him but unable to talk,' he said, adding that he also did not notice any visible injuries on him. He added that there was also no blood on his stretcher.
Manjoo said after he realised that it was Luthuli who was injured, he phoned some ANC comrades in Stanger and an editor of a KZN-based Sunday newspaper, informing them about the matter.
Another witness who took the stand on Tuesday was Nozizwe Mhlongo-Mabaso. Mhlongo-Mabaso regarded Luthuli as her grandfather, because her father was a manager at his spice shop.
Mhlongo-Mabaso said she was 10 when Luthuli died. She told the court that her father was one of the people who cleaned Luthuli's blood where he was found injured. She said that people who went to the scene also found a plank — the type often used in building — near his body.
Mhlongo-Mabaso also reiterated evidence by earlier witnesses that Luthuli was not partially blind and deaf.
'Mkhulu Luthuli was able to read a bible without any problems, [so] it was unlikely he would not have seen or heard a steam train coming towards him,' she said.
The apartheid government claimed that Luthuli was hit by a goods train in 1967, a claim his family is disputing.
The inquest continues.

Image: Ayanda Ndamane / Independent Newspapers Outgoing National Director of Public Prosecutions (NDPP) Shamila Batohi is facing mounting pressure to provide details of her claims that there is political interference in the work of the National Prosecuting Authority (NPA). In an interview this week, Batohi had said: 'The NPA has been infiltrated by people who do not have the rule of law at heart. 'We are having internal challenges; some prosecutors may not be aligned with the vision of really fighting for the rule of law in this country.' Calls for Batohi to be summoned to Parliament to provide explanations follow a difficult period for the NPA during which the authority has bungled a number of high-profile cases. The latest was the Free State High Court declaring the extradition of former Free State premier and ex-ANC secretary-general Ace Magashule's personal assistant, Moroadi Cholota, from the US unlawful as it did not have a valid and lawful request by the Justice Ministry. As a result of Judge Phillip Loubser's ruling, Cholota cannot face trial in the controversial R255 million tender to audit and replace asbestos roofs in the province alongside her former boss and several other individuals and companies. The NPA plans to appeal against the judgment. Another recent prominent case that intensified pressure on Batohi, who is reportedly due to retire when she turns 65 in January, was the acquittal of Nigerian televangelist Timothy Omotoso of multiple charges of rape, human trafficking, and racketeering in April. On Friday, the EFF wrote to National Assembly Speaker Thoko Didiza and Xola Nqola, chairperson of the Portfolio Committee on Justice and Constitutional Development, demanding an urgent parliamentary debate on Batohi's allegations of infiltration in the NPA. Additionally, the EFF wants the portfolio committee to schedule an urgent meeting and was not calling for punitive or reactionary action. 'This is not a casual institutional complaint. It is a constitutional red flag of the highest order. An assertion from the NDPP herself that the NPA has been infiltrated should send shockwaves throughout every organ of state,' the party said. The EFF warned that the assertions have direct consequences for the rule of law, the integrity of South Africa's criminal justice system, the fight against corruption and gender-based violence, and public trust in the country's democracy. The urgent meeting should be held on Tuesday, June 10, and also requested Justice and Constitutional Development Minister Mmamoloko Kubayi to be invited to attend, provide policy-level responses and inform the committee of the department's position and possible interventions on the matter, according to the EFF. It requested Didiza to exercise her authority under the National Assembly's rules to approve an urgent debate on 'the implications of the NDPP's public statement regarding infiltration of the NPA and the threat it poses to South Africa's justice system, rule of law, and constitutional democracy'. ActionSA parliamentary leader Athol Trollip said the party was alarmed and called on President Cyril Ramaphosa to remove Batohi immediately. He said the NPA has failed to prosecute Ramaphosa for not declaring foreign currency stolen at his Phala Phala farm in 2020, which was later stolen, fugitive self-proclaimed Malawian prophet Shepherd Bushiri, and secure the extradition of the fugitive Gupta brothers, among others. 'The NPA has become a refuge for politically connected individuals, a place where accountability is avoided, justice is delayed, and prosecutions collapse with shocking regularity. Under Batohi's leadership, the NPA reels from one scandal to the next,' added Trollip. Ramokgopa was speaking on Thursday at a packed memorial service for ANC veteran and revered liberation figure, Reverend Dr Tshenuwani Simon Farisani, held at the George Phagadi Town Hall in Thohoyandou. The late struggle stalwart and former Lutheran bishop passed away on May 29. His funeral will take place on Saturday at the University of Venda Stadium. In her tribute, Ramokgopa honoured Farisani's lifelong commitment to justice, recalling his outspoken defence of VBS victims who lost life savings and community investments when the bank collapsed under a staggering R2 billion looting scandal. 'Government, under President Cyril Ramaphosa, has been for the people. We always said those who stole from VBS must be punished and languish in jail,' Ramokgopa said, adding that the Finance Department and the Reserve Bank should assist the suffering community to revive their only hope, VBS. More than 53 people have been charged for theft, corruption, fraud, money laundering, contraventions of the Prevention of Organised Crime Act, and racketeering for stealing and looting more than R2 billion of VBS Mutual Bank money since 2018. Ramokgopa was speaking during a well-attended memorial service of the late ANC veteran, Reverend Dr Tshenuwani Simon Farisani, at the George Phagadi Town Hall in Thohoyandou, Limpopo, this week. Farisani passed away on Thursday, 29 May 2025, and his funeral will be held at the University of Venda Stadium, outside Thohoyandou, on Saturday. The former prominent Lutheran Church Bishop and known political struggle hero was honoured for his resilience in the fight for freedom and equality against the apartheid regime. The service was attended by South African Communist Party deputy national chairperson Thulas Nxesi, Limpopo first female premier Dr Phophi Ramathuba, Limpopo ANC secretary Vhamusanda Reuben Madazhe, Speaker of the Limpopo Legislature Dr Makoma Makhurupetsa, Mopani district municipality Mayor Pule Frelimo Shayi and leaders from various religious and political structures in the province and beyond. Speaking to the mourners at the service, Ramokgopa said Farisani had fought for VBS victims. 'Government, under the tutelage of President Cyril Ramaphosa, has been on the side of the victims. We always said those who stole from VBS must be punished and languish in jail. 'The Reserve Bank and the Department of Finance, under the tutelage of Minister Enoch Godongwana, must assist the grieving communities to rebuild the collapsed VBS Mutual Bank,' she said. 'We have many times successfully rebuilt our country, including the health system in Gauteng during the predicaments of Life Esidimeni. We have also successfully rebuilt the Limpopo provincial government after it collapsed through fraudulent activities after some in the era of mismanaged government funds. 'There is nothing that can stand in our way to rebuild the VBS Mutual Bank and begin on a clean sheet,' she said to thunderous applause. 'When I came here, I drove a sizeable number of potholes, and the feeling was unbearable. 'They attract investment that often blossoms our economy. I therefore implore you, Honourable Premier Ramathuba and your mayors, to fix all your roads and patch potholes so that investors can invest in your municipalities. 'Through this, we can win the fight against the triple challenges of inequality, unemployment and poverty,' she said. Veteran journalist Mathatha Tsedu was invited to the stage to give testimony on the life well spent by Farisani and how his political acumen bolstered his journalism prowess. However, Tsedu used the platform to voice criticism of the irregularities surrounding the ANC Vhembe regional elective conference in May. 'This is the ANC of Farisani. He would be disappointed by how you skipped vital items in the programme, only to jump into nominations and elections of the top five officials. 'How do you jump the secretariat report and other vital items on the programme as if the main objective of the conference was to elect leaders,' he asked. The conference saw Tshitereke Matibe living up to his name — 'Tshitereke,' a Venda name meaning 'protest' — as he staged a bold demonstration at the venue, ultimately securing a fourth term. Tsedu's criticism was challenged by an ANC regional executive committee (REC) member. 'Tsedu does not understand the politics of the ANC. This is not journalism, he must just leave politics to politicians, and journalism to the newsroom. You can just read from his address that he is far from within,' said the senior member, speaking to The Citizen on condition of anonymity. The leader, who asked for his name to be withheld for fear of reprisal, said that despite the woo-ha, Matibe won the conference hands down.
