'Key state witness in Joshlin Smith trial is an opportunist', says defence

Raquel 'Kelly' Smith's defence attorney on Wednesday accused the state's key witness in her kidnapping and human trafficking trial of being an opportunist who 'only looked out for her own interest'.
Attorney Rinesh Sivnarain told the Western Cape High Court sitting in Saldanha Bay Lourentia 'Renz' Lombaard — once good friends with his client — had used Smith to her advantage.
Lombaard, a former co-accused in the case, became a section 204 witness — a person implicated in a crime but allowed to testify truthfully against other accused in exchange for indemnity from prosecution.
Smith, her boyfriend Jacquin 'Boeta' Appollis and Steveno van Rhyn are accused of being behind the disappearance of six-year-old Joshlin Smith on February 19 2024. They pleaded not guilty.
The court previously heard that of the three accused and Lombaard, Smith was the only one who worked to provide for her family and feed her and Appollis' drug addiction.
Sivnarain said during Lombaard's cross-examination it emerged she often sustained her children by asking Smith for food.
Lombaard, he argued, was an opportunist and only decided to tell the truth seven months after being arrested because she was expecting to be given money by Smith which she had agreed to.
'When Lombaard made these confessions she expected to receive some benefit and therefore only looked out for her own interest,' said Sivnarian.
Lombaard had 'thrown Smith under the bus' to save herself and had many opportunities to come clean about the truth but continued to lie 'even when given her last opportunity'.
Prosecutor Zelda Swanepoel said during her closing arguments on Tuesday that despite discrepancies in Lombaard's evidence, she was a credible witness.
'The most reliable and most important corroboration for Lombaard's testimony is that of [another witness Nico] Coetzee.'
Swanepoel said Coetzee specifically referred to R20,000. Lombaard testified overhearing Smith tell Appollis, ' Hier is die geld wat ek by die sangoma gekry het [here is the money I got from the sangoma]'. Smith answered R20,000 when he asked how much.
The court heard the same amount was mentioned in Appollis' and Van Rhyn's statements.
However, Sivnarain argued that when Coetzee told his employers Tertia and Johan Kruger about the plan Smith had relayed to him, he only mentioned the plan, nothing about Joshlin being taken away.

Image: Thuli Dlamini / eThekwini Municipality Pressure is mounting on eThekwini Municipality mayor Cyril Xaba to act against the City Manager Musa Mbhele following the Constitutional Court's dismissal of the City's appeal to overturn a lower order, which ruled that it must pay a service provider R30 million for the work the company had done. On Wednesday, the Constitutional Court dismissed the City's leave to appeal the Supreme Court of Appeal's decision after that court in February also upheld the earlier Durban High Court's ruling that the City must pay the service provider. The City is also expected to fork out more than R20 million in interest as the debt has accumulated interest since the high court ruling in 2022. The City also incurred legal fees as the appeal was dismissed with costs - now the case has drawn the attention of a former deputy city manager who was charged with misconduct after the city incurred legal costs in a separate matter. On Thursday, Sibusiso Makhanya instructed his law firm, Macgregor Erasmus Attorneys INC to write a letter of demand to the mayor to table the letter to the council within seven days. Makhanya, then the deputy city manager for trading services had been charged for misconduct for causing the City to incur R6 million in interest after it was taken to court by a service provider had not been paid R63.5 million. The City blamed Makhanya for failing to respond to emails from the Chief Financial Officer as there were allegations that the service provider had overcharged the City. The City argued that had Makhanya cooperated, the municipality would have avoided the R6 million in interest. Makhanya eventually left his job. Through his lawyers, Makhanya is now demanding that City management need to be consistent and hold Mbhele accountable for the cost the City will incur as a result of this week's Constitutional Court ruling. 'We brought to your attention then, as we do now, that one of the issues our client raised at his disciplinary hearing was the inconsistent application of the disciplinary code vis a vie himself and Mbhele. Mbhele was the person responsible for eThekwini having the default judgment granted against it and therefore incurring wasteful expenditure. "No further indulgences or communications will be forthcoming from our client and should you fail to act as you are obliged to, then we hold instructions to approach an appropriate forum for the necessary relief,' concludes the letter. Cooperative Governance and Traditional Affairs MEC Reverend Thulasizwe Buthelezi has joined calls for the mayor to act against officials responsible for the costs. In a statement the MEC called on the City to recover the money from officials that were responsible for the loss. In a short response, the City's spokesperson Gugu Sisilana said the municipality has accepted the court order, however, the mayor is yet to respond to the calls for action against for those responsible. JOHANNESBURG - The Vanderbijlpark Magistrates Court has heard that a sangoma who is charged with human trafficking and the premeditated murder of a two-year-old has two previous convictions. Kutlwano Shalaba had been missing since November last year, when his body was recovered from a shallow grave in Bekkersdal last Friday. The toddler was allegedly sold for R75,000 by his mother to Sebokoane Khoanyana, with the funds deposited into the mother's account on the day of his disappearance. Khoayana is appearing in court on Thursday, with his co-accused, Keneilwe Shalaba, the mother of the murdered child. ALSO READ: Police probe premeditated murder case after toddler (2) was killed and his mother arrested Khoanyana was arrested last week, and he revealed that Kutlwano was buried in Bekkersdal, south of Gauteng. The sangoma was linked to the disappearance of the child following police investigations after it was found that the mother was involved in the disappearance of her child last year. On Thursday, Khoanyana told the court that he intended to apply for bail, which will be heard on 25 June 2025. His lawyer, Gladmore Nyamanda, has also told the court that the 50-year-old has previous cases of assault and possession of dagga from the Free State. Khoanyana's attorney adds that the assault case is from 2019. "I'm sure it was withdrawn, but for the sake of the court, we had to tell the court what happened, but also the possession of dagga, we had to tell the court as well." Nyamanda says the sentence for possession of dagga was a suspension of six months.
