7 Manila cops arrested for robbery-extortion

Seven personnel of the Manila Police District (MPD) were arrested after taking a man into custody under "fabricated" drug charges, the National Capital Region Police Office (NCRPO) said on Tuesday.
In a statement, the NCRPO said the arrested police officers were assigned to Police Station 5's anti-drug unit, including one lieutenant, three staff sergeants, and three patrolmen.
'The arrests were carried out following the swift validation of reports and complaints that exposed the involvement of the said personnel in illegal activities while in the performance of their duties,' the NCRPO said.
'Appropriate charges are now being filed against the individuals involved, who are currently under restrictive custody,' it added.
Based on the initial investigation, a 49-year-old man reported that the police officers arrested him under fabricated drug charges on June 20.
'While in custody, the involved officers allegedly extorted P50,000 from the complainant's spouse in exchange for release. Although only P20,000 was eventually paid via mobile transfer, the complainant was freed without charges,' the NCRPO said.
According to the NCRPO, the cops allegedly returned the money to dissuade the complainant from pushing his legal action. Recovered from the arrested cops were seven mobile phones used in the alleged extortion, five official police IDs, screenshots of digital transactions and conversations, and remittance records of the extorted amount.
The NCRPO said the police officers allegedly committed robbery-extortion, grave threats, arbitrary detention, and violations of the Anti-Graft and Corrupt Practices Act as well as obstruction of justice.
'Under the Chief PNP's core leadership pillar on police accountability, there will be no second chances for police scalawags,' NCRPO chief Police Major General Anthony Aberin said.
'NCRPO will not allow these criminals to taint the integrity and dedication of those who are doing good in the service. Rogue policemen will be arrested, detained, charged and remove from the service, based on due process of law,' he added. —VAL, GMA Integrated News

The Sandiganbayan has found former Palawan governor Mario Joel Reyes and his provincial planning and development coordinator Samuel Madamba II guilty of 11 counts of graft in connection with misuse of some P1.53 billion in royalties from the Malampaya gas field in 2009. In a 625-page decision, the anti-graft court sentenced Reyes and Madamba to six to 10 years in prison per graft conviction or a total of at least 66 years of jail time. The P1.53 billion worth of Malampaya gas field royalties were allegedly spent on school buildings, the San Vicente Airport Development Project, road projects, solar home system, and a day care center. "There is manifest partiality when accused Reyes, as HoPE (Head of Procuring Entity), improperly evaluated the bid proposals, leading to the award of numerous or overlapping contracts to a single contractor with one set of key personnel," the anti-graft court said. "Accused Reyes approved contracts that awarded multiple projects to a single contractor while being fully aware that these projects required the contractor's presence at specific times that conflicted with other projects. This act indicates a clear, notorious, or plain inclination or predilection to favor one side or one person rather than another, which the Anti-Graft Law categorizes and punishes as manifest partiality," it added. Based on documentary evidence presented before them, including the contracts awarded to the same contractor for overlapping projects and the Commission on Audit report, the Sandiganbayan ruled that there was "a clear violation of contractual obligations." "For one, it is logically impossible for the same key personnel to be involved in all these projects at once, given their different locations which are far apart from each other. Although the towns and areas belong to only one province (Palawan), the Court takes judicial notice that these towns are not really geographically located in one single island," it said. "Additionally, the contractors failed to update or submit revised lists of key personnel for the overlapping projects," the anti-graft court said. The Sandiganbayan also said that Reyes and Madamba, who was then BAC secretary, failed to publicly post the bidding for the subject government contracts due to "neglect and utter lack of effort." While Reyes posted bail in these cases, the court said the ex-Palawan governor failed to appear or present any evidence to dispute the evidence presented by the prosecution. "His (Reyes) failure to be present and adduce evidence could indeed be considered as a waiver of his constitutional right to defend himself and confront the witnesses against him," the Sandiganbayan said. Madamba, for his part, defended himself by arguing that he only failed to properly register the invitation to bid on the Philippine Government Electronic Procurement System (PhilGEPS) because of a former contractual employee's failure to provide a password and to the poor internet connection in Palawan before 2010. The Sandiganbayan, however, says this defense rings hollow absent evidence. "Not a shred of evidence was offered to prove these allegations. Thus, the basic rule applies that, a mere allegation is not evidence and is not equivalent to proof," it said. "Besides, there were available alternative options provided by the Government Procurement Policy Board to ensure mandatory posting, such as contacting the PhilGEPS division for assistance, fax the documents for posting, or utilizing internet cafes. This noncompliance with these posting requirements led to limited participation in the bidding process, as evidenced by the COA Audit Report which showed only one bidder for 65 projects and two bidders for 139 projects," it added. —AOL, GMA Integrated News

Road rage suspect claiming to be NBI personnel nabbed

The National Bureau of Investigation-Technical Intelligence Division (NBI-TID) has arrested a suspect in a road rage incident who pretended to be part of the NBI. In a statement on Monday, the NBI said a motorcycle driver complained to Senator Raffy Tulfo's television program about the driver of an SUV that rammed him. The complainant said that the suspect claimed that he is an NBI member, displayed a badge, and even threatened him. Upon verification of NBI records, it was found out that the suspect is not connected to NBI either as an employee, job order worker, or consultant. The suspect also has a standing warrant of arrest for syndicated estafa with no bail recommended. The suspect was arrested in an operation on July 24. Seized from him were several identification cards, a fake NBI ID, and an NBI wallet badge. The suspect was brought to the NBI detention facility in the Bureau of Corrections in Muntinlupa in line with his warrant. Torre: PNP 'hopes for best, prepares for worst' ahead of SONA 2025

Philippine National Police chief General Nicolas Torre III said they are 'hoping for the best and preparing for the worst' as security preparations continue ahead of the State of the Nation Address (SONA) on Monday. Torre made the statement after his charity boxing event in Manila where he was declared as winner by default, shortly before he headed to check on critical points of deployment to ensure the security for President Ferdinand "Bongbong" Marcos, Jr.'s fourth SONA at the Batasang Pambasa in Quezon City. "After this, actually pupunta kami ng Baseco and then after we release the relief goods that we have, pupunta na kami sa areas kung saan ang critical points ng ating deployment sa SONA," Torre said. The National Capital Region Police Office (NCRPO) said more than 20,000 police personnel have been deployed as part of security measures for the annual event. When asked if the number of deployed cops for the SONA is overkill, Torre responded it is just part of their preparations. The NCRPO said nearly 23,000 police personnel will secure this year's SONA. "We always respect the opinion of other people. Naniniguro lang tayo, we always hope for the best but we are prepared for the worst," said Torre. (We are just making sure.) In a Super Radyo dzBB interview, NCRPO spokesperson Police Major Hazel Asilo also said they have been closely coordinating with the intelligence community as part of their SONA preparations.
