Authorities investigating overcapacity after $4 million Lamborghini yacht partially sinks off Miami Beach
A luxury yacht that partially sank near Star Island over the weekend had twice the number of people on board than it was built to hold, according to officials, prompting an investigation that could result in civil or criminal penalties for the vessel's owner.
Overcapacity raises safety and legal concerns
The Florida Fish and Wildlife Conservation Commission (FWC) confirmed the vessel is a Tecnomar Lamborghini 63 - a 65-foot yacht reportedly worth $4 million.
According to the Lamborghini Miami dealership website, the boat's maximum capacity is 16 people. However, authorities said 32 people were rescued when the yacht began to sink on Saturday.
"There are certainly safety guidelines in place regarding the amount of people you can safely have on your vessel," said Petty Officer Nicholas Strasburg of the U.S. Coast Guard.
Strasburg said the boat did have enough life vests for everyone on board, but the excess number of passengers may have contributed to the incident.
Coast Guard: Owner could face penalties
FWC is the lead agency investigating the cause of the sinking. The Coast Guard said the investigation will determine whether the vessel was operated safely and in compliance with maritime regulations.
"If there is a deficiency in the safety and operation of the vessel, there is the certainty a potential of civil or even criminal penalties," Strasburg said.
CBS News Miami approached two men working on the yacht in a shipyard, but they said the owner was not available. They added that the owner may have more information at a later time.
Strasburg said the partially sunken vessel posed a hazard to navigation and needed to be removed from the channel.
"The vessel partially sank. We were able to get air floatation devices around it and tow it out of the channel so it could be removed," he said.
Good Samaritans helped rescue passengers
The Coast Guard credited good Samaritans for helping in the rescue effort. Captain Yasmany Linares said he was on the water at the time and helped take 23 people back to shore on his own boat.
"If that boat flip, all these people can be trapped under the boat and that's a different story," Linares said.
FWC said it is preparing a preliminary report on the incident, which is expected to be released soon.

Coast Guard to cover Ashtabula County on weekends
An agreement reached last summer, after substantial boating issues on Lake Erie off the coast of Ashtabula County, has been extended, said Ashtabula City Manager Jim Timonere and Lt. Phillip Gurtler, a spokesperson with the U.S. Coast Guard Ninth District. Timonere said it was his understanding the Coast Guard planned to continue weekend staffing of the station during the summer months. Early in the 2024 boating season, there were a series of major incidents that local officials brought to the attention of the Coast Guard. The Ashtabula Station had been reduced from being staffed seasonally to relying on coverage from Fairport Harbor and Erie before the start of the 2024 boating season. By mid-summer of that year, the station was staffed on the weekends after a fatality and major rescue operations on a windy July day. 'The Coast Guard will continue to utilize Forward Operating Location Ashtabula to support Coast Guard operations in the area in the same way it did during last summer's boating season,' Gurtler said. 'Ashtabula was identified during our extensive analysis as an area with multiple overlapping coverages consisting of Coast Guard units and our local, state, and federal partners for Search and Rescue,' he said. 'The transition from a seasonal station to an FOL allowed us to better consolidate Coast Guard personnel and assets to provide a more resilient coverage, even if the Coast Guard has a slightly less visual presence in a particular area. FOL Ashtabula will be manned as required by operations.' Last year, local and state officials asked the Coast Guard to increase their presence, including a campaign stop in Ashtabula by then-Senator Sherrod Brown. Gurtler said any mariner or boater in distress should use VHF Channel 16 or call the Sector Command Center at 888-230-4703. The Ohio Department of Natural Resources also operates a vessel out of the Geneva State Park Marina and the Ashtabula County Water Rescue team also responds to search and rescue missions. The city of Ashtabula also has a boat that can be utilized.

Wesley Chapel family says dog survived alligator attack in their backyard
TAMPA, Fla. (WFLA) — A family in Wesley Chapel is traumatized after their rescue dog was attacked by an alligator in their backyard. A video shows Zeus, a German Shepherd, standing on a leash with a gator lurking just beyond the fence, a chilling moment the family now views as a warning. 'We have a doggy door, and Zeus will go in and out of it whenever he wants,' said Susan Alkhatib. Alkhatib and her family ran outside with flashlights and caught a glimpse of Zeus struggling in the pond with the gator still latched onto him. 'The alligator had just let go of Zeus,' Alkhatib said. 'We started yelling at him to come toward us. When he got closer, he got tired. So we had to kind of go into the pond a little bit to get him.' While News Channel 8 was interviewing the family, a gator emerged from the water again before slipping back in. 'I have a 7-year-old sister,' said one family member. 'And I just think, if she was at the fence, would he have done the same thing to her?' Zeus miraculously survived the attack. He suffered a fractured and displaced jaw, along with multiple puncture wounds around his neck. 'The vet said it looked like his whole head was in the gator's mouth,' said Alkhatib. 'Even he said, 'I don't know how he survived.'' 'I honestly can't believe he is alive,' Alkhatib said. The Florida Fish and Wildlife Conservation Commission has sent out trappers, but so far, they have not been able to capture the gator. Zeus is now recovering from several surgeries. 'Empire Challenge' hits the water in Youngstown
The New York Naval Militia and New York Guard members conducted emergency response exercises Thursday on the lower Niagara River and Lake Ontario, alongside the Coast Guard and local, state, and federal law enforcement agencies. On Thursday, four New York State Police divers jumped from a State Police helicopter into the lower Niagara River just off of Fort Niagara. The exercise was an alternative method of deploying divers into the water for the purpose of recovering people or evidence from the water. The two days of exercises, named 'Empire Challenge' were centered on Coast Guard Station Niagara and Fort Niagara State Park. The New York Naval Militia was also planning to conduct drone operations during the training. Unmanned aerial systems, or drones, will be launched on reconnaissance missions. 'Exercise Empire Challenge, is primarily an emergency communications event,' said Capt. Don McKnight, the commander of the Naval Militia's Military Emergency Boat Service. earlier this week. 'The exercise allows us to test new capabilities and functions alongside our many law enforcement and first responder partners,' he added. The New York Naval Militia is a 3,200- member force of Navy, Marine Corps and Coast Guard reservists who also volunteer to serve in the state force. The Naval Milita operates a fleet of 11 patrol boats in the Military Emergency Boat Service.
