Delhi HC restrains infringement of Volvo trademark

The Delhi High Court has restrained the infringement of the trademark of Swedish vehicle manufacturer,
Volvo
. In an order dated May 30, Justice Amit Bansal further restrained two transporters from the unauthorised use of the mark for their bus services. The Swedish vehicle maker filed a plea seeking a permanent injunction against the defendants from infringing its
Volvo trademark
.
The defendants, the plea alleged, were Udaipur-based
Ganesh Motor Body
Repairs, a manufacturer and fabricator that made buses nearly identical or deceptively similar to the original Volvo buses,
Rishabh Bus Private Limited
in Delhi, which purchased buses from the maker and lured customers for its inter-city bus services by advertising its fleet of buses as Volvo buses.
Volvo said another transporter, the Bahraich-based Shanti Travels, used a motif on its grille that was nearly identical to its grille. Arguing its case, the Swedish company said its "
iconic grille slash trademark
" was of particular significance as its placement on the grille of any bus or other automobile signified that the automobile was originally a Volvo.
"The defendants, by manufacturing, using, displaying, and advertising lookalikes of the plaintiffs' well-known products, are attempting to create an unauthorised association with the plaintiffs (Volvo group), and target customers and deceive them to believe that the plaintiffs have launched an affordable new range of products," the plea said.
The court held that the defendants had dishonestly copied and created fake, replica or counterfeit products of the plaintiffs' famous products bearing the Volvo trademarks. "The defendants' attempt to use the suit trademarks is nothing but a mala fide attempt to encash on the plaintiffs' rights and amount to infringement and passing off of the suit trademarks, with a sole intention of riding piggyback on the plaintiffs' immense reputation and goodwill to achieve immense publicity, marketing and business gains," the court said.
The order found a prima facie case in their favour of the Swedish maker for an ad-interim injunction. "If the actions of the defendants remain unrestrained, then the practice of using the infringing grille slash trademarks on any bus will become rampant and the exclusivity associated with the plaintiffs' buses will vanish over time," it added. The court, as a result, restrained the defendants and their agents from infringing the Volvo mark in any manner by physically using it on buses or using it for travel services till October 9, the next date of hearing.

Mumbai-based construction materials provider Arisinfra Solutions' initial public offering (IPO) received a moderate response on the second day of the public subscription. The public issue was booked 1.32 times as of the second day of the bidding rounds on Thursday, 19 June 2025. Arisinfra Solutions IPO through a book-built issue is offering an entirely fresh issue of 2,25,04,324 or over 2.25 crore equity shares as the company aims to raise nearly ₹ 499.60 crore from the stock markets. Out of the three investor segments, the retail investor portion was subscribed the most. Investors oversubscribed three times with a total of 71,30,140 or 71.30 lakh bids, compared to the 23,79,028 or 23.79 shares on offer. The Non-Institutional Investors (NIIs) came in second with 1.39 times subscription as investors booked a total of 49,46,878 or 49.46 lakh equity shares, compared to the 35,68,542 or 35.68 lakh shares on offer. The Qualified Institutional Buyers (QIBs) segment received the least subscription out of the three segments as of the end of the second day. The QIB portion was booked 73 per cent of the total offer, as investors bid for 52,26,067 or 52.26 lakh shares, compared to the 71,37,086 or 71.37 lakh shares on offer. As of 19 June 2025, the grey market premium (GMP) of Arisinfra Solutions IPO stood at ₹ 22 per share as of the end of the second day of bidding. The company seeks to use the money raised from the IPO to repay or prepay loans, support its working capital requirements, and invest in a subsidiary. It also disclosed plans for a potential unidentified acquisition, while the remaining funds will be used for general corporate needs. The company raised ₹ 224.8 crore from its anchor investors ahead of the IPO. JM Financial Limited, IIFL Capital Services Limited, and Nuvama Wealth Management Limited are the book-runners for the public issue, while MUFG Intime India Private Limited (Link Intime) is the registrar to the offer. Satcom providers junk Indian telcos' demand for level-playing field

NEW DELHI: Satellite communications ( satcom ) players have junked the telecom industry 's call of seeking a level-playing field between mobile and space broadband services. Broadband India Forum (BIF), which represent technology and satcom companies such as Google, Meta, OneWeb, Tata's Nelco, Hughes, among others, has staunchly opposed telecom carriers' opinion that the Telecom Regulatory Authority of India (TRAI) has kept satellite spectrum pricing low and non-transparent, compared to prices of spectrum for terrestrial services . The issues of 'level playing field' and 'same service same rule' are based on certain basic legal principles of equality enshrined in Article 14 of the Indian Constitution. According to the Delhi-based association, the core doctrinal requirement under the said Article is that entities must be similarly situated for similar treatment. 'In other words, unequals (satcom and terrestrial services) cannot be treated equally. We submit that two differently placed services which are intrinsically based on different technologies, different regulations and laws, having different intended use, different rights and obligations, cannot be deemed as similar or substitutable or competing services,' TV Ramachandran, director-general of BIF, said in a letter to Neeraj Mittal, secretary, Department of Telecommunications (DoT). ETTelecom has reviewed a copy of the letter dated June 18, 2025. TRAI had recommended the administrative allocation of satcom spectrum for a fee pegged at 4% of adjusted gross revenue (AGR) to be assigned for five years. There won't be any upfront fee for getting spectrum. TRAI Chairman AK Lahoti had categorically rejected the level-playing field argument by telcos, stating that the two technologies were different and that satellites could only be complementary. In turn, BIF termed the Cellular Operators Association of India 's ( COAI ) claims as 'detached from reality', adding that the latter's members have formed commercial partnerships with global satellite service providers, including billionaire Elon Musk's Starlink, and AST SpaceMobile, which demonstrates complementarity between terrestrial and satellite services. In terms of economic scale, BIF said terrestrial telcos in India generate over ₹3.36 lakh crore annually, while the combined satcom market barely touches ₹540-600 crore, or just 0.2% of telco revenue, which 'discredits' any claim of market overlap or substitutability. Ramachandran further said that the cost of the devices is of the order of ₹25,000 (satcom) versus ₹5,000 (terrestrial), with the scale being of the order of 1:5. Likewise, he noted that the number of satellite terminals manufactured in 2024 by the largest satellite service provider was approximately 3 million globally, whereas in India, almost 150 million mobile devices are sold. 'These numbers expose the fallacy of any claim of substitutability or competitive parity,' the executive said. BIF's statement comes close on the heels of telcos, in a recent joint letter through the Cellular Operators Association of India (COAI) to various government authorities, slamming the sector regulator's recommendations on satcom spectrum pricing , calling them unjustifiably low. Telcos had cautioned the government that if TRAI's recommendations were implemented in their current form, they would create a non-level playing field and impact the sustainability of terrestrial telecom services. 'By no stretch of imagination, satellite communication service providers and terrestrial communication providers are similar or equal. To put both categories at par is wholly unjustified, arbitrary, unconstitutional, being violative of Article unequal entities in this case, which are satcom services ought to be treated differently,' Ramachandran said. 'Due to multiple reasons, the satellite services would not even be an alternative (to terrestrial network). It's a minor complementary, and not even a major complementary service,' Minister of State for Communications Chandra Sekhar Pemmasani told ETTelecom in a recent interview, adding that "there is no need to worry" about it.

ED attaches ₹44-crore Delhi house of Bhasin Infotech accused of duping homebuyers

NEW DELHI: A residential property in Delhi worth more than Rs 44 crore has been attached under the anti-money laundering law as part of an investigation against a Noida-based realty company and its promoters accused of duping homebuyers, the Enforcement Directorate said Wednesday. The case pertains to Bhasin Infotech and Infrastructure Pvt Ltd (BIIPL) and its director Satinder Singh Bhasin . The money laundering case stems from multiple Uttar Pradesh Police ( Noida ) FIRs filed in 2015 against BIIPL, Grand Venice group entities, Bhasin, Quincy Bhasin and others on charges of cheating, fraud and criminal conspiracy. It was alleged in the police cases that the accused collected hundreds of crores of rupees from investors in real estate projects by promising timely delivery of commercial units, which were "never" completed or handed over, the ED said. The agency identified a "residential independent house" located at D-24 in the upmarket Rajouri Garden area in west Delhi. The asset is in the name of "main accused" Bhasin. The Lucknow zonal office of the ED issued a provisional order under the Prevention of Money Laundering Act (PMLA) to attach the said property. The market value of the said property, as assessed on 09.06.2015 (date of police FIR), is Rs 27.01 crore. The present value of the property is Rs 44.06 crore, the ED said. It was found, the ED alleged, that funds collected from the public were "diverted" and "dissipated" by the accused through a web of group companies and associate entities, instead of being used for the construction and development of promised projects. These companies were controlled by Bhasin, Harpreet Singh Chhabra, Ajay Dhawan and the proceeds of crime were "layered" and parked across multiple entities with no direct traceability, the agency said. Raids were conducted by the ED in this case in April at locations in Delhi, Noida and Goa and about Rs 36 lakh in cash was seized apart from documents and electronic records.
