
Separate AG, PP roles now to avoid loss of public confidence, govt told
PETALING JAYA : Lawyers want Putrajaya to act quickly to divest the attorney-general (AG) of his prosecutorial role, saying any further delay will only deepen public perception that the government lacks the political will to carry out promised reforms.
They said the desired change—one that is crucial for the Malaysian justice system— has been talked about for many years, but remains elusive.

Lawyer Salim Bashir said the current administration, led by Prime Minister Anwar Ibrahim, must 'walk its talk' following vigorous feasibility studies conducted both locally and abroad by a government task force over the past two years.
The public expects the government to expedite the process, he said.
'Enough consultations and studies have been made. The separation must be done urgently to bolster public confidence,' said Salim, a former Malaysian Bar president.
The lawyer was commenting after law and institutional reform minister Azalina Othman Said said last week that the government was still in the midst of studying the matter.
Azalina expressed hope that a decision can be reached before the next general election.
Last December, Anwar told the media that a draft Cabinet paper on the subject is expected to be ready by the middle of this year.
Acknowledging the complexity of the issue, Anwar said the paper may take time to complete as it involves numerous amendments to the law, including the Federal Constitution.
Pakatan Harapan had, in its election manifesto in 2018, pledged to put the change into effect, a promise it repeated at the 15th general election four years later.
Barisan Nasional followed suit, saying in 2022 that it was necessary to eliminate any conflict of interest and reduce excessive power placed in the hands of the AG.

Both PH and BN are now part of the unity government.
Once separated, all prosecutorial powers will be vested in the public prosecutor, while the AG will act as the government's legal advisor.

Hanif proposed that a royal committee, under the auspices of the Conference of Rulers, be formed to study the separation of roles.
Lawyer Rafique Rashid Ali said there will be occasions when the AG may not be in the best position to deal with a criminal matter himself.
'He may find himself in a position of conflict of interest from time to time, when the interest of his client—the government—may not fully coincide with public interest,' he said.
Rafique said experience has shown that such situations tend to arise when politicians are prosecuted for criminal offences.

He said that, since 2018, politicians aligned to the government of the day had their charges withdrawn while their trials were ongoing.
In certain other cases, the prosecution's appeals against acquittals were struck out on flimsy grounds such as the petition of appeal being filed out of time, he added.
'Most of these corruption charges involve millions of ringgit, and the optics are that a pliant AG is appointed to execute the agenda of those in power, ' said Rafique, adding that precious judicial and prosecutorial time and resources are wasted in the process.

Prime Minister Datuk Seri Anwar Ibrahim, when tabling the 13th Malaysia Plan (RMK13) with the theme 'Redesigning' at the Dewan Rakyat, said that the TVET programme would also be expanded to tahfiz students to produce Madani huffaz technocrats with added value in technical expertise. The government, he said, will also expand the TVET curriculum to include the field of ageing with special incentives for students undergoing industrial training. 'TVET programmes are gaining popularity. In 2024 alone, 212,000 new admissions into TVET programmes were recorded,' he said, adding that the Madani TVET programme will be strengthened to increase the mastery of skills that can generate higher income, including for tahfiz and huffaz students. 'At the same time, the level of TVET certification will be increased by introducing three new levels of expertise, six to eight, to be equivalent to the level of higher education qualifications under the Malaysian Qualifications Framework (MQF). This effort aims to recognise high skills in technical fields and expand career paths, in line with market needs,' said the prime minister. Anwar, who is also the Finance Minister, said TVET graduates are also enjoying increasingly competitive incomes, most of which exceeded the minimum wage of RM1,700. 'About 95.6 per cent of TVET graduates are able to secure employment within six months of completing their training,' he said. He said the close collaboration between TVET institutions and industry would serve as a catalyst for technological transfer and skills enhancement in line with initiatives by the Ministry of Higher Education. 'The structure of TVET programme offerings will be re-strategised with a focus on high-growth, high-value (HGHV) and advanced technology-based industries. 'This is in line with labour market demands and strategic industry needs such as in the Johor-Singapore Special Economic Zone (JS-SEZ), the Kerian Integrated Green Industrial Park (KIGIP) project and the Kulim Hi-Tech Park (KHTP),' he said. Pan Borneo projects, energy transition prioritised

Kuala Lumpur: The 13th Malaysia Plan (13MP) tabled by Prime Minister Datuk Seri Anwar Ibrahim in the Dewan Rakyat yesterday marks a major boost for Technical and Vocational Education and Training (TVET), the Bumiputera economic empowerment agenda and national disaster management, says Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi. He said the emphasis on aligning the minimum wage beyond existing prerequisites and the implementation of a premium wage scheme would add value to the education ecosystem and job marketability in the country. 'In addition, I am very grateful that the Bumiputera economic empowerment agenda, as outlined in PuTERA35 (Bumiputera Economic Transformation Plan 2035), has been incorporated into the 13MP, with 132 initiatives from the Bumiputera Economic Congress resolutions also included. 'Hopefully, this will benefit all levels of society in rural, suburban and urban areas, as well as our friends in Sabah and Sarawak,' he said. Ahmad Zahid, who also chairs the National Disaster Management Committee, welcomed the government's long-term planning to strengthen disaster management and mitigation measures, particularly for natural disasters such as floods. He said the tabling of the 13MP had come at a time when the nation was facing economic uncertainty and supply chain disruptions that were severely challenging competitiveness and public well-being. He added that the roadmap for 2026-2030 also focused on economic empowerment through value creation driven by digitalisation and advanced technologies such as artificial intelligence (AI), as well as an integrated approach towards sustainable and inclusive economic growth. Meanwhile, Deputy Prime Minister Datuk Seri Fadillah Yusof said the implementation of the 13MP must be carefully structured, taking into account a holistic approach that included all layers of society, development sectors, environmental sustainability, and a strong emphasis on good governance. He said this was vital to ensure Malaysia's competitiveness continued to be strengthened and that the country remained prominent on the global stage. 'If we look at what was presented earlier, there are nine main focus areas under the three pillars of the Madani Economy. The first is 'raising the ceiling,' which refers to transitioning towards an AI-based nation, high-growth, high-value industries, and strategic sectors that emphasise regional and rural development with global impact,' he said. 'The second pillar is strengthening governance and institutions by ensuring a public service that is transparent, swift and decisive. The third is 'raising the floor,' which focuses on addressing the cost of living, centring on Madani individuals as the social foundation, and improving the quality of life for the people,' he said. Fadillah, who is also the Minister of Energy Transition and Water Transformation (PETRA), said his ministry would focus on energy security, environmental sustainability and affordability of energy and water costs. He said the government had announced a new, more transparent and fair energy market approach, including the introduction of new tariffs and the 'time of use' concept to promote more prudent energy consumption. He added that the government would also conduct an in-depth study into the potential of nuclear technology as an energy source to complement existing sources such as solar, while continuing efforts to develop new sustainable energy sources. Fadillah said focus would also be given to Flood Mitigation Plan (RTB) projects in Johor, Perak, Pahang, Sarawak and Sabah to reduce flood risk and ensure water security. Is Malaysia harbouring Jakarta's wanted ‘gasoline godfather' Riza Chalid a.k.a. 'Indonesian version of Jho Low'?
THE opposition has seemingly demanded Prime Minister Datuk Seri Anwar Ibrahim to explain his actual connection with oil tycoon Muhammad Riza Chalid who is now a key suspect in the high-profile corruption case involving Indonesian state-owned oil and gas giant Pertamina. Following the recently-concluded 13th Annual Consultation between Malaysia and Indonesia, PAS activist Nurul Islam Mohamed Yusoff claimed that even the Indonesian Anti-Corruption Society (MAKI) coordinator Boyamin Saiman had urged President Probowo Subianto to seek PMX's consent to extradite Riza to Indonesia. 'According to Boyamin, Riza now resides in Malaysia and had a friendly relationship with PMX before he became PM,' the Central PAS Information Committee Research and Policy Department director penned on his Facebook page. 'It was reported on Oct 2, 2022 (prior to the 15th General Election) that PMX brought Riza to meet the Sultan of Kedah. In a ceramah, (now Home Minister) Datuk Seri Saifuddin Nasution Ismail conformed it was true that PMX brought Riza but only as a friend. 'I, for one, have never come across anyone deliberately bringing someone they only 'know in general' to meet the palace.' PMX acknowledges 'friendship' For the record, Indonesian news portal Tempo cited PMX as saying on Tuesday (July 29) that Putrajaya does not interfere in the legal affairs involving Riza. Speaking during a meeting with several editors-in-chief in Jakarta, PMX acknowledged knowing and having met Riza Chalid but emphasised, 'Let the legal process in Indonesia continue'. But he did not explicitly respond to questions regarding Riza's presence in Malaysia. Recall that on July 12, Indonesia's Attorney General's Office (AGO) had named Riza as a suspect in a corruption case pertaining to fuel imports at subsidiaries of its state-owned oil and gas giant Pertamina that incurred trillions in state losses. This came about as investigators at the Office of the Assistant Attorney General for Extraordinary Crimes had found enough evidence to name the tycoon a suspect amid their investigation into the case in which seven suspects, including Riza's son Kerry Adrianto, were arrested in February. Following this, Indonesian news agency Antara reported on July 21 that the country's Immigration and Corrections Ministry has traced Riza's last-known whereabouts to Malaysia. According to the ministry, Riza had departed Indonesia on Feb 6 for Malaysia and had not returned since. Elaborating further, Nurul Islam also highlighted a report by opposition-slant MalaysiaNow news portal which claimed that Riza had opened a rare earth elements (REE) mining company on the day PMX became PM. 'As a result of the check, I found that there is a company Triple Golden Innovation Sdn Bhd (registration number 1489064-K) which was registered on Nov 23, 2022 which is the day before PMX was sworn in.
