He said he did not feel like Mengo was uncomfortable with their conversations and said there had never been an explicit rejection of his advances.
Mengo accuses the top judge of making unwanted sexual advances towards her between 2021 and 2022.
However, Mbenenge said he understood her use of emojis on the social media platform, WhatsApp, to be flirty.
'I am a Xhosa man, and I know of something like, on the part of a lady, ukumutsa, is when you show interest in a lady, and in the Xhosa setup, they don't look you in the eye, bayamutsa, they look down. When somebody covers their face like this, for me, a Xhosa man, that is sufficiently flirtatious. These were flirtatious interactions.'

Dead or alive? The latest on Markus Jooste inquest
It's been almost 18 months since the alleged death of Steinhoff businessman Markus Jooste under mysterious circumstances. Authorities have yet to publicly disclose the truth of what really happened on the day he reportedly committed suicide. The 63-year-old's demise came after he had been slapped with a R475 million fine for accounting fraud at his multinational holding company. He has been widely accused of 'faking' his death to avoid imprisonment. On 21 March, Markus Jooste allegedly took his life with a self-inflicted bullet to the head at the Kwaaiwater Beach. The shooting occurred near his luxury holiday home in Hermanus. Jooste, who was discovered on the rocks near the shore, reportedly died shortly after arriving at the Hermanus Medi-Clinic. According to a local car guard, the businessman had used a silencer to reduce the sound of his gunshot. Just one day earlier, the 63-year-old had been fined R475 million by the Financial Sector Conduct Authority (FSCA) for accounting irregularities recorded at Steinhoff International between 2014 and 2017. On social media, South Africans have accused Markus Jooste of taking notes from fellow controversial businessmen Gavin Watson and Brett Kebble, who have been rumoured to have 'faked' their deaths. According to the Cape Argus, a police source claimed that of June 2025, there was still no post-mortem and morgue number in Jooste's inquest docket. The source added that there was also no proof of the weapon he allegedly used. However, police disputed the claim, adding that the investigation into Markus Jooste's death had been concluded. They added that the findings and docket had been submitted to the NPA. 'The firearm used during the incident was subjected to ballistic tests and thereafter returned to the executor as the weapon was registered in the name of the deceased. A report of the ballistic test is filed in the docket for court purposes', police shared. Last month, the Minister of Police told Democratic Alliance (DA) spokesperson for justice, Glynnis Breytenbach, in a parliamentary committee meeting that the postmortem report, blood/alcohol report, and ballistic report had been included in the investigation. Limpopo pig farmer's trial postponed as accused turns witness
The High Court in Polokwane postponed the trial of three men to Thursday. The state accuses them of murdering two women and dumping their bodies in a pigsty on a Limpopo farm. Limpopo pig farmer Zachariah Olivier, farm supervisor Rudolph de Wet, and Zimbabwean national William Musora face charges of murder, attempted murder, defeating the ends of justice, illegal possession of a firearm, and unlawful possession of ammunition. Musora faces an additional charge under the Immigration Act. The state alleges the men shot and killed Maria Makgato and Lucia Ndlovu in August last year at Onverwacht farm, outside Polokwane. A third woman reportedly escaped. The victims had allegedly gone to the farm to collect expired food for the pigs. According to the prosecution, the accused dumped the women's bodies in a pigsty, where the pigs consumed them. During brief court proceedings on Monday, 20-year-old De Wet, a supervisor on the farm, turned state witness under Section 204. His lawyer, Muhammed Farouk Valjee, told the court that De Wet will testify that Olivier fatally shot the women and forced him, under duress, to dispose of their bodies. The state is expected to withdraw charges against De Wet once he gives his testimony. Olivier and Musora, aged 60 and 50 respectively, remain in custody and have yet to enter their pleas.
