The Brihanmumbai Municipal Corporation (BMC) has sent a showcause notice to actor Mithun Chakraborty for the alleged unauthorised construction of a ground and mezzanine floor at his Malad premises. A mezzazine floor is a partial floor, generally built between two floors.In his response, the actor claimed that he had got the notice as part of an ongoing BMC drive in Malad's Erangal, where his premises are located. "I have no illegal or unauthorised constructions. A notice has been sent to in and around all, we are giving reply to them," he said.
advertisementAccording to the showcause notice, dated May 10, the Mumbai civic body has warned the actor of prosecution under Section 475A of the Mumbai Municipal Corporation Act for unauthorised construction. Section 475A deals with penalties for failing to remove any unauthorised work.
The notice mentions structures such as two ground floor units with mezzanine levels, and three temporary 10x10 units constructed using a combination of brick masonry walls, wooden planks, glass partitions, and AC sheet roofing. These constructions were carried out without permission, as per the notice.In the notice, the civic body had given a week for the actor to reply on "why the said building or work shall not be removed or altered or pulled down or the use of premises restored?"advertisement

The case involved allegations of misuse of land in Powai originally allotted for affordable housing that was allegedly used to construct luxury Judge SE Bangar accepted the ACB's closure report, saying that there was no proof of corruption, monetary gratification, or criminal conspiracy. The judge said, 'The ACB, Mumbai, has rightly concluded that no criminal offence warranting prosecution is made out,' and added, 'The closure reports are based on cogent investigation, verified compliance, and supported by judicial orders of the constitutional court.'advertisementThe allegations were linked to the Powai Area Development Scheme (PADS), executed by Lake View Developers—a Hiranandani Group entity—alongside the Mumbai Metropolitan Region Development Authority (MMRDA) and Brihanmumbai Municipal Corporation (BMC) under a Tripartite Agreement signed on November 19, 1986. Activists had accused the developer of diverting concessional land, meant for affordable housing, to construct luxury flats, allegedly causing a Rs 30,000 crore loss to public funds. In 2012, the ACB registered an FIR following a sessions court direction based on a complaint by activist Santosh Daundkar. The complaint named Hiranandani, then Urban Development Department Secretary Thomas Benjamin, and unknown officers from MMRDA and BMC. Daundkar sought the case be handed over to the CBI and Enforcement ACB initially filed an "A summary" report in 2013, indicating insufficient evidence. This was rejected by the court in 2018. Following a re-investigation, a closure report was filed again in 2019, which Daundkar 2008 and 2010, three Public Interest Litigations (PILs) were filed by individuals including activist Medha Patkar, raising concerns over developments in the PADS region. However, while disposing of the PILs in 2023, the High Court found that construction and handover obligations were fulfilled. A court-appointed committee confirmed to these proceedings, the ACB said, 'In view of the PILs having attained finality, there is nothing brought on record by the Complainant to infer any element of any criminal offence whatsoever on the part of the alleged accused persons.'In its final report, the ACB said it found no evidence that officers of MMRDA, BMC, or the Urban Development Department engaged in illegal activities or that the developer breached any terms of the Tripartite Agreement or earned unlawful court also said that the High Court had 'conclusively examined' issues related to affordable housing obligations, flat amalgamation, and flat sales. MUMBAI : After a 35-year-old woman lost her life and another was injured following the collapse of a portion of an unauthorised structural extension of a rehabilitated tenement (RT) building at Byculla (W), the Mumbai Building Repairs and Reconstruction Board is issuing warning notices to tenants of such buildings in the city to remove unauthorised extensions. Unauthorised structural extensions have been made by many tenants of such buildings. On May 28, a portion of unauthorised structural extensions, protruding beyond the original building line on the fifth floor, which were carried out by tenants of the building, collapsed. Following the incident, officials of the repair and reconstruction board visited the site and instructed tenants to remove unauthorised extensions. The Mumbai Building Repairs and Reconstruction Board is now issuing warning notices to tenants in reconstructed RT buildings in its jurisdiction. "The reconstructed tenement buildings were built between 1980 and 1990 after Mhada acquired rights to the buildings, which became dangerous and reconstructed these buildings. The Mumbai Building Repairs and Reconstruction Board carries out regular maintenance of these buildings. There are 388 buildings across the city, but unauthorised extensions have been carried out over the last 10 to 15 years, and some of the buildings are very old. This particular building, which has 193 residential rooms and 11 non-residential rooms, is also very old. We are issuing notices to tenants of these buildings to remove the unauthorised extensions," said a Mhada official. "Residents carry out these unauthorised extensions as they are hamstrung due to the small size of their rooms. But while carrying out these extensions, they do not take adequate precautions," said a Mhada official. Activist Santosh Daundkar said, " BMC has a dedicated Building and Factory department, which has a designated officer for carrying out action, including removal of unauthorised construction under the MMC Act, and they carry out action accordingly. Mhada also has officials to carry out such action, but they don't carry out any action as required. They only initiate action when an incident occurs. Mhada is lackadaisical when it comes to action against unauthorised construction. It has to be alert and take systemic action against unauthorised construction."
