DHS slams judge's release of transgender asylum seeker detained by ICE agents in Portland

PORTLAND, Ore. (KOIN) — The Assistant Secretary of the Department of Homeland Security has accused an Oregon judge of 'caving' to pressure from activists after she of a transgender asylum seeker from Mexico who was .
In a Thursday press release, Assistant Secretary Tricia McLaughlin referred to 'Biden-appointed' U.S. District Judge Amy Baggio as an 'activist judge' who 'is ignoring the biological reality of sex.'

McLaughlin further noted the 24-year-old woman – referred to as OJM by her attorneys – 'was placed into ICE's male detention center in accordance with the President's Executive Order and for the safety of women in ICE custody.' The release also contained a photo of OJM.
OJM had already been in the United States for two years and was originally at a hearing for her asylum case in Portland on June 2 when ICE officials asked the court to dismiss her case and detained her.
In response, attorneys at the Portland-based Innovation Law Lab said they filed an emergency petition, arguing ICE used 'deceptive and unethical practices' to detain her and strip her of her due process rights.

According to OJM's attorneys, after she left the courtroom, ICE agents arrested her 'in an attempt to end her asylum claim, transfer her, and rapidly deport her.'
'This is a dangerous attempt by ICE to circumvent due process, speed up deportations, and eviscerate the right to asylum,' said Innovation Law Lab Attorney Jordan Cunnings after OJM's arrest. 'This unethical behavior goes against the values we hold as Oregonians, ensuring that everyone is welcomed and included in our state.'
According to court documents, Judge Baggio claimed that OJM was 'erroneously deprived by the Government without procedural due process through the series of Government actions.'
OJM was abducted and raped in Mexico because of her gender identity and sexual orientation 'at the hands of a dangerous cartel,' OJM's attorneys said, noting she fled to the United States for safety.'
Innovation Law Lab called McLaughlin's recent comments 'disgusting' and an attempt to further intimidate an asylum seeker because of her gender identity.
'Let's be clear, the federal government is attempting to dox and intimidate this asylum seeker simply because she is trans,' they said. 'This is a disgusting effort to distract from the real issue. ICE is trampling due process, a core, fundamental freedom that protects every person in the United States, no matter where they were born. Asylum seekers have been following all the rules in their legal applications for asylum and federal agents are still snatching them off the street unlawfully.'
Judge Baggio officially ordered OJM's release on July 14.

She explained: "We understood the pain that the other one was feeling, and [in] those tough days and moments, we helped each other stand up. "We could cry with each other and talk about what we were feeling. We were able to walk alongside each other through the pain and heartbreak, and it brought us together in this amazing way." The pair went on to marry in 2021, but Francie insisted they will never forget their lost loved ones. She added: "We're both still grieving. We're never going to leave Bob and Beth behind [or] forget about them. "They'll always be a part of us. We thought we were going to spend the rest of our lives with them and that's not what happened and we were dealt a really hard hand. Both of us had a decision to make – are we going to rise up from the ashes and get back to life and what Beth and Bob would have wanted from us?"

Then-President Barack Obama, Trump said, 'should not be telling' Washington, D.C.'s NFL team 'to change their name.' But now, there is a need to focus on the nonsense, it seems. As President Trump continues to try to turn attention away from scrutinizing his relationship with the late alleged sex trafficker Jeffrey Epstein, he posted twice on his Truth Social platform on Sunday about the name of the football franchise in the nation's capital as well as that of the MLB team in Cleveland, Ohio. Indians, like Elizabeth Warren, must be very angry right now!' (Sen. Warren, a Massachusetts Democrat, has been mocked by Trump and other Republicans for her claims of Cherokee ancestry.) Trump's urging of the sports organizations to reverse their rebrandings comes as his second-term Administration has targeted diversity, equity, and inclusion initiatives in both the public and private sector. Speaking to reporters Sunday, Guardians' president of baseball operations Chris Antonetti said, 'We understand there are different perspectives on the decision we made a few years ago but obviously it's a decision we made. We've got the opportunity to build a brand as the Guardians over the last 4 years and are excited about the future.' The Commanders did not immediately issue a statement, but earlier this year, controlling owner Josh Harris said his team had no plans to change its name again. 'In this building, the name Commanders means something,' Harris said during a February press conference. 'It's about players who love football, are great at football, hit hard, mentally tough, great teammates.' It's unclear whether Trump has the authority to upend a deal that the Commanders and D.C. Mayor Muriel Bowser announced in April to return the team in 2030 to its former home at the capital's Robert F. Kennedy Memorial Stadium after having moved to Landover, Md., in 1997. Amid years of discussions about redeveloping the storied-but-defunct sports and events campus, Trump's predecessor, Joe Biden, signed into law in January a bill that transferred the land of the RFK Stadium from federal to local control for the next 99 years. Still, earlier this month, as some members of the D.C. Council expressed skepticism about the timeline and financing of the mayor's deal with the Commanders, Trump suggested he could intervene if the council doesn't approve it. 'It's a very important piece of property. It's a great piece of property,' Trump said, referring to the RFK Stadium site, 'You know, ultimately we control that.
