‘Zero compensation as bike rider drunk, didn't have valid licence'

Chennai: A motor accidents claims tribunal refused compensation to a pillion rider who suffered 48% disability in a road accident, as the bike's rider was drunk and he drove the vehicle against traffic on a one-way road.
The rider also did not have a valid driving licence at the time of the accident. The tribunal noted that the claim should have been filed against the motorcycle's driver rather than the load carrier involved in the collision.
Sub judge S Palani, presiding over the tribunal in Karaikal, passed the order while dismissing a claim petition moved by A Honest Raj, a resident of Nagapattinam, seeking 9 lakh as compensation from the insurer of the load carrier involved in the accident.
According to Honest Raj, on May 13, 2022, around 6.30pm, he was riding pillion on a motorcycle driven by Gowthaman at Jawaharlal Nehru Street, Karaikal. At the time of the accident, a load carrier, driven by Rajamanikandan, which came from the opposite direction allegedly in a rash and negligent manner, hit their vehicle.

In the accident, Honest Raj suffered a serious injury resulting in 48% partial disability. Aggrieved, he moved the claims tribunal seeking compensation from the insurer of the load carrier.

During the investigation, it came to light that the rider of the bike, Gowthaman, was under the influence of alcohol during the accident and that he drove the bike illegally on a one-way road.
Recording the submissions, the court said, "On a cumulative collection of evidence adduced by the respondent, it would establish that the petitioner's rider, Gowthaman, who was under the influence of alcohol, without holding a valid driving licence, rode the motorcycle on a prohibited one-way road, in a rash and negligent manner and committed the accident. That being so, the petitioner ought to have filed the present claim petition against Gowthaman, owner and insurer of the motorcycle.
Admittedly, the petitioner has not filed the claim against the tortfeasor Gowthaman, who is liable for the accident," the tribunal added.

1 2 Koraput: Jeypore MLA Tara Prasad Bahinipati was allegedly assaulted during Congress's Mashal Yatra at Koraput bus stand on the night of Aug 14. As per the complaint filed by his PSO at Koraput town police station, the incident took place around 8.15 pm when one Krushna Kuldeep (47), a helper at the bus stand, suddenly slapped the MLA and hurled abuses at him before being overpowered and handed over to the police. Woman suspects fraud in oil purchase, loses Rs 2.4L

Udupi: A woman running a cashew oil unit in Kundapur was allegedly cheated of over Rs 2.4 lakh after a man posing as a Yelahanka BSF purchasing officer placed an order for 30 tonnes of oil and collected money online under the pretext of generating a gate pass and security deposit. Complainant Veena, 56, said that in the first week of Aug, a person named Kunal Chaudhary called her and informed her that, on behalf of the Yelahanka BSF Purchaser's Office, they required 5 barrels (1 ton) of oil. The complainant told him that it was not possible to send just one ton and that if they needed five tons, she could send the oil in a tanker. The accused said he would speak to his superiors and inform her. Two days later, he called back and asked her to send 30 tons of oil. Accordingly, on Aug 14, about 30 tonnes of oil were filled in a tanker and dispatched to an address in Bengaluru. The accused then called again and said, "Tomorrow is Aug 15 – a holiday. The gate pass must be made online quickly; if it is not generated, the payment will be delayed by 2–3 days," and asked her to transfer Rs 5 to initiate the gate pass process. The complainant transferred Rs 5 from her son's bank account. She then received Rs 10 from the accused. After that, the accused called again and asked her to send a security deposit of Rs 2.5 lakh. As the complainant was in a meeting in Delhi, she immediately transferred a total of Rs 2,45,486. Suspecting foul play, she also called 1930 and lodged a complaint regarding the incident.
