
A young couple paid a contractor $1,500 after their dishwasher flooded their kitchen. It was downhill from there.
Restrepo, a college professor originally from Colombia, and Marks, a grammar school teacher, were impressed and grateful. They paid Darcy a $1,500 deposit for what the invoice described as 'plans for kitchen remodel.'
But Restrepo failed to get a signed contract spelling out what Darcy was expected to do and by what date, and how much (and when) Restrepo would pay him.

It was a mistake, Restrepo now acknowledges. He assumed Darcy understood the importance of getting the job done before the baby's due date a month later. You can guess what happened next: The job didn't get done, and the couple never got a refund from Darcy. On Sept. 11, Restrepo complained to Home Depot and asked for his money back after finding Darcy unresponsive to calls and texts.
Restrepo first contacted me for help in December. The baby was 3 months old by then, and the couple was still without a functioning kitchen. (They were using the bathroom sink to wash baby bottles and heating them in a microwave oven.)
Restrepo's attorney had sent a letter to Darcy in November saying he had 'failed to do any of the work he promised' and demanding unspecified damages under the state consumer protection law (Chapter 93A), which allows a court that rules in favor of a consumer to award triple damages plus attorney's fees (which in Restrepo's case could exceed $5,000).
The letter from Restrepo's attorney detailed an almost two-week period between Aug. 29 and Sept. 10, when Restrepo reached out to Darcy seven times by phone or text. (Restrepo shared with me phone and text records that support his assertions.) During that period, Darcy picked up once, on Sept. 4, saying he would call right back but didn't, Restrepo said. That evening Darcy texted, suggesting they 'chat in the morning.' Restrepo called the next day but got no answer, and his three subsequent calls over the next two days were not returned either.

In the last text he sent to Darcy, on Sept. 6, Restrepo wrote: 'We are expecting our child soon and really need our kitchen. We are counting on you.'
In early December, Darcy replied to Restrepo's attorney, defending himself and saying it was Restrepo who became 'impatient' as Darcy carried out his 'investigative work' and formulated a plan for the kitchen renovation, including plans to test the electrical service in the 23-unit condo building.
Darcy did not specifically address Restrepo's contention that he dropped out of communication with him.
In the letter, Darcy blamed Restrepo for 'lying and withholding … correct information' in the complaint Restrepo made to Home Depot on Sept. 11. That complaint resulted in Darcy being terminated by Home Depot as one of its certified contractors, after the company said it tried to reach him multiple times without success. Darcy wrote that he planned to 'litigate against' Home Depot based on 'false information' provided by Restrepo and that it was 'more than likely' that he would add Restrepo as a 'litigant.'

In Restrepo's case, Home Depot upped its usual amount by paying him $1,500, the amount of his deposit. Restrepo's acceptance of Home Depot's cash offer did not interfere with any legal claim he had directly against Darcy, the company said.
Darcy replied to my inquiry by saying he tried to move forward with the project but was hindered by not having approval from the condo building management.
'It is clearly stated in the condo bylaws that in order to renovate, alter or work in the building I am required to get approval from the management company,' Darcy wrote
to me.
Darcy told me that he asked Restrepo for a contact for the management company but didn't get it.
Restrepo provided me with records that show he texted the condo rules and regulations, among other documents, to Darcy on the first day they made contact. On the front page of the rules and regulations are email and phone contact information for the building manager.
It's possible Darcy overlooked that contact information. But Restrepo said Darcy never asked him for it until Aug. 28, two weeks after the deposit was paid, apparently in response to Restrepo's text asking, 'is there anything you need me to do to advance the process?'
In a phone call with Darcy that followed, Restrepo said he provided the contact information. The next morning, Darcy made a one-minute call to the building manager, possibly leaving a voicemail, records Darcy shared with me show.
I don't think Restrepo can be blamed for Darcy's belated attempt to contact the building management, or for his apparent lack of follow-up after his call to the manager on Aug. 29.

Darcy also told me in an email that he spent 12 to 14 hours on the project before Restrepo 'canceled.'
Between Aug. 7 and Sept. 11, the day that Restrepo complained to Home Depot, Darcy spent a couple of hours on the phone with Restrepo, Restrepo's phone records show. Restrepo says Darcy made two site visits of about an hour each, including once with an electrician.
Darcy also made a five-minute call to the Hull town electrical inspector on Aug. 29, records Darcy shared with me show. And he got a quote on the cost of cabinets on Restrepo's behalf, according to Darcy's letter to Restrepo's attorney. Restrepo says Darcy never shared that quote with him, nor presented him with a design or plan for the kitchen.
The resolution
: The records shared with me show Restrepo quickly sent Darcy the documents he requested, including the condo rules and regulations. The records show that Restrepo repeatedly asked what he could do to help Darcy move the project forward, with little response from Darcy. Restrepo seemed deferential to Darcy — up to a point. After that, he pursued Darcy, pouring countless hours into it.
He said he wants to be an example for other consumers.
I think Darcy should, at a bare minimum, return the deposit (Home Depot's payment notwithstanding). If Restrepo was impatient, I think that's understandable.
Two weeks ago, Restrepo filed an application for a criminal complaint against Darcy but that was denied after a hearing. He is contemplating filing a claim in small claims court.

The takeaway
: When you hire someone to do a job, make sure both parties are aware of their responsibilities. The best way to do that is in a written contract specifying what tasks will be done by what date and how much the contractor will be paid upon completion of each stage of the project. Make payment contingent on completion of certain stages to incentivize your contractor to stay on schedule.
Many homeowners complain that it takes too long for their contractor to finish their job (contractors are often juggling multiple jobs). Homeowners are in a delicate position: Once work has begun, you don't want to alienate the contractor with complaints, but you also need the work to be complete. A contract will help. But in no event should your contractor stop returning calls after you have paid money.

‘An intimidation tactic': Trump's show of force dismays Washington residents
Washington DC's only Home Depot was busy with contractors and customers on Thursday morning – but the Hispanic day laborers who usually gather and wait for work under the parking lot's sparse trees were nowhere to be found. Two days earlier, masked federal agents swarmed the area and made several arrests, which were photographed by bystanders and posted on social media. Juwan Brooks, a store employee who witnessed the raid, said the agents grabbed anyone who appeared Hispanic. 'They don't ask no questions,' Brooks said. People walking across the parking lot, getting out of their cars, or even sleeping in their vehicle – all were grabbed by the agents, leaving behind empty work trucks that were eventually towed away. 'It was cool when Trump was saying it, but to actually see it first hand? I didn't like it,' Brooks said. The day laborers 'are not bad people', and he wondered what happened to the children of the men that were taken away. Four days after Trump ordered federal agents and national guard on to the streets of Washington DC to fight a crime wave that city leaders say is not happening, residents of the capital are becoming used to the presence of groups of armed men in their neighborhoods, and the aggressive tactics they use. Beyond the apparent immigration arrests at Home Depot – which Brooks said was the second raid there he is aware of since Trump took office – federal agents have been spotted setting up roadblocks at busy intersections, and patrolling neighborhoods across the city. Trump, who exercised a never-before-used clause in the law governing the district to take over the Metropolitan police department (MPD) for 30 days, this week said he would seek Congress's approval to keep it under federal control for the 'long term'. I just feel like it's too much federal overreach It's unclear how much of a difference the deployment has yet made on public safety. Rates of violent crime dropped to 30-year lows last year, but it remains more prevalent in Washington DC than many cities with similar populations. Since Trump made the deployment official on Monday, the city recorded two homicides, bringing its count for the year up to 101. 'I just feel like it's too much federal overreach. I think it's unnecessary, and I think our MPD does a great job,' said Kevin Cataldo, a neighborhood commissioner whose district includes the block just north of downtown where the 100th homicide of the year took place on Monday, hours after Trump announced the federal takeover. Recent evenings have seen federal agents and police set up roadblocks and pull drivers over on major roads, as protesters gathered to condemn them. On Tuesday evening on 14th Street in Columbia Heights, a north-west Washington neighborhood that is home to the city's largest Hispanic population, police and federal agents, some with their faces covered, began stopping cars, said a local shop manager who declined to be named. Before long, dozens of people emerged to berate them. '[Residents] were trying to tell them to leave, you know, the people in the street and the neighbors,' he told the Guardian. 'They yelled back 'don't make the people scared, this is a free country', 'why make the community unsafe?',' the manager said. The scene repeated a little over a mile south on 14th Street on Wednesday evening, with police and federal agents pulling over cars, and locals heckling them and trying to warn approaching drivers away, according to videos posted on social media. Owen Simon, an undergraduate government student at Georgetown University, had heard that agents were spotted in the tony neighborhood around campus, and wondered what they were doing there. Muggings happened occasionally in the neighborhood, but Simon said he was less concerned about those than what the agents might do to foreign students – or students who appeared to be foreign. 'No one wants to walk around knowing that anyone could be scooped up out of the street at any moment,' he said. 'I don't think that this move by the Trump administration is a way to crack down on crime. I think it's about optics.' As he smoked a cigarette in the Home Deport parking lot, Brooks had a similar concern about Congress Heights, the south-east Washington neighborhood where he lives. Crime there is undoubtedly a concern, but it was teenagers who were behind it, not his working-class neighbors. 'You got other people catching strays off that, too,' he said. 'You got working people living in the neighborhood, going to the store, getting picked up because of 16-, 17-year-olds. 'I understand targeting the area, but you can't really blame the people in the area who are trying to do better,' he added. What we know about man killed while running from ICE agents in Monrovia
After a man was struck and killed by a SUV Thursday while running from a federal immigration enforcement operation at a Home Depot in Monrovia, immigrant communities are once again condemning the federal government's tactics while mourning the crash victim. The man who died on the 210 Freeway was identified as Roberto Carlos Montoya Valdez from Jutiapa, Guatemala, according to the National Day Laborer Organizing Network, which said the Guatemalan consulate confirmed the identity. Cellphone video from the deadly crash appears to show a passerby on the 210 Freeway, showing the body of a man who has been hit by a car just yards from where federal officers were arresting day laborers below. The man ran from the scene, crossed Evergreen Avenue and entered the eastbound 210 Freeway, said Monrovia City Manager Dylan Feik. CHP officers said they received a report just before 10 a.m. that someone had been hit by a SUV on the freeway near Myrtle Avenue. What exactly led up to the man running onto the freeway is unclear. 'Was it intentional? I don't think that is the case, but it ended up with a father, a brother being killed,' said Pablo Alvarado, co-executive director of the National Day Laborers Organizing Network. The Department of Homeland Security told NBC Los Angeles in a statement that Montoya Valdez was not being pursued by federal officials. But Alvarado blamed the federal officials' tactics that, he said, created fear. 'Whether they were chasing him or not, the fact is that when you have operations of this kind, the first reaction of any human being is to run.' Many others in the same Home Depot parking lot also ran, according to people who witnessed or experienced the raid. 'My boss told me to run because immigration was there,' Mattias, a worker who escaped the raid, said in Spanish. 'Some people ran regardless of their immigration status because nowadays, they don't know if undocumented or documented people will be detained.' Mattias said he hurt himself while jumping a fence. DHS said eight day laborers were arrested during Thursday's raid, including nationals from Mexico, Guatemala and Honduras. The department called the raid by U.S. Border Patrol a 'targeted immigration enforcement operation,' but did not mention the death of Valdez.
