KUALA LUMPUR: A 37-year-old former finance officer was sentenced to 16 months in prison and fined RM5,000 by the Sessions Court today after admitting to criminal breach of trust (CBT) involving RM182,884.02 in company funds.
Judge Azrul Darus ordered Siti Nurain Mohamad Ghazali to begin her sentence from the date of her remand on May 22. Failure to pay the fine will result in an additional six months' imprisonment.
The offence occurred between April and December 2024 at a petrol station along Jalan Tun Razak. Siti Nurain was charged under Section 408 of the Penal Code, which carries a minimum one-year jail term, extendable to 14 years, with caning and a fine.
Investigations revealed that she had systematically diverted supplier payment funds into her personal bank account. The company uncovered the discrepancies during an audit on February 5 and later questioned her.
In mitigation, Siti Nurain, who was unrepresented, pleaded for leniency, citing her responsibilities as a mother of three children aged eight, 10, and 11. She also stated that she is undergoing psychiatric treatment at Hospital Kuala Lumpur and requires daily medication.
'My husband has lost his source of income. I am responsible for supporting our children. I have repented during the one-month remand and will not repeat this offence,' she told the court.
Deputy public prosecutor M. Saravanan argued for a deterrent sentence, emphasising the prolonged nature of the offence and its impact on the company.
'The misappropriation of such a substantial sum over an extended period reflects a deliberate and sustained course of conduct. Her actions directly impacted the company's financial standing,' he said.

PUTRAJAYA: The Court of Appeal here today acquitted and discharged Muar MP Syed Saddiq Syed Abdul Rahman of four charges involving criminal breach of trust, misappropriation of property and money laundering linked to funds from Angkatan Bersatu Anak Muda (Armada). A three-member bench comprising Justices Datuk Ahmad Zaidi Ibrahim, Datuk Azman Abdullah and Datuk Noorin Badaruddin allowed Syed Saddiq's appeal to overturn his conviction and sentence of seven years' jail, two strokes of the cane, and a RM10 million fine imposed by the Kuala Lumpur High Court on Nov 9, 2023. 'We find that the prosecution failed to prove the abetment charge against the appellant (Syed Saddiq). The evidence presented was not credible and did not support the misappropriation charge under Section 403. Additionally, the money laundering charges under AMLA could not be sustained. 'Therefore, the appellant is acquitted and discharged of all charges,' said Justice Noorin, who read out the unanimous decision. Syed Saddiq, 32, had been accused of abetting Armada's former assistant treasurer, Rafiq Hakim Razali, in committing criminal breach of trust involving RM1 million. The alleged offence was said to have occurred at CIMB Bank Berhad, Menara CIMB KL Sentral, on March 6, 2020, under Section 406 of the Penal Code. For the second charge, he was accused of misappropriating RM120,000 from the Maybank Islamic Berhad account of Armada Bumi Bersatu Enterprise by instructing Rafiq Hakim to dispose of the funds. The act was alleged to have taken place at Malayan Banking Berhad, Taman Pandan Jaya, between April 8 and 21, 2018, under Section 403 of the Penal Code. Additionally, Syed Saddiq faced two charges of money laundering involving the transfer of RM50,000 each from his Maybank Islamic account to his Amanah Saham Bumiputera account. These transactions, allegedly proceeds of unlawful activities, were said to have occurred at a bank in Taman Perling, Johor Bahru, on June 16 and 19, 2018. The money laundering charges were brought under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, which provides for a maximum sentence of 15 years in prison and a fine of up to five times the amount involved, upon conviction.

Kota Kinabalu: A man, who was detained on his 24th birthday this year, was jailed five years and ordered given a stroke of the cane for repeatedly taking syabu. Sessions Court Judge Amir Shah Amir Hassan handed the sentence to Mohammad Zulkarnain who admitted to the charge against him on Tuesday. Mohammad was found taking the drug at 8.30am on Feb 24 this year after his urine was tested positive for drug at the Papar police station. He has two previous conviction records of taking the drug. The offence under Section 39C(1) (b) of the Dangerous Drugs Act carries a jail term of between five and seven years and whipping, on conviction. After completing the jail sentence, Mohammad was ordered placed under police supervision for three years. In meting out the sentence, the court advised Mohammad to not repeat to take the drug, seek for a job and find a soulmate since he is still single. Advertisement In another court, the court set July 24 for further pre-trial case management for a 38-year-old lorry driver charged with committing criminal breach of trust involving frozen products worth RM39,326. The court set the date for Azlan Limin when his counsel discharged herself from representing him. Azlan informed the court that he could not engage a counsel because of financial problems. He is accused of breaching the trust given to him as a lorry driver who was entrusted by the Evergrowth Intergrated Food Industries Sdn Bhd with the 316 cartons of frozen goods on Apr 9 this year at the company premises in Kg Mook, Kinarut, Papar. He claimed trial to the offence under section 407 of the Penal Code which carries a jail between one and 10 years, with whipping and liable to a fine, on conviction. The court extended Azlan's bail.
