Govt Succeeds In Overturning Order To Transfer Duta Enclave Land Title To Semantan Estate
PUTRAJAYA, June 24 (Bernama) -- The Federal Territory of Kuala Lumpur Land Registrar succeeded in its appeal to overturn the High Court's ruling that had ordered it to transfer the title of the 263.272-acre 'Duta enclave' land in Kuala Lumpur back to Semantan Estate (1952) Sdn Bhd.
A three-member bench consisting Federal Court judge Datuk Lee Swee Seng and Court of Appeal judges Datuk Azimah Omar and Datuk Wan Ahmad Farid Wan Salleh had allowed the Federal Territory of Kuala Lumpur Land Registrar's appeal to set aside the High Court's decision.
Justice Lee, held that the 2009 High Court decision, did not order the Government of Malaysia to transfer the subject land back to Semantan Estate.
'As such, there was no order to execute. In the absence of an order for the transfer of the land back to Semantan Estate, an order for declaration cannot be executed, as it is only declarative of the rights of parties.
He said a declaratory order merely affirms the legal rights of parties involved and it does not carry with it the power of enforcement, such as specific performance, adding that such orders are non-executable by nature.
Justice Lee, who delivered the court's unanimous decision, however, ruled that Semantan Estate is entitled to adequate compensation, to be assessed based on the land value in 1956, the time the government took possession of the land.
The company, he said, is also entitled to mesne profits for the land, which will continue to accrue until the government fully settles the compensation. The amount of mesne profits, to be assessed by the High Court, shall no longer be payable once full payment of compensation has been made.
He also directed parties to file their expert valuation report on the market value of the subject land as at December 3, 1956, within 90 days from today.
Justice Lee said two payments made by the government - RM1.321 million on December 21, 1956, and another RM79, 241 on February 3, 1959 - would be deducted from the amount of compensation to be assessed.

Kota Madani Development In Precinct 19 Can Overcome Shortage Of Govt Quarters
By Thivyamalini Ramalu PUTRAJAYA, June 25 (Bernama) -- Calls to increase the number of government quarters in Putrajaya over the past 25 years are set to be finally answered through the development of Kota MADANI in Precinct 19 here, said Putrajaya Corporation (PPj) president Datuk Fadlun Mak Ujud. Speaking to Bernama and RTM here today, he said government quarters are still in high demand, particularly from support groups who have been renting houses quite far from their workplaces. "Under the original master plan in 1998, we did plan for these residences. Based on the demand for quarters that we have received so far, we now have 17,000 applicants from various categories. "As far as I can recall, requests to build more quarters have been made since 2000. Finally, this year, we can implement the development of these quarters,' he said. Spanning 41.28 hectares, Kota MADANI is set to feature 10,000 high-density vertical residential units capable of accommodating over 3,000 residents. Its design will integrate artificial intelligence technology, efficient digital infrastructure and a green mobility system. Commenting on the assumptions of certain parties that the project used public funds, Fadlun stressed that the project is being developed through a public-private collaboration by Putrajaya Holdings using the Build-Lease-Maintain-Transfer (BLMT) concept. "… and this can reduce the actual costs because the government does not come out with any funding, and it is all borne by the developers. The only thing is that the repayment period will be determined by the Public Private Partnership Unit (UKAS),' he said. The development of Kota MADANI in Precinct 19 will be implemented in stages, with the first phase set to commence in the third quarter of this year, and the development is estimated to cost RM4 billion.

Finance Officer Loses Over RM4 Mln To Online Investment Scam
GEORGE TOWN, June 25 (Bernama) -- A finance officer from a local consultancy firm has lost RM4.17 million after falling victim to an online investment scam recently. Penang police chief Datuk Hamzah Ahmad said the 60-year-old woman lodged a police report yesterday at the Timur Laut district police headquarters (IPD), claiming she had been deceived by an investment scheme known as 'KKR Investment'. He said the victim first came across a KKR Investment advertisement on Facebook in early March and clicked on the link provided. 'She was then contacted via WhatsApp by a woman who later added her to a WhatsApp group called 'Kumpulan Analisis Kewangan Saham Malaysia' (Malaysian Stock Financial Analysis Group),' he said in a statement today. Hamzah said the suspect promised high returns within a short period, depending on the amount invested. The victim was also instructed to download an app called 'KKR INV' via a given link to register and begin investing. Between March 10 and June 13, the victim made 76 transactions amounting to RM4.17 million to eight different company bank accounts before realising she had been scammed. 'She became suspicious when she was unable to withdraw the profits displayed in the app and was instead asked to make additional payments,' Hamzah said. The case is being investigated under Section 420 of the Penal Code for cheating. -- BERNAMA
