Bengaluru: The Karnataka high court has determined that penalties under section 31 of the Protection of Women from Domestic Violence Act are not applicable to maintenance orders.
Justice Shivashankar Amarannavar delivered the ruling while dismissing a Bengaluru woman's petition.
The case involved the woman seeking monthly maintenance of Rs 20,000 and Rs 15 lakh for marriage expenses from her husband, along with the return of gold jewellery. She filed for interim maintenance under Section 23(2) of the Act. In Nov 2014, a magistrate granted a Rs 3,000 interim monthly maintenance. The respondent-husband paid Rs 8,000 in Dec of that year, and requested time for paying the remaining amount.
The following year, the petitioner filed a complaint under Section 31 of the DV Act, seeking action against the respondent for breaching the interim protection order. Following an inquiry, the magistrate convicted the respondent in Jan 2017, imposing a six-month simple imprisonment or Rs 20,000 fine.

The respondent appealed to the sessions court, which overturned the magistrate's order. The woman challenged the decision, arguing that her husband deserved punishment under Section 31 for non-compliance with maintenance orders.

Justice Amarannavar observed that Section 31's language is unambiguous, referring only to protection and interim protection orders. The provision applies exclusively to Section 18 protection orders, not to residence, monetary, custody, or compensation orders under sections 19-22.
The court emphasised that criminal statutes require strict interpretation as they affect citizens' fundamental rights. The legislature deliberately included only protection orders under section 31 after specifically categorising them under section 18.
The judge also highlighted practical implications, questioning whether failure to pay maintenance due to valid reasons should attract section 31 penalties. Such wider interpretation could overwhelm courts with section 31 cases, which the legislature did not intend.
The court concluded it cannot override legislative intent by treating non-payment of maintenance as a protection order breach under section 31, thereby affirming the sessions court's ruling favouring the husband.

Maken Murder: 3 Held Three persons have been detained in connection with the gruesome murder of Lalit Maken, his wife and a visitor to their house, the commissioner of police, Ved Marwah told a press conference. The three have been detained on the basis of information collected from the five eye witnesses to the crime, he said. All three were residents of South Delhi, Marwah added. The police commissioner promised a reward of Rs 1 lakh to any person giving clues leading to the arrest of Maken's assailants. Parliament Adjourned A stunned and grieved Parliament adjourned as news of Congress (I) MP Lalit Maken's killing came in. Speaker Balram Jakhar, PM Rajiv Gandhi and Opposition leaders paid tributes in the Lok Sabha prior to adjournment. MADURAI: The Madurai Bench of the Madras High Court recently came to the rescue of a stateless woman, born to Sri Lankan parents in a refugee camp in Karur, after her passport application was rejected by the Ministry of External Affairs (MEA) without affording her the opportunity of a hearing. Following a petition filed by the woman, S Harinaa, Justice C Saravanan directed the MEA to reconsider the application within three months by obtaining a fresh report from the police. Harinaa was born to two Sri Lankan nationals in a refugee camp at Rayanoor in Karur district in February 2002. Wanting to study abroad, she had earlier moved the HC in 2022, against rejection of her passport application. While disposing of her petition in June 2023, the court had observed that there are provisions under the Passports Act, 1967, which enables the centre to issue passports to even non-citizens, if it feels it would be in public interest. Since Harinaa holds citizenship neither in Sri Lanka nor India, the court also declared her a stateless person. However, her application was once again rejected in May last year, challenging which she moved the court again. The second rejection order was passed based on a police verification report which included wrong information that Harinaa was born in Sri Lanka. The Deputy Solicitor General of India, opposing Harinaa's plea, told the court the MEA feels that issuance of a Certificate of Identity to Harinaa may not be in the interest of the nation. However, Justice Saravanan observed that there are ample numbers of documents, including Harinaa's birth certificate, to show she was born in India, while there are no records to indicate she was born in Sri Lanka and entered India either legally or illegally. Noting that these aspects were not considered by the MEA, the judge gave the above directions.
