MACC Files Forfeiture Application For Menara Ilham

KUALA LUMPUR, June 25 (Bernama) -- The Malaysian Anti-Corruption Commission (MACC) has filed a forfeiture application for the Menara Ilham building linked to the late former finance minister, Tun Daim Zainuddin.
MACC Chief Commissioner Tan Sri Azam Baki said the 60-storey building is among the latest assets subject to forfeiture proceedings involving Daim, his wife Toh Puan Na'imah Abdul Khalid and several of their local proxies.
'We will initiate the (forfeiture) process today, and I must say, it is not a simple task as there are many steps involved, and the documents (related to Menara Ilham) are extensive.
'In the next one to two weeks, more applications will be filed for properties linked to the individuals concerned,' he said at a press conference at the MACC headquarters here today.
Azam also said the MACC has obtained a Restraining Order in Malaysia against assets belonging to Daim and related parties in the United Kingdom, estimated to be worth RM700 million.
Following this, UK authorities have been notified and agreed to file a Restraining Order application in UK courts based on Malaysia's request.
Earlier this month, the MACC once again seized Menara Ilham after securing permission from the Deputy Public Prosecutor to do so.
On Monday, the High Court temporarily suspended an order to freeze seven properties, including three luxury residences in London, and one bank account, allegedly belonging to Na'imah and her family.
Previously, the MACC had obtained an ex parte order to freeze the seven properties and one bank account, all of which are valued at £132 million (RM758.2 million), under Section 53 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act (AMLATFPUAA) 2001.

KOTA KINABALU (June 25): A former director of the Sabah Water Department told the Sessions Court here today that the large amount of cash allegedly found by the Malaysian Anti-Corruption Commission (MACC) was derived from profits of business ventures with his partners. Ag Mohd Tahir Mohd Talib, 63, testified before judge Abu Bakar Manat, naming three business partners — one of whom was his brother — who were contractors involved in the ventures. He said he had provided business capital to them from his personal savings, though he could not recall the specific amounts as the arrangements dated back many years. The agreements, he added, were made orally without written documentation. Ag Mohd Tahir also stated that in addition to business profits, the cash in question included his salary. Taking the stand as the first defence witness, Ag Mohd Tahir read his testimony aloud in open court. His statement spans 155 pages. Under examination-in-chief, he testified to receiving substantial profits — RM5 million, RM30 million and RM12 million — from his partners, all in cash. He claimed to have roughly counted the money he received. He further asserted that the luxury vehicles and items allegedly found in his possession were purchased using both his salary and business profits. Ag Mohd Tahir is on trial alongside his wife, Fauziah Hj Piut, 58, and the department's former deputy director, Lim Lam Beng @ Lim Chee Hong, 69. He faces 11 charges under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, while Fauziah faces 19 similar charges. The couple also jointly face two additional charges under the same section. Ag Mohd Tahir has an additional charge under Section 4(1)(a) of the Act. The offences allegedly took place at various locations in Kota Kinabalu and Kuala Lumpur — including the department's office, a residence in Sembulan, bank branches, a condominium in Sulaman, and a tower in Kuala Lumpur — between October 4 and November 4, 2016. Meanwhile, Lim is accused of committing offences at the MACC office on Jalan UMS and at a residence in Kota Kinabalu between October 13 and November 8, 2016. The prosecution is led by Deputy Public Prosecutors Mahadi Abdul Jumaat, Haresh Prakash Somiah and Zander Lim. Ag Mohd Tahir and Fauziah are represented by counsel Datuk Hj Ansari Abdullah and Erveana Ansari, while Lim is represented by counsel Datuk Tan Hock Chuan, Baldev Singh, Karpaljit Singh and Kelvin Wong. The trial is scheduled to resume on June 26.

PUTRAJAYA: In a new development, at least RM11 million in misappropriated sukuk funds meant for a highway extension project was converted into digital currency. Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Tan Sri Azam Baki said the digital currency was then used for undisclosed purposes. "We are now tracing how the funds were withdrawn and used," he told reporters today. He said the money is believed to have been siphoned from sukuk funds and spent via digital means, which is now under detailed investigation. "Further investigations are ongoing, including examining the connections between these transactions and several other witnesses," he said, adding that at least 10 more people will be called soon as the probe continues actively. Azam said to date, the MACC has recorded statements from 55 individuals and made nine arrests. "A number of raids have also been carried out, including at the suspect's residence. "In total, 14 individual bank accounts and eight company accounts have been frozen, involving funds amounting to RM156 million," he said, adding that the investigation is being conducted under the Anti-Money Laundering and Anti-Terrorism Financing Act 2001. He said the probe also involves embezzlement activities linked to unlicensed alcohol and gambling, believed to involve RM25 million from the misappropriated sukuk funds. "We expect to complete the investigation within two months, possibly earlier. "We will provide updates as needed," he added. Earlier, it was reported that around 20 witnesses would be called by the MACC as part of its ongoing investigation into the alleged misappropriation of sukuk funds meant for the construction of a highway in the Klang Valley. This includes recalling witnesses who had previously given statements to gather further information on the fund, which is worth millions of ringgit. The investigation team is scrutinising various documents, including bank records, and recording statements from bank personnel to verify the contents of those records. So far, the MACC has seized RM141 million worth of assets in Malaysia linked to the case and is currently tracking RM15 million in foreign assets.
