Community leaders report defamation of Head of State, minister to police

BEAUFORT (Aug 15): Two local leaders from Membakut filed police reports regarding a Facebook post linking Science, Technology and Innovation Minister Datuk Dr Mohd Arifin Arif to the death of student Zara Qairina Mahathir.
District Native Court chief Banjimin Ondoi Dulau and Deputy Chief 1 of PBS/STAR Membakut Division, Jinori Mikil, filed separate reports at the Beaufort District Police Headquarters (IPD) here today.
They emphasized that the allegations in the post were entirely false, made without evidence, and clearly defamatory. Additionally, the claims attempted to tarnish the reputation of the individuals involved and the institution of TYT (Head of State), particularly the Governor of Sabah, Tun Musa Aman.
Banjimin stated the post could incite the public, provoke unrest, and interfere with ongoing police investigations.
'The statement also threatens the safety and dignity of the victim's family and the slandered individuals,' he said.
Jinori said he identified the post on a Facebook account on July 30, which alleged Mohd Arifin's child was involved in the incident.
'Mohd Arifin's child never attended the school in question. This accusation is completely untrue and could create negative public perception,' he explained.
He urged authorities to investigate the Facebook account, which also claimed the student was the granddaughter of the Sabah Head of State and the child of Mohd Arifin.
Both Banjimin and Jinori requested legal action under Section 233 of the Communications and Multimedia Act 1998, Sections 499–500 of the Penal Code (defamation) and Section 504 of the Penal Code (intentional insult to provoke breach of peace).
They further called on the Malaysian Communications and Multimedia Commission (MCMC) to act against the account owner and those spreading the defamatory content.
Besides the named account, they identified several others uploading identical content and have submitted details to relevant parties.
The leaders hope all state and federal authorities, including cyber law enforcement agencies, will take appropriate measures to protect the reputation and safety of the slandered parties, especially concerning the dignity of state leaders and the institution of the Sabah Head of State.

'The struggle is not over, UMNO Youth will continue to stand at the forefront for the sovereignty of the country,' read a statement issued by the movement. 'UMNO Youth will not budge an inch even if pressured, threatened or intimidated. As long as blood flows in the body, the dignity of the country will continue to be defended!' Prior to that, DAP has strongly condemned Akmal's action of leading a march and demonstration in front of a hardware shop in Kepala Batas on Thursday (Aug 14) despite warnings from the Inspector-General of Police (IGP) and the Penang Police chief not to hold any gatherings. ⁠'The action is a form of bullying and intimidation against the trader amid on-going investigation and that he has apologised for the mistake in installing the flag,' Loke who is also the Transport Minister had pointed out. ⁠'Actions like this go beyond the limits of the law and the norms of the multi-racial society in Malaysia. KUALA LUMPUR: Bukit Aman is investigating a TikTok account, @berjuanguntukzara, for allegedly uploading inaccurate and misleading content related to the Zara Qairina Mahathir's case. Bukit Aman Criminal Investigation Department (CID) director Comm Datuk M. Kumar said the investigation is being conducted under Section 4(1) of the Sedition Act 1948, Section 505(b) of the Penal Code, and Section 233 of the Communication and Multimedia Act 1998. "These provisions cover offences involving improper use of network facilities, as well as content deemed to incite hatred towards any party or cause public fear and unrest," he said in a statement on Saturday (Aug 16). Comm Kumar urged the public to immediately stop engaging in such irresponsible behaviour, warning that the spread of false information could create confusion. "Such actions could disrupt and undermine the effectiveness of the ongoing investigation into the case.

KUALA LUMPUR: Umno Youth chief Datuk Dr Muhamad Akmal Saleh completed giving his statement at the Dang Wangi District Police Headquarters (IPD) here at 1.25am on Saturday (Aug 16) over the assembly in Kepala Batas, Penang last Thursday. Muhamad Akmal's lawyer, Aizat Azam, said the Merlimau assemblyman had extended good cooperation and answered all of the approximately 80 questions posed by the investigating officer. "He (Muhamad Akmal) was investigated under Section 4(1) of the Sedition Act 1948, Section 506 of the Penal Code, and Section 233 of the Communications and Multimedia Act 1998,' he told reporters when met in front of the IPD today. Meanwhile, Muhamad Akmal said he would give full cooperation to the police in the investigation into the case. He arrived at the Dang Wangi IPD at 11pm yesterday to have his statement recorded.
