The CBI's Banking Security and Fraud branch and Anti-Corruption branch in Bengaluru will now deliver summonses and legal notices by postmen, replacing the traditional method of manual delivery by investigators as a move to improve efficiency and transparency.The agency's Banking Security and Fraud Branch and Anti-Corruption Branch signed a Memorandum of Understanding (MoU) with the Karnataka Circle of the Department of Posts on Wednesday to operationalise this shift.advertisementAccording to an official statement released on Thursday, the initiative will not only ensure secure, trackable, and timely delivery of legal communications but also lead to significant savings in travel and daily allowances. This will also enable more efficient use of manpower for core investigation duties.
As part of the MoU, the dispatch and delivery of summons and legal notices will be done through India Post's Speed Post 'Book Now Pay Later (BNPL)' service and India Post will supply specially designed envelopes and Proof of Delivery (POD) cards bearing the Chief Bureau of Investigation logo and return addresses. These items will be collected directly from Chief Bureau of Investigation offices and delivered to recipients across the country. Signed Proof of Delivery cards confirming delivery will be returned to the Chief Bureau of Investigation, with full tracking available via the India Post website.advertisementThe centralised dispatch will be managed through the RT Nagar Head Post Office in Bengaluru, with pickup services available on all working days.
'Delivery timelines will range from one to five days, with provisions for re-delivery and free return of undelivered items. The Delhi high court has dismissed a plea moved by Rashtriya Janata Dal (RJD) chief Lalu Prasad seeking to stay the trial court proceedings in the corruption case related to the alleged land-for-jobs case registered by the Central Bureau of Investigation (CBI). The CBI and the Enforcement Directorate (ED) are investigating former Bihar chief minister Lalu Prasad, his family, and several others in connection with the land-for-jobs case. During his tenure as the Union railways minister between 2004 and 2009, Yadav is alleged to have granted railway jobs in exchange for land parcels from candidates or their relatives, either as gifts or at significantly reduced prices. CBI on May 18, 2022 had registered a case against the former railway minister and 15 others, including his wife, two daughters, unidentified public servants and private persons. They were granted bail in the CBI case, saying they should not be arrested before the charge sheet was filed. Delhi's Rouse Avenue court is scheduled to commence arguments in CBI's case on June 2. In an application filed on May 29, Prasad's counsel senior advocate Kapil Sibal had urged the court to stay the proceedings until disposal of his plea seeking to quash the criminal case, citing absence of sanction under section 17A of the Prevention of Corruption Act, for initiating the preliminary inquiry. The said section mandates police officers to seek prior approval before conducting an inquiry, investigation or trial into an alleged corruption offence by a public servant, if the offence relates to official recommendations or decisions. In an order released on Saturday, a bench of justice Ravinder Dudeja said, 'The present matter is stated to be listed before the learned Special Judge for arguments on charge. Notwithstanding, the pendency of the present petition, the petitioner would be at liberty to urge all his contentions, before the learned trial court at the stage of consideration of charge. This would be rather an added opportunity to the petitioner to put forth his point and get the same adjudicated. Thus, I find no compelling reasons to stay the proceedings of the trial court. The application of stay is therefore dismissed.' The judge, however, issued a notice on Yadav's plea seeking to quash the FIR and fixed August 12 as the next date of hearing. Sibal further submitted that even though CBI had conducted an investigation from 2009 to 2014, and had even filed its closure report before the competent court, the initiation of the fresh investigation in 2021 and registration of FIR thereafter in 2022, was in concealment of the previous investigations and closure report that was an abuse of the process of law. He added that city court's 2023 order taking cognisance of the charge sheet filed against him was 'bad' since it had failed to ignore the illegality committed by CBI during the investigation. However, the court turned down his request stating there were no compelling reasons to stay the proceedings. The HC judge was of the view that Prasad would get an 'added opportunity' to put forth his contention before the trial court and get the same adjudicated. CBI, represented by special public prosecutor DP Singh, had opposed the petition saying that it was not necessary to obtain prior sanction to probe Prasad's role. He further submitted that Prasad had 'misused' his position as railway minister, through his 'cronies' and the only sanction required was for prosecution in the corruption case, which the agency had taken. He further pointed out that the RJD chief had directly approached the high court when the argument on charge is yet to commence in the case before a trial court and the said submissions could be made before the trial court too. Based on CBI's case, ED had initiated the probe. In its first chargesheet filed in January last year, the ED named RJD chief Lalu Prasad's wife and former Bihar chief minister Rabri Devi and their daughters, Misa Bharti, and Hema Yadav. The federal agency, also named a 'close associate' of the Yadav family Amit Katyal, railway employee and alleged beneficiary Hridayanand Chaudhary, and two firms AK Infosystems Pvt Ltd and AB Exports Pvt Ltd, through their common director Shariqul Bari. In its first 100-page supplementary charge sheet filed in August, ED had named Lalu Prasad Yadav, Tejashwi Yadav, and eight others as accused in the money laundering case.

New Delhi [India], May 31 (ANI): The Rouse Avenue court issued an open-ended non-bailable warrant (NBW) against three persons, including a company's CMD, in a money laundering case linked to a Rs 1200 crore bank fraud case. This case is related to Amira Pure Foods Private Limited. Two of the accused are not in India. According to the report of the Foreign Regional Registration Office (FRRO), Karan A Chanana left the country in 2017 and Anita Daing in 2016. Special CBI judge Amitabh Rawat issued an open-ended warrant against three persons: Karan A Chanana, Anita Daing and Rajesh Arora. Open-ended NBWs are warrants without a date for execution and do not have a time limit. Special judge on May 28 disposed of the application filed by Enforcement Directorate (ED) on April 5, 2025, for issuance of open-ended Non-Bailable Warrant against accused persons, namely Karan A. Chanana, Anita Daing and Rajesh Arora. 'Let it be executed through lawful available means in respect of the accused not in India,' special judge Amitabh Rawat said in the order passed on May 28. The application for cancellation of the NBW issued against Karan A Chanana was also dismissed by the court on May 28. ED had prayed for issuance of open-ended Non-Bailable Warrant against three respondents, namely Karan A. Chanana, Anita Daing and Rajesh Arora. Special Public Prosecutor (SPP) Simon Benjamin, Manish Jain, alongwith Snehal Shard, appeared for ED. It was submitted that the investigation under PMLA conducted by the Prosecuting Agency is being prejudiced and adversely affected due to continued non-compliance with the summons issued by the Prosecuting Agency. It was further submitted that these three are Directors/Ex-Directors and key decision-makers of M/s Amira Pure Foods Private Limited, the defaulting entity, and their joining of the investigation is necessary to bring the investigation to its logical end. Investigation related to these accused persons is pending. A Prosecution complaint against some other accused has already been filed. Enforcement Directorate (ED) had made effort to serve summons dated 08.11.2024 at Karan A Chanana's London based known addresses through MHA under MLAT. Chanana was directed to appear in person before this Directorate on 14.02.2025 in compliance of the Summons. However, Karan A. Chanana failed to comply with the said summons and a response was received vide letter dated 01.02.2025 (received through email dated 02.02.2025) wherein his representative informed that Karan A Chanana is unable to make himself physically present on 14.02.2025 due to his deteriorating health condition. Earlier on November 20 2024, Non Bailable Warrants (NBW) against these accused were issued by the court. It was also submitted that the respondents deliberately, intentionally, and knowingly avoided their presence before the IO in compliance with summons issued under Section 50(2) and (3) of PMLA. The Central Bureau of Investigation (CBI) registered an FIR on 23.11.2020 under Section 120B, 420, and 471 of the Indian Penal Code (IPC) Act, 1860, and the Prevention of Corruption (PC) Act, 1988, on the basis of a complaint dated 17.11.2020 filed by Canara Bank. In the said FIR, it was alleged that the accused company, M/s Amira Pure Foods Private Limited, through its Directors, Promoters, Employees, and others, committed fraud by siphoning and diverting funds, criminal misappropriation, criminal breach of trust, cheating, fraud, etc., causing wrongful loss to the tune of approximately Rs 1201.85 crores to the consortium of banks led by Canara Bank. On the basis of the CBI FIR, ED had registered the present case 22.06.2022 under PMLA. It was argued that investigation conducted by the Directorate revealed that M/s Amira Pure Foods Private limited was sanctioned fund based and non - fund based limits by a consortium of Banks led by Canara Bank to the tune of approximately Rs 1,367 crores from 2009 to 2016. The stated purpose of the loan as per the loan documents was, inter-alia, for working capital requirements. The account of the company was declared as Non Performing Asset (NPA) on 29.09.2017. The account of M/s APFPL was declared as fraud by all the member Banks to the tune of approximately Rs 1,201 crores. The company not only defaulted in repayment of interest but also failed to submit its financial statements, net worth particulars of guarantors, routed transactions outside consortium lenders, did not enable stock audits etc, it was added. Investigations by ED showed that said entity siphoned off/ diverted the borrowed money to the tune of Rs 734.20 crores through non-genuine and sham business transactions with various fictitious entities, which were used as a conduit for the diversion of money of the lenders. ANI 31 May 2025, 15:44 GMT+10 New Delhi [India], May 31 (ANI): The Delhi High Court has dismissed a plea by RJD chief and former Railway Minister Lalu Prasad Yadav seeking to stay trial court proceedings in the alleged 'land-for-jobs' corruption case, investigated by the CBI. Justice Ravinder Dudeja ruled that Yadav remains free to present his arguments before the trial court at the charge consideration stage, stating there were no compelling reasons to halt proceedings. Represented by Senior Advocate Kapil Sibal, Yadav sought to quash the FIR, arguing that the CBI failed to obtain mandatory prior approval before proceeding with its inquiry. He contended that while approval was secured for others, it was not obtained in his case. The trial court is scheduled to commence arguments on charge framing on June 2. The CBI, opposing the petition on maintainability grounds, argued that sanction under Section 17A of the Prevention of Corruption Act was not required. It further stated that while sanction under Section 19 was necessary, it had already been obtained. The agency also informed the court that the issue raised is currently pending before the Supreme Court and is expected to be heard by a three-judge bench. The Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) are investigating former Bihar Chief Minister Lalu Prasad Yadav, his family, and several others in connection with the land-for-jobs case.
