MCMC begins public consultation on regulatory framework for spam messages

PUTRAJAYA: The Malaysian Communications and Multimedia Commission today commenced a two-week public consultation on the proposed Regulatory Framework for Unsolicited Commercial Electronic Messages (UCEM), commonly known as spam.
In a statement, MCMC said the initiative is pursuant to Section 233A of the Communications and Multimedia Act 1998, which was introduced following legislative amendments gazetted in February 2025.
The proposed framework aims to strengthen consumer protection, promote responsible digital marketing practices, and foster a safer and more trustworthy digital ecosystem.
In line with the new provision, MCMC is developing subsidiary legislation to establish a clear, coherent and enforceable structure to address the increasing prevalence of UCEM.
The public consultation invites feedback from a wide range of stakeholders, including industry players, civil society organisations, consumer groups, lawmakers and members of the public.
Stakeholders are invited to review the consultation document and provide feedback on the proposed regulatory approach during the consultation period from Aug 13 until 5pm on Aug 27.
"This initiative reflects the commission's commitment to a transparent, inclusive, consultative and evidence-based policymaking process," MCMC said.

KUALA LUMPUR: The Malaysian Communications and Multimedia Commission (MCMC) has requested to remove nearly 38,000 false contents and 8,000 posts related to race, religion and royalty (3R) from social media platforms in a three year period. Communications Minister Datuk Fahmi Fadzil said th ministry takes the issue of the spread of false information on social media seriously, especially when it involves attempts to manipulate sentiments related to the race, religion, and royalty (3R) by irresponsible parties, including political troll accounts. "From Jan 1, 2022 to July 1, 2025, a total of 7,846 3R-related contents and 37,845 false contents were removed by platform providers at MCMC's request under Section 233 (for improper use of network facilities or services) of the Communications and Multimedia Act. "Each removal action is carried out based on existing legislation, regardless of the political background or beliefs of the individual, to ensure that freedom of speech is not abused. "The final assessment is also subject to the platform providers according to their community guidelines," he said in a written reply to Kampar member of Parliament Chong Zhemin. He said the MCMC works closely with the police to enforce the Communications and Multimedia Act and other existing laws. "Action can be taken against any individual under Section 233 under the Communications and Multimedia Act who misuses application services, including social media, to create and disseminate false or extremely offensive content with the intent, among others, to hurt, harass, or disturb others. "To further strengthen online safety, Fahmi said MCMC had introduced licensing requirements for internet messaging and social media service providers to obtain the Application Service Provider Class License, effective Jan 1, 2025," he said. Fahmi also said to mitigate online harms, service providers are encouraged to adopt the Code of Conduct (Best Practices) for Internet Messaging and Social Media Service Providers, which was issued by MCMC on Dec 20, 2024.

GEORGE TOWN: Police have warned against a planned gathering by Umno Youth scheduled for Thursday (Aug 14) in Bertam, Kepala Batas. Citing concerns over public safety and order, Penang police chief Comm Datuk Azizee Ismail urged the public to steer clear of the gathering, which arose from the upside-down Jalur Gemilang controversy. "We urged all parties to wait for the instruction from the Deputy Public Prosecutor (DPP) and refrain from any actions that could spark unrest," he said in a statement on Wednesday (Aug 13). Comm Azizee said police are also investigating the individual who recorded and circulated a video of the inverted flag under Section 233 of the Communications and Multimedia Act 1998. He added that 38 police reports have been lodged nationwide so far, 17 coming from Penang and 21 in other states. "The investigation paper was completed and submitted to the Penang DPP's office on Aug 11, and is now under review," he said. On Aug 9, a 59-year-old hardware shop owner in Kepala Batas, Penang, was investigated after the national flag was found hanging upside-down outside his shop. The shop owner claimed that it was an unintentional mistake made while measuring a flagpole, which he corrected shortly after. Umno Youth chief Datuk Dr Muhamad Akmal Saleh previously announced plans to stage a protest at the shop, but the gathering did not take place after police were stationed in the area and advised against it. The scheduled protest, believed to be organised by Umno, has instead been moved to the Kepala Batas night market site located about 2km from the hardware shop. Akmal has been vocal against improper displays of the Jalur Gemilang and said he wanted to visit the shop owner to "teach" him how to display it properly.
