[UPDATED] Zara Qairina case: 5 teenage girls to be charged with bullying
KUALA LUMPUR: The five teenage girls to be charged tomorrow in connection with Zara Qairina Mahathir's case will be charged only for bullying and not related to the death of the 13-year-old student, said the Attorney-General's Chambers (A-GC). As such, the A-GC said an inquest must still be conducted to determine the actual cause of Zara Qairina's death. In a statement today, the A-GC said this in response to calls from lawyers representing Zara Qairina's family, who urged the department to postpone the charges against the minors and instead charge them under Section 507D(2) of the Penal Code for causing a person to believe that harm would be inflicted. It added that the decision to proceed with the current charge was based on evidence and facts obtained during the investigation, adding that the offence concerns bullying and has no link to the 13-year-old's death. It also described the lawyer's remarks in Paragraph 4 of the media statement as speculative and not supported by verified facts. "In this regard, we once again stress that the charge under Section 507C(1) of the Penal Code is based on the findings of the investigation," read the statement. Earlier, the family of Zara Qairina called on the attorney-general to charge five teens suspected of bullying her under Section 507D(2) of the Penal Code, which carries up to 10 years' jail, a fine, or both. In a statement, the family's lawyers said they have appealed to the attorney-general to suspend prosecution under Section 507C(1) of the Penal Code. The five minors are expected to be charged at the Kota Kinabalu Juvenile Court tomorrow in connection with the bullying case involving Zara Qairina. Zara Qairina, a SMKA Tun Mustapha student, was found unconscious at her school dormitory in Papar on July 16 and was pronounced dead the following day at Queen Elizabeth Hospital.

Man arrested for spreading fake statements on Zara Qairina case
KUALA LUMPUR: Police have arrested a man for spreading false statements about the investigation into the death of Form One student Zara Qairina Mahathir on social media. Bukit Aman Criminal Investigation Department director Datuk M Kumar said the man, 51, was found to have uploaded a two minute and six second video to a TikTok account on Aug 15 containing the audio conversation of a supposed pathologist who claimed that the death of the student was a premeditated murder. 'A mobile phone believed to have been used in this case was also seized,' he said in a statement here today, adding that the case is being investigated under Section 4(1) of the Sedition Act 1948, Section 505(B) of the Penal Code and Section 233 of the Communications and Multimedia Act 1998. 'The suspect was arrested at 10.20 pm yesterday and has been remanded for three days starting from today till Aug 21.' He also warned that the police would take stern action against those deliberately spreading rumours or manipulating facts aimed at causing fear or concern among the public or disrupting court proceedings. He also advised the public to not simply believe information on social media without verifying its accuracy and urged all parties to allow the authorities to conduct their investigations professionally. Zara Qairina, 13, died at Queen Elizabeth I Hospital in Sabah on Aug 17 a day after she was found lying unconscious in a drain near her school dormitory. – Bernama
