In a major blow to the practice of comunidades to settle court cases with tenants through the sharing of disputed land, the Supreme Court has held that such arrangements violate both the Tenancy Act and the Land Use Act, effectively circumventing statutory protections for agricultural land.
The SC, in its judgment delivered on Monday, dismissed an appeal by the comunidade of Tivim, upholding a lower court's decision to deny permission for a proposed 60:40 land-sharing compromise with agricultural tenants.
The verdict of Justices Sudhanshu Dhulia and K Vinod Chandran said that the proposed compromise terms 'fall foul of both the statutes' — the Goa, Daman and Diu Agricultural Tenancy Act, 1964, and the Goa Land Use (Regulation) Act, 1991.
The court said that such arrangements create 'freehold ownership rights over tenanted land, without resorting to the procedure contemplated for the purchase of such land by the tenant'. The arrangements, the SC said, allow parties to use agricultural land for non-agricultural purposes, which is 'expressly barred by the Land Use Act'.
The dispute arose over two properties, Oiteil-De-Madel and Levelechy Aradi, belonging to the comunidade of Tivim, which were leased to tenants in 1978.
After the tenants' predecessor was declared an agricultural tenant by a trial court in 2017, the comunidade appealed against the decision.
During the pendency of the appeal, the comunidade's general body meeting in March 2021 resolved to compromise by offering a 60:40 land division — 60% to the tenants and 40% to be retained by the comunidade.
However, the administrative tribunal denied permission for this compromise under Article 154(3) of the Code of Comunidades, which requires the tribunal's approval for any compromise involving comunidades.
The high court upheld this decision, which was subsequently challenged in the SC.
The apex court observed that the proposed compromise constituted an 'abuse of the process of law'. The court said that the consent terms effectively granted 'full ownership rights' to both parties and allowed them to use the land 'for any purpose whatsoever', directly violating statutory restrictions.
Justice Dhulia, writing for the bench, observed that the compromise would 'wipe out tenancy rights' that were legally declared by the trial court and bypass the specific procedures laid down in the Tenancy Act for the termination of tenancy and purchase of land by tenants.

The woman suffered torture and was forced to change her religion, leading to her death while she was seven months pregnant, Wagh said. A person can follow any religion and convert another person with consent, but law does not permit the use of force, cheating or enticement for conversion, the chief minister said. 'Complaints of coercion or inducement for conversion will lead to investigation and action against the concerned organisation,' Fadnavis added. The state government had formed a panel headed by the Director General of Police (DGP) for giving recommendations to deal with such cases, and it has submitted its report, he said. The government will study it and bring in new (legal) provisions so that conversions do not happen by force or cheating, he said. 'Action can be taken under the Bharatiya Nyaya Sanhita (BNS) in such cases. But a panel was formed to suggest strict provisions. The state government has the intentions of bringing in strong provisions to deal with such cases, and we will take a decision on this soon,' he said. In the letter, the chief secretary said that the implementation of the Prevention of Sexual Harassment (PoSH) Act in workplaces and institutions is essential to ensure a safe, respectful, and inclusive environment for all, particularly women. He has also directed the department heads and authorities that the compliance report on the action points be submitted to the Department of Women and Child Development within 15 days. 'Sexual harassment not only violates an individual's dignity and rights but also undermines productivity, morale, and equal opportunities,' he said. Ahuja also mentioned in the letter that by enforcing the POSH Act, organisations fulfil their legal and ethical responsibility to prevent, prohibit, and redress instances of harassment. He said it fosters a culture of accountability, encourages reporting without fear, and builds trust among employees or members, ultimately contributing to a healthier and more equitable work or institutional space. Ahuja has also advised all the department authorities to go for the constitution of Internal Committee (IC), capacity building and sensitisation, time-bound inquiry and redressal mechanism, annual reporting and transparency and responsibility of management. 'The head of the institution shall be held personally responsible for ensuring effective implementation of the POSH Act, as well as for any lapses in safeguarding complainants and preventing retaliation,' Ahuja said. The chief secretary also asked all administrative heads to constitute or revalidate IC and ensure meeting of IC once in a month for the next six months to create awareness and build momentum for the campaign against sexual harassment in educational institutions. Thereafter, the ICs should meet in each quarter as per the Act. He also said that the authorities to ensure that the grievance redressal mechanism, such as the She-Box portal, along with details of the IC is prominently displayed in multiple locations in all institutions, mandate periodic awareness and capacity-building sessions for all staff and students, monitor and enforce compliance through regular inspections and require all institutions to submit status reports. The college and school authorities are also told to regularly visit educational institutions and interact with students, the chief secretary said. The second-year student of Fakir Mohan (Autonomous) College in Balasore died at AIIMS-Bhubaneswar on Monday night. She had set herself on fire on the college campus on July 12 over inaction against a professor who allegedly sexually harassed her. Stating that the state government is committed to ensuring the safety, dignity, and empowerment of women in all educational and professional environments, Ahuja said district administrations are therefore expected to act with urgency and diligence to create a safe environment for girls and women and uphold the provisions of the law in both letter and spirit. Vijayawada: The Supreme Court on Thursday set aside the order of AP high court granting anticipatory bail to former Gannavaram MLA Vallabhaneni Vamshi Mohan in the alleged illegal mining case, while asking it to hear the matter afresh and decide the case on merits. The state govt preferred an appeal before the apex court challenging the high court order. Senior counsel Mukul Rohatgi, arguing on behalf of the state govt, submitted that the high court granted anticipatory bail in a mechanical manner without considering the objections of the state govt. Considering the arguments, the SC bench comprising of Justices Sanjay Kumar and Satish Chandra Mishra found fault with the high court order. The bench said they are not inclined to go into the merits of the case and are remanding it back to the high court to hear the matter afresh. Directing the state govt to file a counter affidavit, the bench asked the high court to decide the matter within four weeks. The SC also directed police not to take coercive steps against Vamshi till the matter is decided by the high court. Vamshi was made an accused in the case registered by Gannavaram police following a complaint lodged by officials of mining dept over alleged illegal mining. An inquiry by the vigilance dept assessed that the state exchequer incurred a loss of Rs 195 crore due to illegal mining in Gannavaram assembly constituency. Vamshi moved an anticipatory bail plea before the HC after police filed a prisoner transit warrant.
