
Developer liable for defects to Subang Parkhomes' common property
PUTRAJAYA : The Court of Appeal has unanimously dismissed a developer's appeal, affirming its liability to the joint management body (JMB) of a Subang condominium for loss and damage arising from defects in the common property.
A three-member bench chaired by Justice Che Ruzima Ghazali upheld a judgment entered by the High Court in the JMB's favour, saying the ruling was sound both in law and fact.
'We decline to disturb the finding of liability,' said Che Ruzima, who sat with Justices Zaini Mazlan and Shahnaz Sulaiman.
Che Ruzima also said the High Court did not commit any error in ordering an assessment of the damages payable.
The bench also ordered the developer, Zen Estate Sdn Bhd, to pay costs of RM20,000 to Subang Parkhomes' JMB.
The JMB represents some 475 condominium purchasers who had bought their respective units at between RM800,000 and RM1 million. Vacant possession to the units was delivered in 2013 and 2014.
Following its formation in 2016 under the Strata Management Act 2013 (SMA), the JMB sought out the developer to hand over all documents to facilitate the management and maintenance of the units and the common property.
It subsequently took out an application for discovery and, in 2020, filed a negligence suit against the developer over defects to the common property.
The complaints included leaks to the roofs of its penthouses and at the complex's basement carparks, as well as damage to the tiles of its jacuzzi and swimming pools.
The JMB also claimed the developer had failed to ensure that all electrical installations complied with the Electricity Regulations 1994.
In its defence, Zen Estate contended that the complaint pertained to maintenance and that the 24-month defect liability period had lapsed. Accordingly, it argued that the suit was unsustainable.
In the High Court last year, Justice Wong Kian Kheong ruled in the JMB's favour, holding that the loss and damage suffered were reasonably foreseeable.
Wong, now a Court of Appeal judge, said the developer was aware that the JMB would eventually be constituted to assume responsibility for maintaining and managing the common property. He said Parliament had via the SMA expressly conferred statutory duties and powers on the JMB to carry out these functions.
Wong held that the developer's obligations arose by operation of law and the absence of a contractual relationship with the JMB did not affect its claim.
'This is because the tort of negligence in itself is a cause of action which is independent of any contract between the plaintiff (JMB) and the defendant (Zen Estate),' he said.
He also found that loss and damage suffered was reasonably foreseeable.
Wong said the defects were attributable to the developer and ordered that damages — including for rectification work already carried out by the JMB — be assessed and paid.
He also ordered the developer to compensate the JMB for loss of use and enjoyment of the common property in a sum to be assessed.
Lawyers CK Lim, Julian Chan, David Yii and S Hemashantini represented the JMB while Cheryl Tay and Carmen Liao acted for the developer.

Kidnapped Palestinian man found bound with cable ties at Hulu Langat chalet
KUALA LUMPUR: The High Court here was told today that police found a Palestinian man with his hands and feet bound with cable ties during a raid at a chalet room in Hulu Langat nearly three years ago. Assistant Superintendent Mohamad Jazlan Sharif, 42, who is currently with the Criminal Investigation Division (Operations and Intelligence) at the Dang Wangi district police headquarters, said he and a team from the D9 Criminal Investigation Division of Dang Wangi and Kuala Lumpur police were deployed to the scene on Sept 29, 2022. "During the raid at Room 112, two men (Muhammad Iqmal Abdul Rahis and Mohamad Sufian Saly) suddenly ran out of the room towards the roof, but my team and I managed to apprehend them after a brief struggle. "We then found a man inside the room with his hands and feet bound with cable ties. We freed him and asked for his identification documents, which revealed that he was a Palestinian," he said during examination-in-chief by deputy public prosecutor Mohd Sabri Othman. He said this while reading his witness statement at the trial of the kidnapping of a Palestinian man faced by eight accused, namely Tengku Arif Bongsu Tengku Hamid, 44, Mohamad Naziree Mustapha, 44, Faizull Hardey Mohd Isa, 45, Muhammad Iqmal Abdul Rahis, 30, Mohd Zaidi Mohd Zain, 59, Nidarahayu Zainal, 39, Raibafie Amdan, 44, and Edy Ko'im Said, 45. The police officer, who is the third prosecution witness, said that the police also raided room 110, where they found three men — Tengku Arif Bongsu, Mohamad Naziree, and Faizull Hardey — along with 36 black cable ties in a transparent plastic bag. He said the raid followed the arrest of Mohamad Norakmal Hassan on the same day. Mohamad Norakmal and five others had been charged with a similar offence - abducting and unlawfully detaining a Palestinian man - and were sentenced to five years' jail each after they pleaded guilty to the charge. The five individuals charged with him are Mohd Azwan Jamaludin, 42; Dody Junaidi, 47; Mohamad Sufian Saly, 28; Tengku Hazarul Ismail Tengku Hamid, 54; and Muhammad Al Hatim Mohd Fauzi, 28. According to the charge, the eight accused were jointly charged with wrongfully confining a 31-year-old victim to obtain a reward, specifically, secret information on creating and deactivating computer software used to hack mobile phones. They are alleged to have committed the offence at Jalan Mayang here at 10.40pm on Sept 28, 2022, under Section 3 of the Kidnapping Act 1961, read together with Section 34 of the Penal Code. If convicted, the offence carries a prison sentence of between 30 and 40 years and whipping. Meanwhile, Tengku Arif Bongsu, Nidarahayu and her husband, Raibafie, are also facing 19 additional charges under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, involving more than RM250,000.

Man To Hang For Murder Of Bangladeshi Worker In Kampung Gajah
IPOH, Aug 8 (Bernama) -- The High Court here today sentenced a man to death by hanging for killing a Bangladeshi man in Sungai Kinta, Sungai Galah area, Kampung Gajah in Perak Tengah district, seven years ago. Judge Su Tiang Joo sentenced Mohamad Amier Amzar Mohamad Aspar, 28, after the man was found guilty of killing MD Ovaidul, 32, at the location between 8.20 pm and 10.25 pm, Dec 15, 2018, under Section 302 of the Penal Code. Su in his judgment said he agreed with the prosecution that the murder was premeditated and committed in an extremely brutal manner by the convict. "It could have caused much pain and agony to the deceased over a prolonged period of time in between the beating in his house and then being taken to the riverbank before the fatal cut was administered by the accused and the body unceremoniously dumped into the river to hide traces of the crime. "In other words, the death was not sudden and quick. In the second circumstances, I accept the presumptions of the prosecution that the death sentence would be appropriate and I sentence the convict to be punished with death and pursuant to Section 277 of the Criminal Procedure Code, the accused is to be hanged by the neck until he is dead," he said. Su said he found that there are more aggravating circumstances than mitigating circumstances, among them are the convict interfering with prosecution witness, the pain and suffering from the injury suffered and the extent of the injuries, and the accused dumping the body of the deceased into the river. "The convict is a Malaysian and the deceased a Bangladeshi national. This is a neutral circumstance because under Article 8, Sub-Article 1 of our Federal Constitution, all persons are equal before the law and are entitled to the equal protection of the law," he said. Earlier, MD Hossain Khan, the victim's brother, also delivered a victim impact statement with the help of an interpreter on behalf of his family in Bangladesh. MD Hossain said MD Ovaidul was the third of six siblings with both parents still alive, besides the family was dependent on the victim working in Malaysia to support their livelihood in Bangladesh.

Two former senior Perak Immigration officers freed on corruption charges
IPOH: The High Court here acquitted and discharged two former Perak Immigration officers on charges of soliciting and receiving bribes. They are former Perak Immigration Director Zulhairin Yahya, 53, and former Head of the Perak Immigration Prosecution Unit Zaidi Dali, 57, who were alleged to have solicited and accepted bribes seven years ago. Lawyer M. Athimulan, when contacted by Bernama, said Judge Moses Susayen acquitted Zulhairin and Zaidi after allowing their appeal on Friday (Aug 8). "In short, the judge found their conviction unsafe. Therefore, the court allowed the appeal of both accused and ordered them acquitted and discharged," said Athimulan, who represented Zaidi. On Sept 23, 2022, Zulhairin and Zaidi were sentenced by the Sessions Court to three years in prison and fined RM85,000 each after finding them guilty of soliciting and receiving bribes. Judge S. Indra Nehru sentenced the two men to three years in prison and a fine of RM50,000, and another 10 months in prison if they failed to pay the fine, for the offence of soliciting a bribe of RM10,000 every month so that no inspection would be carried out at an entertainment centre in Manjung. They were also sentenced to three years in prison and a fine of RM35,000, in default eight months in jail, each, for two offences of receiving a bribe of RM7,000. Zulhairin and Zaidi were allowed a stay of the execution of their prison sentences pending their appeals at the High Court. The two men were jointly charged with soliciting a bribe of RM10,000 per month from Nga Chee Jiek, as an inducement to ensure that no inspection and raid were carried out on an entertainment centre in Pusat Bandar Seri Manjung. The offence was allegedly committed at the Club House Meru Valley Golf & Country Club here at 9pm on Nov 5, 2015. Zulhairin was also charged as the Perak Immigration Department Director with obtaining a bribe of RM7,000 from Nga through Zaidi, as an inducement to ensure no inspection and raid were carried out on the same entertainment centre at the Knock Knock Meru Jaya Restaurant here, at 12.05am on Nov 12, 2015. Zaidi was also charged in his capacity as the Head of the Prosecution Unit of the Perak Immigration Department with obtaining a bribe for himself and the State Immigration Director amounting to RM7,000 from Nga, as an inducement to ensure that no inspection and raid was carried out on the same entertainment centre at the Meru Valley Golf & Country Club car park here, at 9.55pm on Nov 11, 2015. All the charges were framed under Section 16(a)(B) and Section 17(a) of the Malaysian Anti-Corruption Commission Act 2009 which is punishable under Section 24 of the same act and provides a maximum prison sentence of 20 years and a fine of not less than five times the amount or value of the bribe or RM10,000, whichever is higher upon conviction. The prosecution was represented by Deputy Public Prosecutor Maziyah Mansor, while lawyer Mohd Baharuddin Ahmad Kassim acted on behalf of Zulhairin. – Bernama
